RESIDENCE CONTRACT - SELF-CATERED RESIDENCES -42 WEEKS-NEW STUDENT


THIS CONTRACT the terms and conditions of Endsleigh's insurance cover please see www.studentroomcover.co.uk and the
University's Termination Policy and Accommodation - Your Essential Guide provided by the University create legally binding
obligations between the University and the Student so please read them and make sure you understand their terms before you sign. This
Contract is governed by English law which international students may find is quite different to the law which applies in their own
country. Take advice before signing if you feel you need it.

Common Parts any shared kitchen bathroom common or other room allocated to the Accommodation and
those parts of the University's property which are necessary for the purpose of gaining access

inventory handed out with the keys
Deposit £150 (to be paid before the closing date stated in the University's offer letter to the Student)
Contents Insurance Cover £ 8.00 (inclusive of insurance premium tax and the University's administration fees) payable
on or before the first Payment Date
Communities Contribution £40 payable on or before the first payment date. This is a contribution towards organised
social events at the Residence

This contract will only come into effect before the Student accepts keys for the Accommodation if the Student has paid the Deposit and
notified the University of a payment method for the remainder of the Residence Charge
AND EITHER:
paper contract
The Student has accepted the terms and conditions by signing this Contract and this Contract has been signed and dated by the
University
OR:
online contract
The Student has accepted the terms and conditions by clicking OK on the Accepts Terms and Conditions screen on the online Contract
and the University has sent the Student a Confirmatory Email.

The University will not normally release keys until the above pre-contract formalities have been complied with, but it may do so in
exceptional circumstances. If the University does release keys for accommodation to a student who has not complied with the above
formalities, the student - by accepting the keys - accepts a tenancy of the accommodation on the terms and conditions set out in this
Contract. In such a case, that student must (if requested by the University) complete the above formalities as soon as reasonably possible
after accepting the keys. In such cases, references in this Contract to "Accommodation" shall be references to the accommodation for
which the student has accepted keys, and references to Student shall be references to the student who accepted the keys. All students
have the same rights and obligations once they accept keys for accommodation.

The University agrees to grant to the Student the Rights for the Period of Residence on the conditions set out in this Contract, in the
Accommodation - Your Essential Guide provided by the University and the terms and conditions of personal possessions insurance set
out at www.studentroomcover.co.uk . The Student agrees to accept the Accommodation and comply with their obligations set out in this
Contract, Accommodation - Your Essential Guide, and in the personal possessions insurance policy.

1.0 Students Obligations


1.1 To pay the Residence Charge by direct debit or by credit/debit card (unless an alternative payment method has previously been
agreed) to the University in advance on or before the Payment Dates and to pay the Contents Insurance Cover with the first
instalment of Residence Charge. Within 7 days of demand, to pay to the University interest and administration fees amounting to
£35 for each instalment of Residence Charge that has not been paid by the due Payment date
1.2 To pay the Deposit to the University by credit/debit card online and notify the University of a payment method before the closing
date stated in the University's offer letter to the Student
1.3 To check the inventory and report (to the address stated on the inventory) any discrepancy within 7 days of the start of the Period
of Residence
1.4 To keep the Accommodation the Contents in the Accommodation and (jointly with other students) the Common Parts and the
contents in the Residence in a clean and tidy condition
1.5 To leave the Accommodation and return it to the University in a clean and tidy condition and free of all the Student's possessions
and return all keys and any safety certificates to the University at the end of the Period of Residence
1.6 To allow the University at reasonable times after giving 24 hours notice to enter the Accommodation for the purpose of viewing
inspection cleaning maintenance or repair (no notice being necessary in an emergency or where the disrepair or any other
incident affecting the Accommodation's suitability for occupation and use was reported by the Student)
1.7 To comply with all applicable legislation to the extent that this is necessary to avoid the Student's actions or negligence having
an adverse effect on the University or on the owners or occupiers of nearby property
1.8 To comply with the University's policies rules and regulations relating to Health and Safety -see Web pages

