Re: Steve Shiver

This report has been written in response to false allegations made by Steve Shiver (a.k.a.
Roy Stephen Shiver, Jr., a.k.a. Roy S. Shiver, a.k.a. Roy S. Shiver, Jr., a.k.a. Stephen
Shiver, a.k.a, Roy Stephen Shiver, a.k.a. Shiver Roy S. Jr.) that he has been the target of
improper policing by the Homestead Police Department (H PD). His claims are without
merit. Mr. Shiver has been the subject of three separate, unrelated and properly
conducted criminal investigations by the Homestead Police Department over the past
two and a half years. Two of the unrelated cases are still open and one has been closed.
This first report will only address the closed case in which Mr. Shiver was the subject of
a narcotics investigation. The two other cases are still active.

The Shiver narcotics investigation was initiated in March of 2018 after a life-long friend
of Shiver was arrested for possession of illegal drugs (Tab 1). On March 6, 2018,
Homestead police stopped an individual by the name o f - for a moving
violation) which resulted in an arrest after police discovered illegal drugs in - •s
vehicle. Upon being booked at Homestead Police Headquarters, - requested to
speak with a specific Homestead Police Department detective (who was not involved
with the original stop or arrest) claiming that he had information about "a bigger fish."
At-•s request, the detective met with him while he was still in custody at
Homestead Police Department Headquarters. - proceeded to claim in the
interview with tbe detective that Shiver has been a habitual cocaine user for yeaTs and
t h a t - was his routine dealer (Tab 2). - also provided descriptions of what he
claimed were Shiver's usual method of payment for the cocaine, the normal process for
delivering the cocaine to Shiver's house, and provided the names of others who he
claimed were dealers from whom Shiver also purchased drugs. - claimed that
Shiver would call him and say, "I need an eight ball of cocaine. I put money on the card."
- claimed that Shiver would provide him with an ATM card with instructions to
withdraw the amount of money needed to purchase the cocaine. - claimed that he
would then check the account associated with the card, retrieve the funds from an ATM,
pick up the cocaine, and deliver it to Shiver's house in Homestead and keep a small
profit for himself. - advised that the last time Shiver called him was the day that
Shiver was appointed to the Police Benevolent Association. - went on to say to the
detective, "Next time Shiver calls me, I will call you, and when I deliver to his door, you
can bomb rush him."

The City was able to obtain copies of Shiver's personal bank account statements from his
bankruptcy proceedings which included detailed information about ATM cash
withdrawals from Shiver's account (Tab 3). The records indicate that throughout 2017,
Shiver's bank account was accessed regularly late at night in the form of ATM
withdrawals in areas known for high drug and criminal activity (Tab 4). These locations,
most of which are in Florida City include Sam's Hideaway (750 S Krome Ave), Circle K
(970 W Palm), Food Ma1t (970 W Palm), El Charrito Mini Mart (636 W Palm),
Walgreens (52 E Palm Dr.), Race Track (35426 S Dixie), Texaco (400 SE 1 Ave), Mobil
Lucy (777 S Dixie), Ceuter State Bank (302 W Palm Dr.), and Shell (Palm Dr. & US1)
(Tab 3 & 4). Shiver's bank records frequently show repeated withdrawals of amounts
ranging between $100 and $400, sometimes occurring on the same day. Withdrawals
would often happen during late-night hours on weeknights, including multiple
withdrawals on the same day from the same location, sometimes just minutes apa1t.
More than half of the withdrawals occurred between midnight and 6 A.M.

During- interview, - claimed that Shiver also obtained cocaine from an

individual by the name of (Tab 2). - is a longtime friend and business
associate of Shiver.

On March 7, 2018, the day after-'s arrest, he and the detective had another
interview. The following are excerpts from the transcript of the recording from
the March ih interview between the Homestead Police detective a n d _
(Tab 5):

In this excerpt, - claimed that Shiver expects home delivery of the cocaine.

Detective: So - okay. So tell me how - you told me - you told me once,

but tell me again. How's this - when Steve wants something, how does it
work? 'Cause you told me he won't come out of the house.

- : No, he's - he's not going to come and get it. Them gonna - when
he calls - he calls, I gotta take it to him bro.

In this excerpt, - claimed Shiver would give him an ATM card to pay for the
cocaine.

- : No, 110 he has a bunk curd -

Detective: Right.

- : -- an account here. He keeps whateve1· in that accounts. If he

doesn't have money in that account, then he comes one account, and puts
the money in this account, like --

Detective: Oh, he transfers it.

-:Yeah.

In this excerpt, - claimed that Shiver is known for his cocaine usage.

Detective: Yeah. So, what about Shiver?

 - : Ain't got no Shiver, y'all know Steve was doing this in the first
place. Everyone knew it that way that he had - uh - that's what
told me, says everybody knew Steve was doing
coke, man. But what are they gonna do about it.

In this excerpt, - claimed that Shiver is a habitual cocaine addict who will
continue to use cocaine.

- : Well, Steve ain't never gonna stop using coke though, I mean -

Detective: He's never gonna stop using it?

-:No,man.

In this excerpt, - claimed that cocaine is Shiver's drug of choice.

