Contents:

The objective of this subject is to enable students to understand the


institutes of administrative law and to acquire knowledge of conducting
proceedings and of decision-making in specific procedures for making
decisions on the rights and obligations in administrative relations. This
subject will help students to understand the conduct of power holders and
bearers of public authority and their decision-making. It will also make
them familiar with regulations and help them to be able to apply them
when making decisions in specific administrative cases. Furthermore
students will be able to apply the positive law norms of substantive and
procedural law in specific cases.

Contents:

Within this subject students will gain an in-depth knowledge about


fundamental concepts of administration law and about some special
administrative institutes. Special emphasize will be given to rights of
parties in administrative procedures and on a protection of these rights.
Students will get acquaintance with some concrete problems of
administrative regulation in practice. The objective of this subject is to
enable students to understand administrative law and to acquire
knowledge of how to conduct proceedings and of decision-making in
specific procedures.

Contents:

The course offers students the knowledge of basic principles of business ethics that
stems out of common social and personal ethics, and manifests itself through
positive business customs. At the same time students are acquainted with the legal
regulations of the free market economy, with special emphasis put on competition
protection, on preventing the restraint of trade, and consumer protection.

The course is divided in two parts:

1. In the first part students are acquainted with the basic principles of ethics and
morals, and positive business customs are explained as the foundation of
business morals. Special emphasis is put on the theory of integrating and
separating moral from law regulations. The practice of the Honourable Court at
the Chamber of Trade of Slovenia is studied as well.
2. In the second part the competition protection law is dealt with, with special
emphasis on protection against unfair competition. At the same time special
forms of preventing the restraints of trade are studied. The subject focuses
specially on consumer protection.

COURSE DESCRIPTION

This course provides students with basic knowledge of criminal investigation as


a science of detecting and investigating crime and apprehending perpetrators.
The course examines the historical roots and development of criminal
investigation (criminalistics) in different countries in the world, investigation's
connections to criminal law, criminal procedure, forensic science and law
enforcement agencies and their tasks – including international police
cooperation. It provides theoretical questions of finding the truth about the
criminal offence, gives basics of how to investigate crime (seeking and
obtaining information – interview, interrogation, eyewitness testimony, etc. -
crime scene investigation, the use of clues, hypothesis building, the use of
polygraph etc.) and how to use physical evidence (forensic sciences) in criminal
investigation and at the court.

COURSE OBJECTIVES

During the course students will:

- Develop an understanding of the science and practice of criminal


investigation
- Develop an understanding between criminal investigation and criminal
procedure in Slovenia and other European countries and USA;
- Develop an understanding of international crime problems
- Develop an understanding of cooperative efforts between police and justice
agencies of various countries
- Get basic knowledge of how to do practical criminal investigation
- Get basic knowledge of the use of forensic sciences

COURSE METHOD & RELATED NOTES

Interactive lecture, facilitating active learning is the primary course method


utilized. Additional handouts or audio-visuals will supplement class session.
Power point presentation will be regularly used.

COURSE REQUIREMENTS & EVALUATION

Students are expected and obliged to:

- attend all class sessions & actively participate


- complete assigned readings prior to class
- be prepared to discuss assigned readings in class

Special arrangements can be made with professor for individual foreign


students who do not have to attend regular classes and a possibility of oral
exam can be disscussed.

Students’ final grades for this course will be determined by performance on one
exam worth 100 points.

Examination construct may include a combination of multiple choice, short


answer/essay questions, term definitions and matching formats. Examination
questions will be derived from assigned readings, lectures, audio-visuals, and
discussions. Some form of bonus opportunity may be offered on the exam at
the professor's discretion.

This subject aims to present sources of deviate, especially criminal,


behavior. Criminal behavior is analyzed by using psychological and
sociological methods. This subject is a completion of subject Criminal Law
where students get to know material background and regulation of this

Contents:

Economic criminal law is specific criminal-law branch. Similar as Criminal Law also
Economic Criminal Law is divided into two parts: general and special part. Main
stress in the general part is on the criminal liability of natural persons and liability of
legal entities for criminal offences. The special part concentrates on some specific
economic criminal offences. Beside the knowledge about theoretical and practical
views of economic criminal law also the key points for understanding of economic
crime and the present forms of this kind of criminal activity will be presented to the
students.

