OPEN BID PROCEDURE

FOR AWARD OF FM RADIO BROADCAST STATION


LICENCE

1. General

a. The bidding process shall be conducted by the Bidding Committee,


constituted by the Authority for this purpose.

b. The Bidding Committee shall open sealed Bids in front of the


Authorized Representative of the Bidders. The Bidding Committee
shall announce:

• Bid Price of each Bidder


• Highest Bid
• Qualified Bidders for the next round
• Time for reassembly for the Second Round

c. The bidding shall be conducted in two rounds; the first round will be
through sealed bids and the second round through open outcry.

d. Authorized persons/directors of the company from each eligible


Applicant shall be allowed to participate in the bidding process.

e. The bids shall be offered in Pak Rupees.

f. The conditional bids, having ‘ifs’ and ‘but’, will be out-rightly


rejected.

2. First Round: Sealed Bids

a. The Authority would invite the eligible bidders to submit the sealed
bid for the given city.

b. The sealed bids shall be dropped in a box reserved for this purpose
alongwith 15% of the bid amount in the form of Bank Draft/Pay
Order, in presence of the Bidding Committee, by the Authorized
Representative of the Bidder.
c. The amount of sealed Bid shall be greater than the base price.

d.The Bid shall contain no additions, alterations or omissions.


Otherwise, the Bid may be cancelled/rejected by the Bidding
Committee.

e. The bidder shall not be allowed to modify or substitute their Bids


after submission of the Bid to the Committee.

3. Second Round-Open Outcry:

a. The highest bid amount will be considered as a base price for open
bidding.

b. The opportunity will be provided to pre-qualified companies to offer


high bid with minimum incremental value of Rs.10,000/- till the
last bid offer by the participating companies.

c. Each eligible bidder will show hand for offering the bid.

d. Each bidder shall cry-out his bid, which shall be duly recorded by
the Bidding Committee.

e. The Bidding Committee shall continue the open outcry session until
there are no further Bids.

f. The Bidding Committee shall give an appropriate period of time to


the bidders to submit their highest bid, before the announcement of
Final Bid by the Committee.

g. Each highest bid will get a maximum time of one minute comprised
of three announcements each of 20 seconds duration.

h. The said time period may be changed by the Bidding Committee


with prior announcement of such change before the bidding process.

i. When there are no further Bids, the Bidding Committee shall


announce the Highest Bid and the name of the Highest Bidder.

j. The highest bidder shall be considered successful bidder and the


amount quoted shall be deemed as ‘Applicable Licence Fee.

k. The successful bidder shall deposit balance 15% earnest money


within 07 working days failing which his bid will be considered as
disqualified and Authority will proceed to ask next highest bidder
to match the highest bid.

l. The successful bidder shall deposit the balance Applicable Licence


Fee alongwith 10% security deposit along with other relevant
documents and technical details within 30 days as notified by the
Authority.

m. In case the successful bidder fails to deposit the Applicable Licence


Fee and the Security deposit with necessary credentials within 30
days from the date of issuance of such letter by the Authority, he
shall be rendered in-eligible, and the earnest money shall be
forfeited. The fresh applications will be invited in the next phase.

n. The FM Radio licence shall be awarded to successful bidder after


completion of all the obligatory formalities, including
clearance/permission from the Ministry of Interior, Provincial
Governments, where the Station is to be established, and approval
of the Authority.

o. Earnest money deposited by the unsuccessful bidders will be


refunded.

4. Reservation of Rights

4.1 The Authority reserves the right to reject any or all the bids without
assigning any reason whatsoever.

4.2 The Authority reserves the right, in its sole discretion, to take any action,
which it considers necessary to ensure that the Bid process occurs in a
fair, open and transparent manner, in accordance with law and
discourage collusion and predatory bidding that may block the entry of
potential bidders into the biding process.

4.3 No suit, prosecution or other legal proceeding shall lie against the
Authority or any member or employee of the Authority in respect of
anything done or intended to be done by the Authority in good faith in
connection with this Bidding Procedure.