Detective: Steve calls you, and you said he always wants an eight ball?

- : Y~uh , h~ - he uin't want less than that man.

Detective: Okay, so he wants eight ball. Strict - stTictly coke?

-:Mhm.

Detective: And he won't come out of the house?

- : Nope. He's scared. He 's been in it, the man, he - he been waiting
to get back into shit like this. And he wants to keep his nose clean.

Detective: What's his end game? What's he want to do?

- : What do you mean?

Detective: What does he -- where does he want to go from here?

- : Run - runfor - when Otis stops, when Oh·s retires, he wants to

locate to Florida City and run for mayor.

 Detective: In Florida City?

-:Yeah.

During the March 6 th questioning o f - the detective asked him how he became
involved with Shiver. - advised that they have been friends since Shiver was a kid.
He went on to tell the detective that he would agree to let the police know when his next
drug sale to Shiver was arranged (Tab 2). The case was closed by police after - told
Shiver that he had a discussion about the investigation with Shiver.

- was subsequently stopped and arrested for a vehicle traffic offense, but was taken
to the hospital afterwards because of complaints of high blood sugar (Tab 6). While at
the hospital waiting to be cleared, - claimed to the officer in the emergency room
that he and Shiver "snort coke" together in Florida City and that they were really good
friends and had known each other for a while. - claimed that these activities
occurred on multiple occasions.

In addition to - s allegations that Shiver has a substance abuse problem, Shiver

himself was asked under oath about whether he had any substance abuse issues. The
following is a sworn deposition from September 2018 before the Bankruptcy Trustee in
Shiver's bankruptcy proceeding (Tab 7):

Attorney: Do you have any drug abuse, substance abuse, or alcohol

abuse problem, sir, or haue you in the past two years? And I won't go ~ I
will try to be mindful on the record, but I need a "yes" or "no" answer to
that question.

Shiver: There have been issues.

Attorney: With you?

 Shiver: Yes.

In a prior section of the deposition, Shiver testified that he did not drink much
(Tab 8):

Q: Are you a big drinker, Mr . Shive,·?

A: No, sir.

Q: Because I see a lot of Best Buy liquors on here, not just sporadic. Like
just here in this three-day period I see Best Buy Liquors for 75, another
Best Buy Liquors for Bo. What are those for, if you know?

A: Liquor, I assume.

Q: Pllrchased by you?

A: No, sir.

Questions about illegal drug use have dogged Shiver for years, dating back to as early as
April, 2001 (Tab 9). In an article written by Jim DeFede in the Miami New Times
(https:/ /www .miaminewtimes.com/news/ a-friend-in-need-635.2845), DeFede
explained that he met Shiver for an interview, where he asked if Shiver had used any
illegal drugs in the past few years. S,hiver responded, "I'm not going to go into that.
We've got too much work at hand." The article continued to read:

"But he refused to respond to any questions about possible drug use in his
recent past. 'I'm not going to go there,' he snapped."

An earlier DeFede article (https://www.miaminewtimes.com/news/under-new-

management-6353104) alleged delays in Shiver undergoing a drug test while serving as
County Manager (Tab 10). According to DeFede, once Shiver finally did submit to a drug

test, he refused to release the results even though he had previously promised to make
the test results publicly available. DeFede wrote:

"County spokeswoman Rhonda Barrett informed me that the results of

his drug scl'eening would not be released and referred all questions
regarding that decision to Shiver."

"His failure to comply with county rules requiring all new employees to
undergo a physical exam and submit to a drug test before beginning
work.fueled questions about past drug use."

Shiver also has a history of incidents requiring police attention, whose reports detail the
possible involvement of alcohol or drug use, including a 2006 altercation between
Shiver and Steve D. Losner, a 2008 DUI arrest in Maggie Valley, North Carolina, and a
2015 domestic dispute with a former girlfriend. On November 3, 2006, Losner went to
the Homestead Police station to report an incident between him and Shiver. The
folJowjng is Losner's incident statement (Tab 11):

"Approx. 3:40 Shive1· arrived at my office @ 65 NW 16ST HMSTD. He

stormed into my private office screaming and arguing about the
sequence of events regarding the CRA audit. He threw his blackberry
phone, continued to scream obscenities, and make political threats. I
became fearful of bodily harm and asked him to leave my office. He did
so only after making threats and behaving erratically .. At the time of
Shiver's arrival, I was on my office phone w/ Curt Ivy. In an earlier
phone conversation Ivy referred to Shiver as "wired." Although I am not
medically trained, I believe Mr. Shiver was under the influence of
alcohol/or drugs. I have never seen anyone act so irrational through
speech and behavior."

On January 16, 2015, Shiver called the police to file a report on a former girlfriend to
whom he owed $17,800 (Tab 12). In the bankruptcy deposition, Shiver acknowledged
that he indeed owed his former girlfriend the money but had not paid her back (Tab 13).
According to the 2015 police repo1t, Shiver complained to the police that the former
girlfriend "made threats to accuse him of having drugs so that he could be arrested (Tab
12)."

