Customers will be able to trade in their old hand phones (“devices”) at a value specified by
Ingram Micro Malaysia Sdn Bhd (“Ingram Micro”); and set-off that value to purchase a Samsung

Galaxy S8 | S8+ within the same transaction at  all nationwide Samsung Experience Stores

(SES) & participating Samsung authorized dealers (collectively referred to as “Dealers”)  from

7th July – 31st August 2017

Customer is only entitled to one (1) time trade up for Samsung Galaxy S8 | S8+ when they trade

in one (1) unit of eligible device.

Duration

The Samsung Galaxy S8 | S8+ Trade-Up Campaign (“Campaign”) will run from 7th July 2017 to

Period”) at the Participating Outlets. Samsung Malaysia Electronics (SME) Sdn. Bhd.

(hereinafter referred to as “Samsung”) shall reserve the right to shorten or extend the

Campaign Period at its sole discretion without any prior notice.

Eligibility

This Campaign is open to all Malaysian and non-Malaysian residing in Malaysia, aged 18 years

and above (as at 7th July 2017), except the employees (and their immediate families) of

Campaign agencies. In the event the consumer is below 18 years old, please seek consent from

Participating Outlets

The Campaign is available to all nationwide Samsung Experience Stores (SES) & participating
Samsung authorized dealers (collectively referred to as “Dealers”).

a)      This Campaign is only applicable for end customers and NOT applicable to the following:

-       Dealers and their immediate family members

-       Resellers and their immediate family members

b)   To be eligible for the Trade-Up Campaign, the customer acknowledges that their device

must meet the following criteria set out by Ingram Micro (“Criteria”):

(i)         Device is able to power ON and OFF, can properly charge, read IMEI and can use with all

Malaysia Telco SIM Card

(ii)        Device must have Wi-Fi connectivity (applicable to IPhone, Android), able to call IN and

OUT and properly factory reset

(iii)       Display screen is functional, free from crack, damage pixels, no shadow, no discolor and

no water damage

(iv)       Casing and cover no major damage, no crack, no missing button and buttons are

functioning
(v)        Device must not be a clone set, iCloud, Find my Phone (applicable to iPhone) Samsung ID
and Phone lock must be remove

(vi)       Make sure devices with finger print feature are in working condition.

c)      One customer is only entitled to enjoy one (1) time promotion with the aforesaid Trade In

Value  off RRP for Samsung Galaxy S8/S8+  when they trade in 1 unit of eligible device.  Trade-

In Value is not redeemable for cash and not exchangeable/transferable.

d)      The Customer is responsible for the removal of any memory card, SIM card and the back-

up and/or erase all the personal and confidential information and data in the device that is
traded in under this Campaign.

e)      The Campaign is valid during the Campaign Period and Event Period only. By participating
in this Campaign, consumer fully and unconditionally agrees to and accepts the Terms and

Conditions stated herein and decisions of Samsung.

f)       Customers are required to complete Ingram Micro’s Trade In Voucher and are advised:-

(i)    to remove any SIM card or memory card from the Trade In Device; and

(ii)   to complete a factory reset and/or security wipe to ensure the Customer’s personal and

confidential information and data, including but not limited to applications, contracts and

personal data, personal information, photos, videos, messages and/or passwords in the Trade
In Device (“Personal Information”)are removed, erased or deleted from the Trade In Device.

g)      Samsung is not liable in any way for any costs, expenses, damages, liability or injury
arising out of or in any way connected with the Campaign.

h)      Samsung shall not be liable for any loss or damage whatsoever which is suffered

(including but not limited to indirect or consequential loss) for personal injury which is suffered
or sustained, as a result of participating in the Campaign.

i)        Samsung shall not be liable for any compensation or reimbursement due to the
unavailability of the stocks stated and/or any costs and expenses including but not limited to
transportation, logistics and accommodation howsoever incurred by consumer in participating
the Campaign.

j)        Samsung reserves the right to alter, extend or terminate the Campaign and amend the
terms and conditions at any time without prior notice. In case of any disputes in connection

with the Campaign, the decision of Samsung shall be final.

k)      Warranty of the Samsung Galaxy S8 and S8+ is subject to standard product warranty

coverage as per terms and conditions stated in the official corporate website

at http://www.samsung.com/my/support/warranty. Customer is advised to check the website

from time to time and stay informed for any changes on the terms and conditions of the

warranty.

l)        During the Campaign Period and /or Event Period, Samsung and/or Ingram Micro may

collect consumers information including personal information in the Trade-in Vouchers and

any other forms (whether on our own or by appointed service provider) taken during the
Campaign.

m)    By providing Customer’s personal data, Customer is indicating that he/she has read,

understood and agree that his/her personal data will be recorded, stored or otherwise
processed in accordance to Samsung's Privacy Policy available at

http://www.samsung.com/my/info/privacy.html or Ingram Micro’s privacy policy (as may be

applicable).

n)      Customer shall be responsible for the removal of any memory card, SIM card and the

back-up and/or removal of all the Personal Information in the trade in Device. Under no
circumstances shall Samsung be responsible for the removal of Personal Information from the

trade in Device and shall not be liable for any loss or use of any Personal Information from the

said device. 

o)      These Terms and Conditions are governed by the laws of Malaysia and disputes directly or

indirectly arising from these Terms and Conditions and/or this offer shall be referred to the
exclusive jurisdiction of the courts of Malaysia.

