TSVANGIRAI FACES CHARGES AFTER PRIVATELY
INSISTING SANCTIONS ‘MUST BE KEPT IN PLACE’
Zimbabwe is to investigate bringing
treason charges against the prime
minister, Morgan Tsvangirai, and
other individuals over confidential
talks with US diplomats revealed
by WikiLeaks.
Johannes Tomana, the attorney
general, said he would appoint a
commission of five lawyers to ex-
amine whether recent disclosures in
leaked US embassy cables amount
to a breach of the constitution.

insisted sanctions "must be kept in
place".
High treason in Zimbabwe can
result in the death penalty. Tomana
told the state-owned Herald news-
paper: "With immediate effect, I am
going to instruct a team of prac-
tising lawyers to look into the issues
that arise from the WikiLeaks.
"The WikiLeaks appear to show a
treasonous collusion between local
Zimbabweans and the aggressive
international world, particularly
theUnited States."
State media reports have said hard-
line supporters of the presi-
dent,Robert Mugabe, want an offi-
cial inquiry into Tsvangirai's discus-
sion of international sanctions with
the US ambassador in Harare.
Mugabe's Zanu-PF party said last
week the government should draft a
law that makes it a treasonable
offence to call for sanctions. The-
Movement for Democratic
Change leader "acknowledged that
his public statements calling for
easing of sanctions versus his
private conversations saying they
must be kept in place have caused
problems," the memo states.
It says: "If necessary, he said, he
and [deputy prime minister Arthur]
Mutambara can quietly meet with
western leadership to develop a
plan on the issue of sanctions. He
said that he and Mutambara have
decided to take this issue out of the
hands of the negotiators and handle
it personally."
Defenders of Tsvangirai might note
that, in the same US cable, he is
described as asking for some
"flexibility" in sanctions. It says:
"Zanu-PF has implemented a strat-
egy of reciprocity in the negotia-
tions, using western sanctions as a
cudgel against MDC. He
[Tsvangirai] would like to see some
quiet moves, provided there are
acceptable benchmarks, to 'give'
some modest reward for modest
progress."
Tsvangirai's aides say he is not
guilty and describe the controversy
as personal attacks on the prime
minister. Beatrice Mtetwa, a leading
human rights lawyer, said it would
be very difficult to mount a legal
case on the basis of WikiLeaks.
"If there is a commission to look into
WikiLeaks, it will have to investigate
everything WikiLeaks has dis-
cussed, including officials from
Zanu-PF," she said. "It cannot be
selective. When it comes to wit-
nesses, are they going to call back
the former US ambassadors? The
cables are based on opinion, not
fact. There are a host of legal prob-
lems."
Asked if she could rule out treason
charges against Tsvangirai, Mtetwa
replied: "From a legal perspective it
would be folly. But I'm not going to
say it's unlikely because the attor-
ney general has been known to
chase rainbows against us. He was
put in the position for that particular
reason."
Last week, the US treasury depart-
ment imposed restrictive measures
on the attorney general, saying his
actions undermined the country's
democratic institutions.

2010 was the influence of Tea
Party voters on the Congressional
landscape. The new Congress

expect angry visits from senior
citizens and lobbyists ready to fund
a candidate back home who sup-
ports the status quo.
But millions of Americans now
realize that the status quo is an
illusion that will not last even anoth-
er 10 or 20 years. The federal gov-
ernment cannot continue to spend
a trillion dollars more than it collects
in revenue each year because we
are running out of creditors. Fiscal
reality is setting in and the conse-
quences may be grim, even if Con-
gress finds the courage to take
decisive action now.
Courage begins with a commitment
to see things as they are, rather
than how we wish they were. When
it comes to Social Security we must
understand that the system does
not represent an old age pension,
an insurance program or even a
forced savings program. It simply
represents an enormous transfer of
payment with younger workers
paying taxes to benefit the other
beneficiaries. There is no Social
Security trust fund and you don’t
have an account. Whether you win
or lose the Social Security lottery is
a function of when you happen to
be born and how long you live to
collect benefits. Of course young
people today have every reason to
believe they will never collect those
benefits.
Notice that neither political party
proposes letting people opt out of
Social Security, which exposes the
lie that your contributions are set
aside and saved. After all, if your
contributions are really set aside for
your retirement, the money is there

of the London School of Econom-
ics expects a genetic upper class
and a dim-witted underclass to
emerge.
The human race would peak in the
year 3000, he said - before a de-
cline due to dependence on tech-

RECUSE YOURSELF!
A recuse law — if you, as a
congressperson, senator, assem-
blyperson, county supervisor or
other elected, take any money from
an organization, then you should be
required to recuse yourself from
every vote which relates to or af-
fects that organization.
The Supreme Court has recently
ruled that the money flowing from
corporations, for example, to the
U.S. Congress cannot be stopped
because political participation via
campaign contributions is part of a
class of activity protected by the
First Amendment.
The only viable way to ensure
that office holders’ cast votes based
on policies’ merits rather than the
gross campaign contributions re-
ceived from one side of the issue or
the other, therefore, is to ensure
that those who take money sit out a
vote when that contributor’s legisla-
tion is put forth.
With regard to minimum wage, a
recuse law would mean that unions
could no longer buy legislative
votes because legislators taking
money from unions would have to
recuse themselves from all pro-
posed labor law legislation. Our
lawmakers would find themselves
deciding early to not take big corpo-
rate contributions, lest they be seen
as ineffective for not voting on a
substantial number of matters be-
fore them.