On June 7, 2008, Shiver was stopped in Maggie Valley, North Carolina when a police
officer noticed that he had driven up the grnss embankment (Tab 14). Upon stopping
Shiver, the police officer noted in his report that the "driver's eyes were bloodshot and
glassy looking." The report goes on to detail the following observations from the police
officer about Shiver on this occasion:

• "When he spoke to me, his speech was very slurred"

• "I observed that he was very unsteady"
• "l asked Roy to attempt the walk and turn test. Roy stated that he could not do
the test. He stated to me that 'You Got Me"'
• "I could detect an odor of alcoholic beverage on his breath"
• "Roy stated that he would like to talk to the Chief of Police"
• "Roy asked me three times if! was Maggie Valley or Haywood County. I
answered him three times Maggie Valley Police."

prepaid credit card that was provided to him (. .) by Steve Shiver (05/18i1966), advised that
Shiver wl/l call himfllll} and advise "I need an eight ball of cocaine I put money on the card". . .
wlll then check the prepaid card to assure that the money has been uploaded. wlll then go and
pick up an eight ball of cocaine and dellver It to Shivers house In Homestead. . .
advised that the last time Shiver called him was the day that he was appointed to the Police Benevolent
Association (P.B.A). Shiver told Ill that the dude that was the new President of the P.B.A. Is one of
Shivers best friends . . .went on to say that, Shiver also gets cocaine f r o m -
, _ and another guy bv the name of-that hangs out around ■iiil■ Homestec1d,
Florida. Detective- asked. . how he became Involved with Shiver. . . advised that he and
Shiver have been friends sense Shiver was a kid and that he currently rents a house from Shiver. -
went on to tellllll that "next time Shiver calls me I wUI call you and when I deliver It to his door you
can bombrush him." Detective- advised. . that he . . .) was going to Jail for the MOMA and
cocaine but that the two could talk later.

Note: . . advised that Shiver pavs $180.00 for and eight bait of cocaine and that h e - pays

Nobody knows better than Homestead Mayor Roscoe Warren how badly
Steve Shiver has bungled his first two 111onths as county manager. During a
March 8 county commission meeting, Shiver sought to undern1ine the
Hom estead City Council by inforn1ing commissioners they should
disregard a city resolution regarding Homestead Air Force Base. The
council resolution urged the county to accept the 717 acres of federal land
on the base and develop it as son1ething other than a con1n1ercial airport.
Shiver told comn1issioners to ignore that resolution, arguing the city
counciJ didn't know what it was doing because county C01nmissioner Katy
Sorenson hadn't properly briefed council members on all options for the
base.

When Shiver's chicanery first surfaced, Warren was so upset he criticized

the 111anager in a column I wrote ("Strike Three," March 22). Last week
Warren recalled a conversation he had with Shiver following publication of
that colun1n. Shiver phoned Warren hoping he'd retract his statements.
"You made it seen1 like I was a liar," Shiver whined, according to Warren.

"Well, Steve, Warren said he replied, son1ebody has to tell the truth."

In another conversation between Warren and the manager, Warren said he

told Shiver, who preceded hin1 as 111ayor1 that he no longer had the right to
speak on Homestead s behalf, and he certainly had no right to speak for the

mayor. 11 ! don 1t like anybody speaking on my behalf," Warren reiterated.

ln recent days, however, Warren s anger has subsided as he has witnessed

one media outlet after another attack Shiver for being untrustworthy and
n1anipulative. Shiver's credibility is in such disarray that an effort to reform
county procuren1ent procedures failed because the 1neasure would have
placed greater power in the hands of the manager. The plan's rejection was
a clear vote of no confidence in Shiver.

Then on Monday, April 16, Warren read a story in the Miami Herald
regarding the mysterious disappearance of New Times papers fron1 the
lobby of county hall and a suspicious n1alfunction during the rebroadcast of
a televised county commission 111eeting. The glitch excised that portion of
the 111eeting in which comtnissioners criticized Shiver. The article raised
questions about whether Shiver 1nay have had a hand in those two events.
Warren said he was aghast at the story's in1plications: D0 they think n1y

friend Steve Shiver would really stoop to that level?"

A day or two before the Herald article, Warren related that he'd received a
phone cal1 fron1 Bill Losner, a Hon1estead banker and one of the town's
most influential men. 11 He shared with me that Steve was in trouble, 11 Warren
recounted, 11 and he wanted to know what we could do about it to help Steve.
He said he had just had a conversation with Steve and that Steve was really
stressed out and worried."

Despite their differences, Warren and Shiver have been lifelong friends.
Warren, who is 48 years old, said he has known Shiver s family since he was

a child. And so as the controversy surrounding the manager escalated,

Warren made a decision to come to his friend's defense.

On April 18 the mayor penned a letter addressed to all the county

commissioners. "Over the past few weeks I have observed the unwarranted
and often 111alicious attacks on the character and integrity of a 111an I
respect as both a true professional and friend," he wrote.

