EXTRAJUDICIAL SETTLEMENT OF ESTATE WITH DEED OF

ABSOLUTE SALE

KNOW ALL PERSON BY THESE PRESENTS:

This AGREEMENT made end and entered into this _____ day of ________ 2019, in
Baresbes, Quezon, Nueva Vizcaya, between and among:

GAUDENCIO DEL ROSARIO, of legal age, widower, Filipino, residing at


Barangay Baresbes, Quezon, Nueva Vizcaya;

HAZEL S. DEL ROSARIO, of legal age, single, Filipino, residing at,


Barangay Baresbes, Quezon, Nueva Vizcaya;

HAROLD S. DEL ROSARIO, of legal age, married, Filipino, residing at


Barangay Maddiangat, Quezon, Nueva Vizcaya;
-and-
HENDRICK S. DEL ROSARIO, of legal age, married, Filipino, residing at
Barangay Boliwao, Quezon, Nueva Vizcaya;

WITNESSETH, that:
WHEREAS, we are the heirs of the deceased ANGELITA R. SARTE who died on
September 29, 2016 at Veterans Regional Hospital-Bayombong, Nueva Vizcaya. Copy of
her Death Certificate is hereto attached as Annex A;

WHEREAS, ANGELITA SARTE, died intestate, without Will or Testament, and


without any outstanding debts in favor of any person or entity;

WHEREAS, ANGELITA SARTE is the absolute and registered owner of a parcel


of land located at Barangay Baresbes, Quezon, Nueva Vizcaya covered by Transfer
Certificate of Title No. T-94498, of the Registry of Deeds of Nueva Vizcaya, and more
particularly described as follows:

Technical Description
A parcel of land (Lot H-2-A of the subdivision plan Psd-02-053097, being a
portion of Lot H-2, Psd-2-03-037740, situated in the Barrio of Baresbes, Municipality
of Quezon, Province of Nueva Vizcaya, Island of Luzon, Philippines. Bounded on the
NW. along line1-2 by Lot H-@-B of the subd’n plan; on the NE. along line 2-3 by Lot
G; Pcs-2-03-001220; on the SE. along line 3-4 by Lot H-1; Psd-2-03-037740; on the SW.
along line 4-1 by Lot H-2-C subd’n plan (perpetual rd. right of way); Beginning at the
point marked “1”on plan being S. 59 deg. 45’W., 2019.49 meters from BBM No. 32,
Cad-178;

thence N. 60 deg. 09’E., 10.01 meters to pt. 2;


thence S. 30 deg. 54’E., 12.00 meters to pt. 3;
thence S. 60 deg. 08’W., 10.00 meters to pt. 4;
thence N. 30 deg. 54’W., 12.00 meters to the pt. of beginning.

Containing an area of ONE HUNDRED TWENTY TWO (120) square meters, more
or less. All points referred to are indicate on plan and are marked on the ground as
follows: Corner 3 & 4 by old PS and the rest by PS cyl. Conc. Mons. 15 x 40 cms.

Bearings true. Date of original survey: May 14, 1935 and that of the subdivision survey
was on March 8, 1995 and was approved on July 5, 1995.

WHEREAS, pursuant to Rule 74, Sec. 1 of the Revised Rules of Court of the
Philippines, and being with full capacity to contract, we do hereby adjudicate unto
ourselves the parcel of land described above, in equal shares.

WHEREAS, we hereby affirm that we have executed this instrument out of our
own free will without force, intimidation or violence upon our person, and that we have
hereby received our just and proper share and have no more claim or demand against
each other in connection with the adjudication of the above-described parcel of land;

FURTHER, FOR AND IN CONSIDERATION of the sum of THIRTY


THOUSAND PESOS (PhP 30,000.00), Philippine Currency, the receipt whereof is hereby
acknowledged in full sum from SPOUSES HAROLD S. DEL ROSARIO AND AU-AU
N. DEL ROSARIO, of legal ages, Filipinos, and with residence address at Barangay
Maddiangat, Quezon, Nueva Vizcaya, we (GAUDENCIO, HAZEL and HENDRICK
DEL ROSARIO) do hereby SELL, TRANSFER, CONVEY and DELIVER our own
respective shares of the abovementioned parcel of land, by way of ABSOLUTE SALE,
unto said SPOUSES HAROLD S. DEL ROSARIO AND AU-AU N. DEL ROSARIO, his
heirs, assigns and successors-in- interest the property above described with all the
improvements existing thereon; That we hereby warrant our valid title to and peaceful
possession of the property herein sold and conveyed and further declares that the same
is free and clear of all liens and encumbrances of any kind whatsoever.