More precise look into the contents of the subject:

GENERAL PART OF ECONOMIC CRIMINAL LAW:


 Economic criminal law: conception of economic criminal law, definition of
economic criminal offence, sources of economic criminal law, comparative
review of economic criminal legislation, selected themes from the general part
of economic criminal law.
 Liability of juristic persons for economic criminal offences: conception and
bases for juristic persons’ liability, borders of juristic persons’ liability.
 Criminal sanctions for economic criminal offences: sanctions for natural
persons, sanctions for juristic persons, the appropriateness of the sanctioning
system.

SPECIAL PART OF ECONOMIC CRIMINAL LAW:


 Insolvent criminal offences, criminal offences of unfair competition, criminal
offences connected to the industrial property protection, criminal offences
connected to the securities (stocks), abuse of economic powers, other
economic criminal offences.

Examination:
If the class sessions are arranged, students are expected and obliged to:
- attend class sessions & actively participate
- complete assigned readings prior to class
- be prepared to discuss assigned readings in class.
Otherwise the students are expected and obliged to follow the individual program,
indicated by the professor.
At the end of the course, students have to pass written or oral examination

Contents:

The aim is to offer the students two point of view about the role of environmental
law – administrative point of view and civil law point of view. These two areas
supplement each other in the view that only administrative rules do not solve all
issues related to the environment and its protection but that also civil law rules on
liability must apply. Considered will be also international pollution cases where
special rules apply and modern mechanisms when doing business with the
environmental issues.

Environmental law includes:

Part One: Introduction is made to the basic characteristic of the environmental


protection and the role of law in this respect. The principles of environmental
protection law are hereby explained and also the rules governing the civil liability for
damage caused to the environment.

Part Two: In part two the students will be equip with the comparative view of legal
rules, which regulate the civil responsibility for the damage made to the
environment.

Part Three: This part aims to define rules, which apply to the cases where damage
occurs to the environment in the international relationships. This part comprises
study of several international cases, like Bophal, Seveso, etc.

Part Four: In the last part some new instruments in resolving environmental issues
are presented, like the role of privately financed infrastructure objects, which aimed
to preserve environment, i.e. waste-water treatment plans, etc. Emphasis is added
to the Built-Operate-Transfer business within the environmental projects.

Contents:

The objective of this subject is to understand the purpose of protection of


competition in the context of European Community law and certain types
of restrictions of competition with capacity to solve actual legal problems
related to this. The subject aims to teach students to solve legal problems
in this field of law and to analyse the decisions, including using
information technology. On completion of this course the student will be
able to understand the objects, meaning, and extensiveness of European
competition law, to demonstrate understanding and use of the basic
concepts in the field of European competition law and to recognize the
possibility of restriction of competition in practice and use the relevant
competition rules in concrete cases.

This equips the students with the understanding of the aims and objectives of the
European Union. The focus will be on the substantive law of the European
Community, explaining and analysing the basic legal principles that underpin the
institutional organisation, the internal market and the competition law of the
Community. The study will include current problems of enlargement.

Contents:

One of the most important parts of criminal procedure is undoubtedly the


way of finding out relevant legal facts. Within this subject students will get
acquainted with methodology of finding these facts and about detailed
explanation of a judgment. Judging is closely connected to systematic
formation of premises and argumentation of the decisions. This subject is
closely connected to Criminal Procedure Law but gives further explanation
and an in-depth knowledge of evidence, like which evidence cannot be
used and why. This acquaints students with issues that have not only
theoretical but also practical meaning.

Contents:

Students are acquainted with the basic characteristics of insurance law as an


independent commercial activity. The issues dealt with are the status of insurance
companies, the content of the contract between the insurer and the insured, and
various types of insurance.

The course is divided in two parts:

1. The first part focuses on the status of insurance companies, with special emphasis
on setting up, management and financial dealing of the companies. Limited
Liability Insurance Companies and Mutual Insurance Companies are dealt with
separately. Emphasis is on the Agency for insurance supervision, authorised to
supervise the work of insurance companies.

2. The second part focuses on contractual insurance law and special contractual and
insurance issues, such as co-insurance and reinsurance. Assets insurance and life
insurance are dealt with separately. Above mentioned insurance groups are
further divided into special kinds of assets and personal insurance, with special
emphasis on obligatory insurance (insurance each Slovenian citizen has to have).
National Insurance is not dealt with. Shipping and other transportation insurance
are dealt with only superficially.