He went on to describe one of the conversations he'd had with Shiver

regarding Hon1estead Air Force Base shortly after the city council passed its
resolution urging the county to accept the base for economic developn1ent.
"It was during this conversation that I was asked: If I understood 1nore
clearly that a dual-tract option existed that would allow us to pursue the
econon1ic developn1ent conveyance and at the same time attempt to
preserve our right to a commercial airport through litigation, would I have
reconsidered my vote? My answer was yes. 11

That passage in the letter, the n1ayor clarified, is meaningless because there
is no such thing as a "dual tract." It's a n1yth. As long as the county pursues
its lawsuit against the federal government, Warren noted, there will be no
econon1ic development at the base. "The litigation is going to hold up any
developn1ent at the base for years to come,1' he said. "My people do not
want an airport. I have heard that loud and clear.1'

Warren continues to urge the county to drop the pretense of a dual tract
and accept the land. The city council is solidly against an airport," he

added. "We support a mixed"use development for the base, and there is no
way in hell I will go against that."

Although Warren won't say it directly, that passage in his letter was the
figurative lifeline tossed to a drowning man. It gave Shiver son1ething to
cling to, an opportunity to clain1 he hadn't actually lied to the county
commission. But in truth it scarcely offered the n1anager any vindication.

Shiver told comnl.issioners the Homestead City Council was never

presented with information on the alternatives for the base. That was a He.
Katy Sorenson did provide that inforn1ation. Warren's letter also doesn t 1

relieve Shiver of accusations that he was behaving more like a political

hack than a professional adn1inistrator. Nor does it address subsequent
revelations that Shiver has filled his staff with friends and cronies who have
no experience in government adn1inistration.

Warren said his n1otivation in writing the letter was straightforward. "There
are going to be tilnes when, as 1ny friend, you are going to piss 1ne off and
screw up,U he explained, "but I'1n not going to say that our friendship is over
because of it l expect you to screw up from thne to time. And Steve
certainly has screwed up. But that doesn't change the fact that he's 1ny
friend. And that 1s pretty much what I was thinking when I wrote that letter. 11

I asked Warren if he thought I had either 1nisquoted or n1isrepresented his

views in 1ny previous stories. 11 No, not at all," he replied. 11 Your articles and
your stories about Steve were very accurate and I'll stand behind them."

Warren does think I've been too hard on Shiver and believes the public
should give the new n1anager a chance to prove hin1self. On this point we
disagree. The position of county manager is too important to allow
son1eone as unqualified as 34-year-old Steve Shiver the luxury of on-the-
job training.

Drug Test Update

Despite pron1ises that he would release the results of his drug test, Miami-
Dade County Manager Steve Shiver now refuses to make then1 public.
Shiver, who finally submitted to urinalysis on April 9 after postponing the
procedure on three separate occasions, told me just days before he took the
test that he would release the results, even though by law he was not
required to do so.

Last week, however, when I requested the infonnation, county

spokeswoman Rhonda Barnett informed n1e that the results of his drug
screening would not be released and referred all questions regarding that
decision to Shiver. The normally chatty county manager refused to return
phone calls explaining his reversal.

At this point it is even unclear who has knowledge of those test results.
Prospective county employees undergo a physical exam and provide a
urine san1ple at Mount Sinai Medical Center. The hospital sends the sample
to a private lab for testing. Results are then forwarded to the county's
personnel office, where a trained technician interprets the information. The
appropriate supervisor is then notified as to whether the prospective
employee passed or failed. If the individual fails the test, he or she is not
allowed to begin work. Shiver's position as the top county employee adds a
new, and apparently unprecedented, wrinkle to this process. What
independent authority might review his test results or be notified of the
outcome? County officials are unable to provide an answer.

Since his appointment in January, numerous rumors regarding Shiver's

personal Ufe and business dealings in Homestead have circulated an1ong
reporters and political insiders. His failure to cornply with county rules
requiring all new employees to undergo a physical exain and submit to a
drug test before beginning work fueled questions about past drug use.
Further complicating matters, at least for n1e, was his response to questions
during an interview several weeks ago. I specifically asked him if he had
used either marijuana or cocaine since becoming a public official in 1993,
the year he was elected to the Hon1estead City Council. l'm not going to go

into that/' he told me. He said he understands that as manager he should be

held to a higher standard than other county employees, but he still refused
to answer my questions.

On April 5 I reported that Shiver had been scheduled to take a drug test on
one previous occasion, but he claimed he was forced to cancel it. The
man ager offered several explanations, some of the1n contradictory, for that
cancellation. New Times then discovered Shiver actually h ad been
scheduled to take his drug exa1n on three separate occasions -- February
27, March 15, and March 19 -- and each ti1ne the appointn1ent was canceled.

In a me1no last week to Commissioner Katy Sorenson, who questioned why

Shiver had postponed his physical exam and drug test, the 1nanager blamed
his secretary, Hilda Suarez. "I never scheduled or rescheduled the
appointments," he wrote.

The memo went on to state, When I inquired about this, it was a1nusing to

see that one reason Ms. Suarez rescheduled the physical was due .in part to
a lunch with the author of the New Times article you were influenced by. 11

Indeed I did dine with Shiver on February 27. He had called and asked if I
wanted to 1neet over lunch . I said sure and let him pick the date. Why that
would force him to cancel his appointment is beyond me. I'm also baffled as
to why he would find that amusing.