How To Participate

When is the Promotion

The Promotion will be held from now until 31st August 2017 (“Promotion Period”) or while

Devices and/or Promotion Item stocks last, whichever is earlier.

Coverage Duration

The term of the Samsung Screen Protection shall be one (1) year from the date of the

purchase of your device and shall be subjected to the general terms and conditions of the

Screen Protection Plan stated on Samsung Official Website available at

http://www.samsung.com/my/support/smartcare/index.html.
The terms of Samsung Protection Plus (Screen Protection Plan + Smart Warranty) is as per

the terms and conditions stated in Samsung official website.

Damage Coverage

Samsung Screen Protection covers damage to your Device caused as the result of

unintentional, unexpected or accidental damage from handling as damage to the display

screen of your Device due to drops, falls and other collisions. Subject to your submission of

a valid claim and payment of a service fee of RM 100 (which is in addition to the fees you

have paid for Samsung Screen Protection and subject to the change/revision as decided by

Samsung from time to time) Samsung will exchange the defective display screen with a

replacement device that is new or equivalent to new in performance; (each a "Samsung

Screen Protection Incident"). 

Samsung Screen Protection does not cover:

i.          Damage or defects due to fire, intentional damage, fractures;

ii.          Scratches, gradually developing defects, cosmetic damage to outer surface/

finishing and external parts of the Device, including without limitation dents or scratches
on the exterior casing, screen, camera lens, buttons and other attachments, including

where caused by friction or rubbing with additional equipment or accessories; 

 iii.         Deterioration of the Device due to normal wear and tear, including without

limitation rust or stains;

iv.        Reckless, abusive, willful or intentional conduct associated with handling and use of

the Device;

v.         Any other circumstance where repair would be contradictory or not in compliance

with good business practice. 

Unless otherwise specified, Samsung Screen Protection covers the hardware components

of the Device as originally supplied and does not cover any software, consumable items, or

accessories even if packaged or sold together with the Device. For details on any user

rights with respect to software, please refer to licensing agreement accompanying such

software. Other General Terms and Conditions as stated in the Samsung Official Website

shall be applicable to the device as well.

The Samsung Protection Plus is a combination package of Screen Protection Plan and

Samsung Smart Warranty (Samsung Smart Warranty is a 1 year extension to the standard

warranty of product). Samsung Protection Plus provides the customer with one (1) time

screen replacement due to accidental cracked screen within the standard warranty and an

extension of one (1) year to the standard warranty of product purchased (Screen Protection

Plan does not apply during the Samsung Smart Warranty term). For full terms and
conditions on the Samsung Protection Plus, please visit Samsung Official Website

mentioned above.  

Customer is advised to check Samsung Official Website from time to time and stay

informed for any changes on the terms and conditions of the warranty. 

Terms and Conditions

By participating in this Promotion, customer agrees to release and hold Samsung and its

employees, officers, directors, shareholders, agents, representatives, parent companies,

affiliates, subsidiaries, licensees, advertising, promotion, and fulfillment agencies, and

legal advisors, harmless from any and all losses, damages, rights, claims and actions of any

kind in connection with the Promotion, including without limitation, personal injury, death,
and property damage, and claims based on publicity rights, defamation, or invasion of

privacy. 

Samsung shall not be responsible for any losses, damages, costs or claims arising out of

customer’s failure to purchase the Device and/or the Promotion item due to stocks

unavailability/out of stocks. 

In case of any dispute/inconsistencies/discrepancies arising out of or in connection to the

Terms and Conditions of this Promotion herein with the general terms and conditions of
the Screen Protection Plan and the Samsung Protection Plus Promotion, the latter (general

terms and conditions of the Screen Protection Plan and Samsung Protection Plus

Promotion) shall prevail only to the extent of reconciling the

dispute/inconsistencies/discrepancies. Samsung reserves the right to make the final

decision. 

This Promotion and the Terms and Conditions shall be governed by the laws of Malaysia

and any disputes arising out of or in connection with this Promotion shall be referred to

the exclusive jurisdiction of the courts of Malaysia. 

Samsung shall not be liable for any losses or damages arising howsoever caused arising

from installation works (if any) of the products purchased in conjunction with this

All transportation, accommodation, personal costs and/or any other costs, fees and/or
