The Constitution (One Hundred and
Third Amendment) Act, 2019
AN
ACT
further to amend the Constitution of India.
Be it enacted by Parliament in the Sixty-
-ninth Year of the Republic of India as
follows:—
1. Short title and commencement.— (1) This
Act may be called the Constitution (One
Hundred and Third Amendment) Act, 2019.
(2) It shall come into force on such date as
the Central Government may, by notification
in the Official Gazette, appoint.
2. Amendment of article 15.— In article 15
of the Constitution, af ter clause (5),
the following clause shall be inser ted,
namely:—
‘(6) Nothing in this ar ticle or sub-
-clause (g) of clause (1) of article 19 or clause
(2) of article 29 shall prevent the State from
making,—
(a) any special provision for the
advancement of any economically weaker
sections of citizens other than the classes
mentioned in clauses (4) and (5); and
(b) any special provision for the
advancement of any economically weaker
sections of citizens other than the classes
mentioned in clauses (4) and (5) in so far
as such special provisions relate to their
admission to educational institutions
including private educational institutions,
whether aided or unaided by the State,
other than the minority educational
institutions referred to in clause (1) of
ar ticle 30, which in the case of
reservation would be in addition to the
existing reservations and subject to a
maximum to ten per cent. of the total
seats in each category.
Explanation.— For the purposes of this
ar ticle and article 16, “economically
weaker sections” shall be such as
may be notified by the State from time

to time on the basis of family income
and other indicators of economic
disadvantage.’.
3. Amendment of article 16.— In article
16 of the Constitution, af ter clause (5),
the following clause shall be inser ted,
namely:—
“(6) Nothing in this article shall prevent
the State from making any provision for the
reservation of appointments or posts in
favour of any economically weaker sections
of citizens other than the classes mentioned
in clause (4), in addition to the existing
reservation and subject to a maximum
of ten per cent. of the posts in each
category.”.

The Right of Children to Free and
Compulsory Education (Amendment)
Act, 2019
AN
ACT
further to amend the Right of Children to Free
and Compulsory Education Act, 2009.
Be it enacted by Parliament in the Sixty-
-ninth Year of the Republic of India as
follows:—
1. Short title and commencement.— (1) This
Act may be called the Right of Children to Free
and Compulsory Education (Amendment) Act,
2019.

(2) It shall come into force on such date as
the Central Government may, by notification
in the Official Gazette, appoint.
2. Substitution of new section for
section 16.— In the Right of Children
to Free and Compulsory Education
Act, 2009 (hereinafter referred to as 35 of 2009.
the principal Act), for section 16, the
following section shall be subsituted,
namely:—
“16. Examination and holding back in
certain cases.— (1) There shall be a regular
examination in the fifth class and in the
eighth class at the end of every academic
year.
(2) If a child fails in the examination
referred to in sub-section (1), he shall be
given additional instruction and granted
opportunity for re-examination within a
period of two months from the date of
declaration of the result.
(3) The appropriate Government may
allow schools to hold back a child in the fifth
class or in the eighth class or in both classes,
in such manner and subject to such
conditions as may be prescribed, if he fails
in the re-examination referred to in sub-
section (2):
Provided that the appropriate
Government may decide not to hold back a
child in any class till the completion of
elementary education.
(4) No child shall be expelled from a
school till the completion of elementary
education.”.
3. Amendment of section 38.— In the section
38 of the principal Act, in sub-section (2), after
clause (f), the following clause shall be
inserted, namely:—
“(fa) the manner and the conditions
subject to which a child may be held back
under sub-section (3) of section 16;”.

The National Council for Teacher
Education (Amendment) Act, 2019
AN
ACT
further to amend the National Council for
Teacher Education Act, 1993.
Be it enacted by Parliament in the Sixty-
-ninth Year of the Republic of India as
follows:—
1. Short title and commencement.— (1) This
Act may be called the National Council for
Teacher Education (Amendment) Act, 2019.
(2) It shall be deemed to have come into force
on the 17th day of August, 1995.
2. Amendment of section of 14.—
In the National Council for Teacher
Education Act, 1993 (hereinafter 73 of 1993.
referred to as the principal Act), in
section 14, sub-section (1), after the
proviso, the following proviso shall
be inserted, namely:—
“Provided further that such institutions,
as may be specified by the Central
Government by notification in the Official
Gazette, which—
(i) are funded by the Central
Government or the State Government or
the Union territory Administration;
(ii) have offered a course or training in
teacher education on or af ter the
appointed day till the academic year
2017-18; and
(iii) fulfil the conditions specified under
clause (a) of sub-section (3),
shall be deemed to have been recognised
by the Regional Committee.”.