At this point even if Shiver were to release the results of his drug screening 1

the information might not be definitive because 74 days passed between the
ti1ne Mayor Alex Penelas announced Shiver's selection as n1anager and the
day he finally provided a urine sample. According to Rhonda Smith, a
111edical assistant who oversees drug testing for Sunshine Medical Testing,
evidence of cocaine ingestion remains in a person's system only three or
four days; for nrnrijuana the period typically is thirty days for a casual user
and upward of sixty days for a regular user.

Time, however, will not diminish the questions regarding Shiver's past.
Every day f receive more infonnation about our new 1nanager. While no
one is asking if Shiver experimented with drugs in high school or college) I
believe it is fair to ask if he has used marijuana or cocaine since being
elected to public office. These are not baseless questions, and Shiver's
response -- "1'111 not going to get into that" ~- just keeps the issue alive.
Reneging on his pledge to release his drug test results only encourages
doubt and suspicion.

The manager s handling of this issue is another exan1ple of his bumbling

and inept 1nanagement style. How long Penelas -- the man who recruited
Shiver for the job -- allows this charade to continue will depend on how
long it takes for Sh1ver s mess to spill over and sully the 1nayor.

Mayco Villafafi.a is a decent 1nan who has been con1n1unications director

for Miami-Dade County for the past two and a half years. "Mayco always
personified integrity and honesty when he worked for me," says forn1er
County Manager Merrett Stierheim, who also worked with Villafafia for
years at the Greater Miami Convention & Visitors Bureau. He was a

professional con1mitted to doing what was in the best interests of the

county."

Last week the man who now occupies Stierhein1's office, 34-year-old Steve
Shiver, abruptly ordered that Villafana be fired. The n1anner in which Shiver
had his order carried out was disgraceful enough to suggest that its real
purpose was to send a message to all county employees: The new 1nanager
will ruthlessly fire anyone he perceives to be a threat.

At 8:00 a.111. last Thursday, March 29, Villafana 1net with Shiver's new
executive assistant, Tom David. The 1neeting, held in Villafafia s office,

lasted no n1ore than five 1ninutes. David quickly got to the point: Villafana
had until 2:00 p.m. to resign, or he would be fired. When Villafana asked for
a reason, David would only say the manager wanted to go "in a different
direction."

Within n1inutes the stunned Villafafia was astonished a second tin1e. A

county employee from the Information Technology Department 111arched
into his office and confiscated his con1puter. Humiliated, he had no choice
but to write his resignation letter at his assistant's desk. "The manager has
the right to assemble his own tean1 of people. I have no problem with that/
Villafana tells me. 1 do have an issue with the way this was done. They

seized n1y con1puter like I was a criminal. I didn 1t deserve that. If they told
me they wanted someone else in the position, I would have sub1nitted n1y
letter of resignation and we could have worked out a s1nooth transition. 11

Villafafia pauses, then concludes, "This was all very distasteful. 11

Stierheim agrees. The manner in which Villafafia was tenninated, he says, is

very disappointing; it leaves me cold."

Word of Villafafia's firing quickly spread throughout county hall, further

eroding confidence in Shiver's ability to do his job. "I've been receiving calls
fron, department heads and other county officials who are very upset with
the way this was handled, Villafafia reports. "You don't treat anybody in that

fashion, but you certainly don 1t treat your professional staff like this.''

Shiver defends his decision to fire Villafana and claims it was pron1pted by
"philosophical differences." He wants someone who will be more
"proactive.'' Ifs fruitless, however, to ask the manager what he 1neans by
proactive. 11 l'm not going to go into details about that," he sniffs.

Villafafia believes he knows why he was fired. ''They think I was leaking
information to you and other me1nbers of the press/ he says. "They think I
was giving you too much information about Chris Hebert."

Chris Hebert is the county rnanager s buddy. Thefve been friends since

hlgh school. The first thing Shiver did in his new position was to hire his pat
who has no experience working in county government -- or even municipal
govermnent. But that was no impedi1nent to Shiver placing him on the
county payroll at a salary of $67,000 per year with an executive-benefit
package worth an additional $14 300. 1

Shiver and Hebert met while attending South Dade High School in
Hon1estead. Shiver was dating the captain of the cheerleading squad, and
Hebert was dating the co-captain. Besides sharing with Shiver a11 affinity
for girls with po111poms, Hebert seen1s to have only one other qualification
for a job in the manager•s office: For the past five years he's worked as the
appraisal depart1nent manager for Shiver s real estate company. 1

In addition to the hefty new salary and benefits package, Shiver gave 35-
year-old Hebert the title public affairs adn1inistrator," a newly minted

county position with no job description and no known n1inilnun1

qualifications. 11 No one understood what that title meant/ recalls Villafana.
We were only told he reported directly to the county manager."

About two weeks ago, along with reporters from the Sun -Sentinel (and
eventually the Miami flerald), I began asking questions about Hebert's
hiring. Until that point, Villafana says, he'd seen Hebert only a couple of
ti1nes and didn t know much about him. Once we started getting all these
1 11

calls fron1 the press about Hebert, I realized there n1ight be a problem and
that I needed to find out what was going on," he recounts.

