22. Discrepancies Between Tender/Contract Drawings And Written Specifications

22.1 The tenderer shall take note that in the event where discrepancies are found
between the Tender/Contract Drawings and written Specifications in the
Tender/Contract Documents unless otherwise specifically clarified by the
Architect and/or Engineer in writing prior to the execution of the Contract, the
following interpretation shall apply and the Tenderer shall comply with the
interpretation accordingly:-

a) Where there are no details or specifications on the Tender/Contract Drawings


itself but detail written Specifications including schedule of works / bills of
quantities and schedule of finishes are given in the Tender/Contract Documents,
then the written specifications including schedule of works / bills of quantities
and schedule of finishes shall take precedence over the drawings. The tenderer
shall tender according to the requirements of the written Specifications
including schedule of works / bills of quantities and schedule of finishes.

b) In a situation where there is no written Specifications exist in the


Tender/Contract Documents at the time of tendering but details are given in the
Tender/Contract Drawings, only then the Tender/Contract Drawings shall take
precedence over the absence of written Specifications.

c) In the event where the details on the Architect’s and/or Engineer’s


Tender/Contract Drawings differ from the written Specifications including
schedule of works / bills of quantities and schedule of finishes, there is in fact a
discrepancy and conflicting specification in the Tender/Contract Documents,
then the higher grade of specification shall prevail.

23. Documentation Fees

23.01 The Tender Documents may be obtained from the office of CT Project
Management upon payment of documentation fees during working hours, made
payable to CT Project Management in the form of Cash, Banker’s Draft, Money
Order or Crossed Cheque.

23.02 The Documentation Fees of the Tenderer will not be refunded to the Tenderer but
will be used to defray the cost of lithography and printing.

24. Tender Deposit

23.01 A Tender Deposit payable to CT Project Management in the form of Crossed


Cheque or Banker’s Draft is required upon collection of the Tender Documents.
Tender Deposit is refundable to all unsuccessful tenderers where bona fide tenders
have been submitted in good condition and after acceptance of tender had been
decided upon. The Tender Deposit is not refundable to the successful tenderer but
will be used to defray the cost of contract documentation.

24.02 If the Tenderer does not return all Tender Documents and Tender Drawings, the
total Tender Deposit shall be forfeited.

24.03 If a tenderer is unable to tender after taking the Tender Documents, he must notify
the S.O. in writing not later than one day before the closing date. Otherwise the
whole of the Tender Deposit will be forfeited.

24.04 If a Tenderer shall:-

(a) withdraw his Tender before the expiry of the Tender Validity Period, or

(b) impose additional terms, conditions or stipulations after the final date fixed for
the submission of Tenders (in which case it shall be deemed to be withdrawal of
his Tender), or

(c) in the event of the Tender having been accepted, refuse and fail to execute the
formal Contract Agreement or to deposit the Performance Bond or fail to
proceed with the Works,

then in any of such events, the Tender Deposit will be forfeited.

25. Submission of Tender

25.01 The tender documents shall be duly completed, enclosed and sealed in an envelope
bearing no identification of the tenderer on the outside. The sealed envelope shall
be marked on top left corner with following caption:-

“CADANGAN MEMBINA SEBUAH KILANG 1 TINGKAT BERSERTA RUANG PEJABAT 3


TINGKAT DI ATAS PLO 230, MUKIM TEBRAU, DAERAH JOHOR BAHRU, JOHOR DARUL
TAKZIM UNTUK TETUAN OVERSEASTEEL HARDWARE & MACHINERY S/B.”
- TENDER FOR MAIN BUILDING AND ASSOCIATED EXTERNAL WORKS ”
and delivered by hand or sent by pre-paid registered post addressed to CT Project
Management at No. 43A, Jalan Pulai 7, Taman Pulai Utama, 81300 Skudai,
Johor, Malaysia not later than 12:00 noon on October 2010.

25.02 Any tender delivered after the stipulated time and date for whatever cause or
reason arising shall be disqualified.

25.03 Notwithstanding the above, the Employer shall in no way be held liable for any loss
or late tender submitted. Proof of posting will not be accepted as evidence for the
submission of the tender.