1.9 To report to the University any damage or want of repair to the Residence or failure of the Services as soon as reasonable
practicable and in any event within 24 hours of becoming aware of it and to replace any light bulbs in the Accommodation
whenever necessary
1.10 To pay to the University all costs reasonably incurred in enforcing the Student's obligations or arising from a breach of them.
This includes returning the Accommodation to the condition it was in when let to the Student and the University's proper and
reasonable administration charges for dealing with a breach. The administration fee for each demand for payment or reminder
letter which the University sends to the Student is £10. The Student is liable to pay the University for any damage caused by the
Students visitor(s).
1.11 Where damage or loss occurs at the Residence and it is not possible for the University (acting reasonably) to ascertain who is at
fault, to pay a fair and reasonable proportion of the cost of repairing the damage or reinstating the loss including a proportion of
the £35 administration fee
1.12 Promptly to send to the University a copy of any communication the Student receives which is likely to affect the
Accommodation or the Residence

1.13 Not to do anything which may cause damage to the electrical installation or equipment in the Residence or which may be a fire
risk or in any other way put the health and safety or security of others or the University's or others' property or the University's
block insurance policy with Endsleigh (see www.studentroomcover.co.uk) at risk. The University operates a No Smoking policy
in all its residences and if the Student persistently breaches that policy the University may terminate this Contract under clause 5.
Smoking in certain parts of the University is also a criminal offence. The University has placed appropriate warning signs in
these areas
1.14 Not to put anything harmful or which is likely to cause blockage in any pipes or drains
1.15 Not to remove from, affix to, change, damage or attempt to repair the structure or decorative finish of the Accommodation the
Common Parts of the Residence or the Contents
1.16 Not to bring additional furniture into the Residence
1.17 Not to use the Accommodation for any purpose other than as a study bedroom
1.18 Not to share the Accommodation or sub-let it or transfer occupancy to any person
1.19 Not to cause any nuisance, offence, disruption, harassment or persistent disturbance to others
1.20 Not to add to or change the telephone services to the Accommodation without the University's prior written consent
1.21 Not to order or buy electricity, gas or mains water supplies from anyone other than the University's supplier
1.22 Not to bring into the Residence any animal unless it is an aid for a disabled person
1.23 Except for designated vehicle storage or parking areas, not to bring onto the Residence any vehicle unless it is an aid for a
disabled person
1.24 Not to cause any obstruction of the Common Parts
1.25 Where damage to the Residence is caused by an intruder, to report the incident to the police as soon as possible (and in any event
within 48 hours) and to provide the police incident report number to the University within 7 days of receiving it

2.0 University's obligations


2.1 To provide the Services, namely:
(a) repair of the Residence
(b) lighting of the Common Parts
(c) supply of hot and cold running water and heating to the Residence
(d) electricity and gas supply to the Residence
(e) insurance of the Residence and insurance of Student's personal possessions
(f) cleaning the Residence as described in Accommodation - Your Essential Guide
2.2 To put the Accommodation and the Contents into the condition described in the inventory provided that within 7 days of the start
of the Period of Residence the Student has reported any deficiency
2.3 To return the Deposit to the Student (after making any proper deductions) as soon as possible after the termination of this
Contract or, if the Student has reserved University accommodation for the next academic year, carry forward the Deposit (or any
remaining balance) and offset it against the Students future liability to pay a deposit
2.4 Except in an emergency, for reported repairs or reasonable access to ensure the continued use and occupation of the
Accommodation and for routine cleaning on the designated days to give the Student at least 24 hours notice prior to entering the
Accommodation
2.5 Not to interrupt the Student's occupation of the Accommodation more than is reasonably necessary
2.6 Not to disclose personal information obtained from the Student except as permitted by clause 3.2 of this contract or where there
is a serious risk of harm to the Student to others or to the University's or others' property