3. Amendment of section of 15.— In the shall be deemed to have been granted

Scheme for Promotion to Organise Science
Film Festival
The Government of Goa is pleased to frame
the scheme for promotion of Science Film
Festival.
1. Short title and commencement.— This
scheme may be called as “Scheme for
promotion of Science and Technology by
providing financial assistance to Vidnyan
Parishad, Goa to organise Science Film
Festival”. (Herein after called as the Scheme).
(i) It shall come into force with immediate
effect.
(ii) The scheme shall promote Science Film
Festival in the State of Goa.
(iii) The scheme shall be implemented by
Department of Science & Technology.
(ii) Government of Goa has notified the
scheme for promoting and creating awareness
regarding new development in Science &
Technology among students by providing
financial assistance to grantee to organize
Science Film Festival.
3. Objectives of the scheme.— (i) The
scheme is formulated with the objectives:—
(a) To promote and popularize goal of
Science & Technology by organizing
Science Film Festival.
(b) To provide Financial Assistance for
the subject scheme, to “Vidnyan Parishad,
Goa” to conduct the science film festival
in collaboration/in association with
Department of Science and Technology, Goa
University, Goa Science Centre, National
Institute of Oceanography at Entertainment
Society of Goa.

4. Scope of the scheme.— (i) The scope of
the scheme is to provide annual financial
assistance to the grantee that is “Vidyan
Parishad, Goa” per Financial Year to organise
Science Film Festival.
(ii) Project Review Committee
A Project Review Committee (PRC)
comprising of (a) Secretar y (Science &
Technology) (b) Director, Department of
Science and Technology (c) Member
Secretary, Goa State Council for Science and
Technology and (d) Environmental Engineer,
Goa State Pollution Control Board will review
the proposals received and upon the
recommendation of the committee, the grants
will be released with approval of the
Competent Authority. The proposal will be
appraised by the committee by conducting a
meeting or by circulation. Alternately the
project could be appraised through the Goa
State Council for Science & Technology or
other experts of various Institutions.
(iii) The Government of Goa, Department of
Science and Technology has given Grant-in-
aid to Goa Vidnyan Parishad for successful
conduct of Science Film Festival for last three
years and considering the Organization’s
expertise and capability for scientific resource
community, the scheme is enacted for conduct
of such “Science Film Festival” annually.
(iv) There shall be precursor activities by
visiting the schools/Higher Secondaries along
with Scientists to enthuse the students.
Science Films will be shown to the students
and thereafter the scientific concepts should
be explained to the students by the Scientist
in an interaction, to develop the goal of
Department of Science and Technology, for
science popularization, and develop interest
and liking for science.
(v) The grantee i.e. Vidnyan Parishad, Goa
approved by Project Review Committee (PRC)
in consultation with the Department of Science
& Technology is eligible to organise Science
Films Festival.
(vi) The Department of Science &
Technology Goa shall ensure that a organizing

committee shall be constituted comprising of
Department of Science and Technology, Goa
University, Goa Science Centre, National
Institute of Oceanography and ESG
(Entertainment Society of Goa), and only other
nominee of Government.
5. Eligibility for availing benefits under the
scheme.— (i) Goa Vidnyan Parishad which has
successfully conducted the Science Film
Festival for the last three years, in Association
with the Depar tment of Science and
Technology, Government of Goa, Goa
University, Goa Science Centre, National
Institute of Oceanography and ESG whose
proposal is examined and recommended by
the Project Review Committee will be eligible
to get financial assistance of maximum upto
Rs. 25,00,000/- per annum subject to provision
in the annual budget. (Proforma for seeking
GIA to organize Science Film Festival in
“FORM I”).
6. Quantum of financial assistance under
the scheme.— (i) An amount of upto
Rs. 25,00,000/- shall be provided per annum
to the grantee directly.
(ii) The grants shall be disbursed in two
equal installments i.e. 50% on receipt of the
proposal duly vetted by PRC and 50% on
submission of statement of Expenditure
directly on case to case basis.
(iii) Government reserves the right to stop
future grants and also modify the financial
quantum, so also the conditions of the scheme,
depending upon the budgetary provisions.
Government also reserves the right to sanction
the grant to the grantee in abeyance or
suspend or cancel the scheme, at any point
of time, and no claim or appeal or challenge
shall lie with any authority or tribunal or
cour t, in respect of this decision of the
Government.
7. Pattern of Assistance of the Scheme.— (i)
The grantee shall be entitled to receive
Government grants based on the estimate
approved by the Government in the Budget