Contents:

Students are acquainted with the origin and the importance of international labour
law as an independent legal branch. They are acquainted with the problems that
accompany the migration of work-force and the capital, and that condition the
formation of more new universal as well as regional regulations concerning labour
and social security. The existing knowledge about the process of employing foreign
citizens in Slovenia and of casual labour of Slovene citizens in foreign countries is
deepened and extended. Law graduates are thus enabled to successfully deal with
ever arising problems concerning labour and social security conditioned by the
extensive participation of Slovenia in foreign trade. Therefore students are also
acquainted with the development of the law and the social policy of European
countries, members of the European Council and the European Economic
Community. In addition to that students study the legal issues concerning labour
unions at home as well as in foreign countries.

Globalisation of the world economy largely affects labour law – international as well
as internal stately norms. Therefore special emphasis is put on the effect the
globalisation has on the norms of the labour law.

This subject aims to present a concept, a purpose and a function of


comparative law. Furthermore students will get to know a comparative
method which is becoming more and more important for explanation of
international contracts as well as for usage of international private law.
Within this subject the most important legal systems will be presented,
especially German, Roman, and Anglo-American, with special emphasize
on German, Austrian and Swiss legal system which are very similar to the
Slovenian one. At the end of the course students will be able to use the
comparative methods in order to retrieve and understand the relevant
sources of foreign law on institutes of foreign law, and to compare the
institutes of foreign law to related institutes of their own legal system.

Its aim is to offer the students two point of view the role of private international law,
how the situation with foreign relationship is handled in Slovenian legal system and
abroad. Within the subject different topics are considered, especially detailed
regulation of conflicts of law, rules on international jurisdiction,
recognition/enforcement of the foreign judgements and arbitral award. Topics are
taught also from the point of view of the Law of the European Union.

Contents of PIL are:

Part One:
Introduction is made to the basic characteristic of the private international law and
the common – basic rules which help to apply special private international rules. The
word is about common principles and institutes of private international law, like
qualification, renvoi, public order etc.

Part Two:
In part two the students will be equip with the rules on applicable law, taking into
account special areas, like international contract law and non-contract law,
international inheritance law, international family law etc..

Part Three
This part defines rules on jurisdiction, procedure, recognition and enforcement. This
part is therefore focused to procedural issues. Domestic procedural rules also apply
for international cases, but they are partial supplemented with special rules for
international cases.

This subject aims to present different aspects of legal regime of real


estates from the view of private and public law. It deals with different
institutes of immovable property law, such as ownership and other
property rights. Furthermore it deals with obligatory aspects (e.g. leasing)
as well as with some public issues (public law restrictions of ownership)
and special regimes for some sorts of immovables. After the course
students will be able to demonstrate understanding of institutes of
immovable property law and to apply legal rules in concrete typical cases,
which means to find out the relevant actual situation and subordinate it
under the suitable law institute.

Contents:

This subject aims to provide students with complex knowledge on


securities law. The content consists of two parts.

In the general part students will become aware of theoretical


fundamentals of securities law: notion of securities, characteristics of
securities, economic importance and functions of securities, development,
sources of securities law, sorts of securities, dispositions with securities,
etc.

And in the special part particular types of securities will be presented:


shares, bonds, coupons, bills of exchange, cheques, bills of lading and
others.

Contents:

The course concerns trading with securities and examines the contractual, corporate,
public and competition aspects. The aim is to acquaint the students with different
types of securities, and to understand the difference between debt and equity
securities, their transfer and their dematerialization. The students will also learn the
aims of different types of financing.

The course is divided into:

A. Securities
The theories and basic principles of securities, various types of securities: equity
securities (shares), debt securities (bonds) and hybrid securities (Convertible Bond,
Participating Bonds, etc.).

B. Trading with securities


Primary and secondary market, authorised participants, institutional infrastructure of
the market, underwriters, takeovers, options, futures, dematerialization, insider-
dealing, investment fonds.

The objective of this subject is to understand a specific legal branch,


which regulates contracts on carriage of goods, passengers and baggage
and to acquire capacity to solve actual legal problems related to the
carriage of goods and passengers.
Upon the completion of this subject a student will be able to analyze
specific questions on contracts of carriage and to apply statutory rules and
decide questions relating to the legal relationships arising from the
transport of passengers and goods.