3.0 Other conditions


3.1 The Student is responsible for the conduct of any invited visitor(s)
3.2 The Student hereby authorises the University to use his/her personal data for all lawful purposes in connection with this contract
(including debt recovery, crime prevention, the University's block insurance policy with Endsleigh, measuring satisfaction and
trying to ensure a proper student mix in the Residence) or where there is a serious risk of harm to the Student to others or to the
University's or others' property
3.3 The University's liability for loss or damage to person or property is excluded unless the loss or damage is caused by the
University's negligence or a breach of its obligations in this Contract and personal belongings left in the Accommodation are at
the Students' own risk. Although the Student's personal belongings (up to a maximum value of £3,000 in total) are insured under
the University's block insurance policy with Endsleigh (see www.studentroomcover.co.uk) that insurance is subject to the
conditions, exclusions, limitations and excesses of the policy. "Top-up" insurance cover is available direct from Endsleigh, and
details of how to arrange this are given on the Endsleigh web-site
3.4 The University is not liable to repair any damage caused by the Student unless the cost is met by insurance (any excess on the
policy being payable by the Student) or by the Student
3.5 This Contract does not affect the University's disciplinary powers
3.6 The University is entitled at the Student's expense to remove from the Residence any article which constitutes an obstruction or a
fire or safety risk but (unless perishable) will return it to the Student on termination of this Contract
3.7 This Contract is a student tenancy under paragraph 8 of Schedule 1 to the Housing Act 1988
3.8 Notices under this Contract must be in writing and the University's address for service is given on the first page of this Contract
3.9 This Contract is not intended to confer any benefit on anyone who is not a party to it

3.10 This Contract (together with Accommodation - Your Essential Guide, Termination Policy provided by the University and the
terms and conditions of Endsleighs insurance cover) contains all the terms agreed to by the University and the Student at the time
it comes into effect and any variation to the terms will only be effective if agreed between the Student and a member of the
University's accommodation office staff. The University will confirm any agreed variation to the Student in writing at the time
the variation is made
3.11 The University may use the Deposit in settlement or part-settlement of any breach by the Student [or their guest(s)] of the
student's obligations in this Contract and/or towards payment of any of the charges due under this Contract

4.0 Termination of this contract


4.1 The University may terminate this Contract if the Student is a first year and has not taken up residence by 21 September 2009 or
arranged a late arrival date. Full details are set out in the Termination Policy which forms part of this Contract.
4.2 The University may terminate this Contract at any time by serving notice on the Student if
(a) any payment is overdue by 21 days or more or
(b) the Student is in serious or persistent breach of any of the Student's obligations or
(c) the Student does not have status as a registered student of the University or
(d) in the reasonable opinion of the University the health or behaviour of the Student constitutes a serious risk to him/herself or
others or the University's or others' property
The Termination Policy which forms part of this Contract, sets out the consequences for the Student if the University exercises
its rights to terminate under this clause.
4.3 The Student may only terminate this Contract in the limited circumstances set out in the Termination Policy which forms part of
this Contract. The Termination Policy sets out the financial and other consequences for the Student if the Student applies to
terminate this Contract.

5.0 Relocation
(a) The University reserves the right to relocate the Student to comparable alternative accommodation during the Period of
Residence where it is reasonable to do so
(b) The University will normally only relocate the Student if reasonably necessary because of the Students breach of one or more
of their obligations in this Contract, or for the efficient operation of residences, or if (in the Universitys reasonable opinion) the
Accommodation is or becomes unsuitable for occupation
(c) If the reason for relocation is because of the Students breach of one or more of their obligations in this Contract, the Student
will not have any right to terminate this Contract as an alternative to relocating
(d) If the relocation (for whatever reason) is temporary the Student will not have any right to terminate this Contract as an
alternative to relocating and will occupy the Accommodation when the period of temporary accommodation comes to an end
(e) If the University wishes to relocate the Student for the remainder of the Period of Residence for reasons of efficiency or
because the Accommodation will not be suitable for occupation for the remainder of the Period of Residence the Student will
have the right to terminate this Contract (without having to comply with the conditions in clause 4.3) as an alternative to
relocating
(f) Where it is not possible to provide temporary accommodation in the same locality as the Accommodation, the University will
reimburse the Student for proper and reasonable additional travelling expenses, as well as removal costs (this will not apply
where the reason for relocation is the Students failure to comply with their obligations in this Contract).
(g) Where the University relocates the Student because the Student is in breach of one or more of their obligations in this
Contract or where the relocation is made at the Student's request the Student shall pay to the University an administration and
cleaning charge of £25