So Villafafia spoke with staffers in the county's employee-relations office

and learned the manager had not followed regulations in hiring Hebert. As
managet~ Shiver has the authority to hire individuals who answer directJy to
hin1 but he still n1ust adhere to certain guidelines. Por example there must

be ajob description for the position that outlines responsibilities and

qualifications. Job candidates• professional experience n1ust 111eet the
n1inimun1 qualifications, In addition prospective employees must sub111it to
a police background check and undergo a physical exan1, which includes a
drug test. Says Villafafia: ! was told by e111ployee relations that those things

were not done. 11

Then Villafafia began fielding questions about Hebert's past. Reporters

wanted to know if the county was aware Hebert had a criminal record.

ln 1990 Hebert was arrested for grand theft and eventually pleaded guilty to
a n1isdemeanor. In 1992 a bench warrant was issued for his arrest after he
failed to abide by the terms of his probation. Also in the early Nineties, he
wrote a string of bad checks that led to 1nore than a half-dozen
misden1eanor cases being filed against hin1. And since 1998 Hebert has been
driving with a suspended license after failing to pay three speeding tickets.
(Given the suspension of his driving privileges, the fact that Hebert's
con1pensation package includes a $5200 car allowance qualifies as ironic.
Furthennore no one in the county personnel deparllnent seen1s to have
noticed that when Hebert filled out his employ1nent fonns, he presented a
driver license that had expired January 4, 2001.)

On top of all this, a computer database routinely used by journalists

conducting background checks on individuals produced a report tJ1at
claimed Hebert had been arrested in 1990 for cocaine possession. The
information provided by this database is not always accurate, and so last
week Villafafia found himself responding to reporters requests for

verification.

As the queries about Hebert continued unabated, Villafai'ia regularly n1et

with Shiver and Tom David, the manager's executive assistant, to brief them
on the reporters' questions. recom1nended that we needed more concrete

information as to what the real charges were," he relates, and that the

police needed to be brought in to do a thorough background check."

According to Villafafia, the manager agreed, Carlos Alvarez, director of the

Miami-Dade County Police Departn1ent, was ordered to conduct a
background check. Alvarez was taken aback that such a routine procedure
hadn't been co1npleted before Hebert was hired.

Eventually the police departn1ent detennined that Hebert had never been
arrested for cocaine possession. The database was incorrect. But as Shiver
and David waited for Alvarez's report, Villafafia continued updating the111
on the n1edia's interest in this story -- particularly mine.

Two weeks ago I wrote an article about Shiver, docun1enting how he had
lied to the county commission on a sensitive issue relating to the future
develop1nent of H01nestead Air Force Base. That effort to n1islead the
commission underscored for many people the belief that Shiver is neither
qualified for nor capable of being county manager.

Since that article appeared, Shiver has obsessively atte111pted to counter it.
He regularly brings up the subject in conversation and, like a desperate
Captain Queeg, promises that Homestead Mayor Roscoe Warren and Vice
Mayor Nick Sincore (whon1 I quoted to prove Shiver lied) are writing letters
to New Tinies repudiating 1ny account.

New Times is still waiting for those letters.

"The story you wrote about the manager was like a neutron bo111b in this
building,'' says Villafafia Everyone was stunned by it. It was very

demoralizing.''

When I began asking questions about Hebert, Villafana reports, the

n1anager wanted to know what could be done, not just regarding me but
other members of the press as well. "They kept asking n1e how we could
control and 1nanage the media," he says. "I told them, you don't manage the
n1edia. We're dealing with public information. 11

Vil1afafia recalls that during one n1eeting last week, David made it clear he
and Shiver were willing to inislead the public regarding Hebert. ln trying to
explain why Hebert had been hired for a position that didn't even have a job
description, David suggested shifting Hebert from the nonexistent role of
"public affairs administrator" to the already established position of junior
assistant county n1anager. If the press asked) David and Shiver would say it
had always been anticipated that Hebert would fill a junior manager
position, and that Hebert was waiting for David to begin work before
assuming that title. "That's how we are going to spin it," David declared 1
according to Villafalia. (David denies Villafafi.a's version of events and says
he never talked about trying to "spin" the facts. "I don't use words like that,"
asserts David, who last fall ran for the state House of Representatives
against Cindy Lerner and lost.)

When I told Shiver I had spoken to several senior officials in county

government who were upset with the way Vi1lafa11a had been fired, and that
they thought it den1onstrated a lack of class on his part, the nrnnager grew
testy. 11 Well, I hope you print their nan1es," he spit.

As if n1ore evidence were necessary, it's now abundantly clear that Shiver
realizes he wiH never earn the loyalty and respect of the n1en and won1en
working within the county, so he will con1pel their allegiance through fear
and intimidation. And for the record, my interest in Hebert was not sparked
by Villafafia, nor did Villafafia "leak 11 any inforn1ation to me. As one county
insider said of Shiver: There is a certain amount of paranoia setting in

lt s also clear that Shiver has adopted an alarming set of professional

standards. In his universe a dedicated and competent public servant like

Mayco Villafana deserves to be fired, while a man like Chris Hebert, with no
credentials and a questionable past, is worthy of the public s trust.

