Re. My situation

Dear Ms. Giovanni:

Thanks for your response (Attached) to my second request for assistance from
the Governor.

I am a sixty one year old Black male. My shoe size is nine and a half, and
the enclosed photographs is my foot. The condition have been diagnosed as pedal
edema, and is prevalent amoung members of the homeless population.

According to Court records, a Crime was in progress at the HOME DEPOT


Shopping Center, in Elmont New York, while I was sitting in my "parked vehicle," on
Martin Luther King Jr. Day last year. I was confronted by two uniformed Police
Officers, interrogated about internet access, the Elmont Public Library, and
ordered to move. I complied. While still in the parking lot talking with the
uniformed Officers, and on the phone, Officer Magnuson, a former New York City
Police Officer arrived on the scene shouting, “get off the phone, get off the
phone, you are under arrest. There is a warrant for your arrest in New York City. I
was arrested and deprived of vehicle, which is the source of my income. I have been
unemployed and living on the street since then. Homelessness has its repercussions.
The photographs speak for themselves.

Following the arrest I was charged with; DRIVING W/O SEATBELT; AGGRAVATED
UNLICENSED OPERATOR MOTOR VEHICLE; OPERATING MV W/O LICENSE;
OPERATING MV WITH SUSPENDED/REVOKED REGISTRATION; UNREGISTERED MOTOR VEHICLE.

Prior to the arrest on June 26 2006, I was charged with; AGGRAVATED


UNLICENSED OPERATOR MOTOR VEHICLE; OPERATING MV WITH SUSPENDED REGISTRATION;

OPERATING MOTOR VEHICLE WITHOUT INSURANCE, and FAILURE TO RETURN
LICENSE/REGISTRATION PLATES,following a traffic stop in Suffolk County. (Docket
#2006SU036423S)

The basis for the charges and justification for my prosecution in both
proceedings was the abstract of my driving record. Its inaccurate. The false
information is the same as the Police Department's computer.

A thirty second review of the actual record, clearly shows, contrary to


suspension orders #CO-510270000 - "NO INSURANCE" and #J255433 - FLD TO ANSWER; my
vehicle is insured, the summons #4230255433 was answered, and my driver's license
was in effect after the suspension date.

The obvious discrepancies which I did not cause, could not have prevented,
cannot correct, and does not constitute my violation of any Law, were brought to
the attention of the Suffolk County Criminal Court, and District Attorney by motion
to dismiss. On November 20 2006, the motion was granted and all charges were
dismissed.

At the time of my arrest, and was deprived of my vehicle, it was legally


registered and insured. My experience is the same as a that of a victim who was
carjacked and abducted in a shopping mall, and unlike a motorist with a suspended
driver's license whose unregistered, and uninsured vehicle was impounded.

The DMV is responsible for maintaining the accuracy of my driving record, and
the discrepancies were brought to its attention on numerous occasions beginning as
early as November 2005.

My drivers license and vehicles registration was suspended for over five
hundred days, as a result of discrepancies.

Any assistance to correct the discrepancies, and assert my rights as


guaranteed by the Crime Victims Act will be highly appreciated.

What borough was your car impounded in? When was it impounded? What was the stated
reason it was impounded? Who was it impounded by? Have you been told there is a
fine to have the car returned? Who have you spoken to about this already?