Estimate during that financial year for the
scheme and will be sanctioned as per
the terms and conditions laid by the
Government.
(ii) The grants shall be disbursed in two
equal installments i.e. 50% on receipt of the
proposal duly vetted by PRC and 50% on
submission of statement of Expenditure
directly on case to case basis.
(iii) The entire amount of the grants
approved within the same financial year,
should be utilized before the month of March
of the subsequent year of grant and only for
the purpose for which it is sanctioned. Any
portion of the grant which is not ultimately
required for the purpose for which it is
sanctioned will be refunded to the
Government Treasur y. Af ter ‘utilizing/
/refunding’ the sanctioned amount, an
Utilization Certificate should be furnished to
the sanctioning authority as required under
Form GFR–19A.
(iv) The account of the Grantee in respect
of this grants should be audited by the
government approved Auditor/Chartered
Accountant and counter signed by President/
/Secretary of the grantee organization. Such
certificate shall be submitted along with
detailed report. The accounts of the grants
shall be maintained separately and properly
from its normal activities.
(v) The Audited statement of accounts
showing the expenditure incurred by the
Grantee from the grants should be furnished
to the Government within a period of one year
from the date of sanction and should certify
that expenditure incurred is only for the
purpose for which it is sanctioned.
(vi) A performance-cum-achievement
report specifying in detail the achievements
made by the Grantee with the Government
grants/amount sanctioned should be
furnished to the Department of S&T along with
Utilization Certificate.

(vii) The grantee Institution must exercise
reasonable economy, observe all financial
proprietary and the financial rules as issued
by the Government from time to time while
incurring the expenditure.
(viii) In case of portion of grants being
utilized for the purpose for which it is not
sanctioned the amount so utilized shall be
recovered from the Grantee in a manner as
decided by the Government and in terms of
the provisions and in accordance to the law
in force. The Government shall also initiate
appropriate criminal proceedings against the
perpetrators.
(ix) The amount remaining unspent out of
this grant on or before the month of September
of the subsequent year of grants, shall be
refunded back to the Government Treasury by
challan within 03 (three) months from the date
of submission of report.
(x) The grantee shall duly acknowledge
the grant provided by the Department in its
report as well as any publications of such
report for which the Department has provided
grants.
(xi) The grantee shall ensure that
no unlawful activities, propaganda in
consistent with the Government illegal
Policy, Rules and Regulations should be
undertaken.
8. Relaxation of the provisions of the
scheme.— The Government shall be
empowered to relax any of the clauses
or conditions of this scheme in genuine
case(s).
9. Interpretation of the provisions of this
scheme.— If any question arises regarding
interpretation of any clause, word, expression
of the scheme, the decision about the
interpretation shall lie with the Government,
which shall be final and binding on all
concerned.

10. Redressal of grievances and dispute.—
Grievances or disputes if any, arising out of
implementation of this scheme, shall be
referred to the Secretary (S & T) of Government
who shall hear and decide such matters
and the decision of the Secretary (Science
and Technology) to the Government in this
regard shall be final and binding on all
concerned.
11. This scheme has been issued with the
concurrence of the Finance (Exp.) Department
vide their U. O. No. 1400062668 dated 6-3-2019
and administrative approval of the
Government under U. O. No. 1788/F dated
06-03-2019.

Whereas, the Government of Goa acquired land admeasuring an area of 2093 acres in the
villages of Mopa (Part), Varconda (Part), Casarvanem (Part), Chandel (Part), Uguem (part) and
Amberem (Part), situated at Pernem Taluka (herein after referred to as the “said area” and
more particularly described in clause (A), in Column (1) of the Schedule hereto), to develop an
International Airport;

And whereas, the Goa Town and Country Planning Board recommended to declare the said
area as a Planning Area and the Government of Goa vide Notification No. 36/
/1/TCP/280/2018/219 dated 31-01-2018, published in the Official Gazette, Series I No. 44 dated
01-02-2018, declared the said area as a “Mopa International Airport Planning Area”;

And whereas, the Goa Housing Board is the owner and in possession of the land admeasuring
an area of 1,68,002.00 sq mtrs. surveyed under Survey No. 36/1 and 2, 37/1, 38/1, 39/1 and 40/1
of village Dhargal Taluka Pernem (herein referred to as the “said land” and more particularly
described in clause (B), in Column (1) of the Schedule hereto);

And whereas, the Goa Housing Board has requested the Government to include the said
land in Mopa International Airport Planning Area;

And whereas, the Goa Town and Country Planning Board has recommended to include the
said land in Mopa International Airport Planning Area and the Government has approved the
recommendation of the Goa Town and Country Planning Board.

Now, therefore, in exercise of the powers conferred by sub-sections (1) and (2) of section 18
of the Goa, Daman and Diu Town and Country Planning Act, 1974 (Act 21 of 1975) and in
supersession of the Government Notification No. 36/1/TCP/280/2018/219 dated 31-01-2018,
published in the Official Gazette, Series I No. 44, dated 01-02-2018, the Government of Goa
hereby declares the area/land as specified in clauses (A) and (B) in Column (1) of the Schedule