At the least Chris Hebert is worthy of scrutiny, beginning with his

confession arising fro111 the 1990 theft charges. He was 24 years old at the
time, attending college in Tallahassee and working as a waiter at a
restaurant called Rooster's. According to court records, the owner, Walter
Sidney Rayborn1 caught Hebert and another waiter skin1n1ing 111oney from
the restaurant by )tknowingly falsifying credit-card subn1issions from
patrons in order to pocket the money." The estilnated amount of n1oney
Hebert allegedly pilfered ranged from $700 to nearly $3000.

Rayborn told Hebert that if he confessed, he wouldn't be prosecuted. So

Hebert proceeded to pen a seven-page confession in which he unabashedly
tried to implicate just about every other e1nployee in the restaurant. "Mr.
Rayborn, I don't understand why you don't like me and you do like Derek,"
Hebert wrote, referring to the other person caught stealing fr01n the
restaurant. "It kinda hurts my feelings and 1nakes me feel like l'n1 being
ridiculed more than anyone else. What has happened has put a tre1nendous
strain on me and n1ade me feel very bad.11

Hebert went on to rat out eight other waiters who supposedly also were
stealing from Rayborn. He then identified bartenders who drank whi1e on
duty and members of the kitchen staff who took food. "Many friends of the
cooks have received French dips, chicken tenders, etc.," Hebert asserted.
"This is a fact because I have seen it done."

Hebert summed up the affair with a flourish of indignation. ''The last thing I
would like to say Mr. Rayborn is, even though rny actions where [sic] in very
poor taste and disrespectful to you, n1any, including your own peers, say
that you are disrespectful to them," he stated. "I myse1f do not deserve
respect for my actjons and I took that on my own shoulders. But 111any of
your employees, not counting us, steal for the sin1ple reason that n1orale in
your restaurant/bar is very low. This is because there are no rewards for
good work other than money. People need more to work hard. How many
times has Gary or yourself patted someone on the back and said good work
son. I have been there almost two years and never seen it happen.

Mr. Rayborn, what happened to rne has made 1ne stand back and realize I

Not surprisingly Rayborn took Hebert's confession, turned it over to police,

and had him arrested. The charges were reduced to petit theft. He was given
six months probation and ordered to pay $2000 in restitution.

Today Hebert says he never stole any 111oney fro1n Rayborn, that al1 he did
was give away six steak dinners to his fraternity brothers. lt was a n1ishap

that happened at a fairly young age," Hebert says. "Mr. Rayborn and I are
now friends, I'm friends with hls son and his fan1ily.'1

So why did Hebert write a confession describing how he bilked the

restaurant by falsifying credit-card receipts? Mr. Rayborn made 1ne write

son1ething that would incrilninate me n1ore than I would be incriminated

because he wanted to hold something over me,U Hebert claims. "If you ask
hiln, I1n1 sure he'll tell you that." Rayborn, who still lives in Tallahassee, says
he likes Hebert and bears hin1 no ill will. But when pressed for details about
the events leading up to Hebert's arrest, he declines comment.

In 1992 a warrant was issued for Hebert's arrest after he failed to cmnply
with the terms of his probation. He was picked up at his parents ho1ne in

Ho111estead on April 181 1993. Hebert dismisses it as a sin1ple

misunderstanding that wasn't his fault. 11 1 told my probation officer that I
was n1oving 1 and I was going back home, and I guess the probation officer
didn't relay that message to the judge," he offers.

Court records suggest a different story. On June 10, 1993, Hebert's attorney
fl1ed a motion to forn1ally terminate his probation. The attorney noted that
a warrant had been issued earlier for Hebert's arrest because he had failed
to n1ake restitution. "The defendant has, however, since the issuance of the
warrant paid all of the money and has completed the community service
that was ordered as part of the probation," the attorney wrote. The
significant word here seems to be since, in1plying that Hebert didn't repay
the restaurant owner or cmnplete his co111munity service until after the
warrant had been issued.

According to records n1aintained by the Leon County Sheriffs Office,

Hebert's legal proble111s weren't lin1ited to theft from the restaurant.
Between 1990 and 1992 he also faced eight separate 111isden1eanor charges
for kiting checks all over Tallahassee. Hebert glosses over the charges as
simply more youthful indiscretion. 11 I passed a couple of bad checks to
Domino's/ he shrugs.

After returning to South Florida, Hebert says, he ran into high schoo1 buddy
Steve Shiver at a H01ne Depot shortly after Hurricane Andrew. Hebert was
working construction at the time, but Shiver encouraged hin1 to get a real
estate appraiser's license. Hebert did so and then joined the firm for which
Shiver worked. In 1995 Shiver decided to start his own appraisal firn1. 11 We
worked out of Steve's bedro01n for about a year getting that con1pany
going/ Hebert recalls.

When Shiver was appointed county manager, he imn1ediately tapped

Hebert to come along with him. "I have strong confidence in his abilities,"
Shiver says. "I know that when I ask him to do s0111ething, it gets done. 11

I ftrst encountered Hebert about a month ago, when Shiver and I met for
lunch, Hebert had driven him to the restaurant. Now, of course, it s

son1ewhat amusing to know that the Miami-Dade County Manager was

being chauffeured by a man who didn't have a valid driver license. State
n1otor-vehicle records show Hebert's license was suspended on October 26,
1998, During an interview this past Friday, March 30, he offered this
explanation: 1 had a speeding ticket in Broward County that I thought n1y

wife had paid. She didn't. It was a clerical error on her part. 11

I ren1inded Hebert that it was11 tjust one ticket in Broward that had gone
1

unpaid but rather two speeding tickets in Broward in 1999 and another in
Monroe County in 1998.

"Exactly," he replied. "That has been rectified and taken care of.11

"When?"

"Yesterday. 11

So you're saying you thought your wife had taken care of all th ree tickets
over the years?"

Hebert's responsibilities at the county ren1ain vague. He says he's been busy
working on a variety of projects. 11 Pretty n1uch a little bit of everything," he
told me this past Friday. "United Way stuff, Ericcson [tennis tourna1nent]
stuff. Ahh, what else? There is a lot of paperwork I've been doing, too.
Reading paperwork, routing the 1nail, taking tours with Mr. Shiver to get a
general knowledge of how the county works. I just found out I an1 going to
be a junior assistant for Tom David. 11

Hebert insists he did undergo a physical exam and drug test before
beginning his new job. He says he was shocked to learn last week that
reporters were pursuing false allegations he may have been arrested in the
past for cocaine possession, I've never done any drugs," he affirn1ed. "I've

never used cocaine or marijuana. I'm a country boy fron1 Hon1estead. I like
Jack Daniels and NASCAR. 11

While the media have been raising questions about Hebert's required
physical exam and drug test, his boss, the county manager, has gone eight
weeks since his appointment without fulfilling the sa111e county
e1nploy111ent requirement. This past Sunday Shiver told me he was forced to
cancel the procedures because of scheduling conflicts. Initially he 111ade it
see111 as though the physical exa1n had been planned for the same day as a
funeral for a veteran police offtcer1 but he later admitted the funeral had
taken place a day or two earlier. "Everything just got bumped around," he
said.

Though I realized there was no artful way to approach the subject, I still felt
con1pelled to ask Shiver if he had used any illegal drugs in the past few
years. l'm not going to go into that," he answered. "We've got too 1nuch

work at hand. He did acknowledge it was a relevant issue, and that as

1nanager he should be held to the highest standard of conduct. But he

refused to respond to any questions about possible drug use in his recent
past. l'1n not going to go there/ he snapped.

I responded to the Iisled location in reference to a incident report.

Upon arrlval Mr.Shiver advised that he was in a dating relationship with Ms. McNeil! for approximately 7 months.
He advised that as ofO 1/09/20 l 5 they have separated. Mr. Shiver advised that she is now sending him numerous
emails and messages 11ia social media making various threat towards him and his pro e e advise tba she has
also made several copies of keys to his residence so she could gain entry at any tim w, "d~ se:d Tu II •

Mr, Shiver advised that during the course of their relationship she boast about ha11ing ex-boyfriends put in jail for
various allegations. Mr. Shiver further advised that sho has mentioned to him about incidents where she's paid
subjects to beat up ex-boyfriends and even break into their residence. Mr. Shiver advised that Ms. McNeil! has also
sent sexunl photos to numerous people via socia! media ctaiminM that they are him, in which they are not.

During the past week that they have been separated Mr. Shivel' advised tliat he has had to block all numbers from her
due to the amount of times she has attempted to contact him and she is now cont11cting different member's of his
family to make various threats.

Mr. Shiver was advised of S.A.O. procedures to obtain flil injunction for protection and advised of services
n11ailiable, Note: Mr. Shiver wanted t.he incident documented only, he did not want to pursue criminal charges if
Ms, McNeil! beha11ior discontinued.

motion. He would sway _mor e than t;hree inches frorn his standing center. I asked him f or his drivers
license, he showed me his wallet with his license in t he wallet, I asked hirn to take his license
out of his wal l et. The dt:iver is Roy Stephen Shiver. I asked Roy if he would suhmit to some
sobriety tests . He stated that he would . During the Ho:d.zontal Gaze Nystagmus I observed that Roy
had equal tracki ng of the stimulus ( an ink pen J, he waij able to follow the stimulus with his
eyes, showed a lack of smoot h purs uit, a constant nystagrnus at maximum deviation, an onset prior to
45 degrees of 35 degrees. The following test was instructed and demonstrated to Roy before be
attempted the tests. During the One leg stand _test Roy attempted to lift his f oot bu_t cou_ld not , he
was ver y unsteady a nd _swaying back and forth while standing to . attempt the test. !:le attempted once
again, got his foot off the ground, then immediately placed his foot back down on the pavement . He

rights of a _person _requested to s ubmit to a chemical analysis to determine alcohol concentration or
presence of an impairing substance pnder NCGS 20-16.2(a), I also r e ad Roy the Miranda r ights which
he did not waive. Roy did not call an attorney of a witness. He sta ted to me he did not want an
attorney of witness . Roy stated to me tha t he was not going to blow in the machine . After a time
period of 25 !llinu(;es I i;eguested Roy to submit a breath sample into the EC/ IRII intox. Roy r efused
