AN ORDINANCE PROHIBITING THE USE OF PLASTIC STRAWS


AND SINGLE-USE CELLOPHANES/PLASTIC BAGS IN ALL
EDUCATIONAL INSTITUTIONS (WALANG PLASTIKAN SA
ESKWELAHAN) IN THE MUNICIPALITY OF TIGBAUAN , ILOILO"

SECTION 1. SHORT TITLE – This ordinance shall be known as “Walang


Plastikan sa Eskwelahan” Ordinance of Tigbauan, Iloilo.
SECTION 2. COVERAGE – This ordinance shall apply to all educational
institutions, private and public, in the Municipality of Tigbauan.

SECTION 3. OBJECTIVES:
3.1. To educate the students regarding the ill effects of using single-use
plastics and straws;
3.2. To avoid massive trash produced in the different schools in the
Municipality f Tigbauan;

3.3. To encourage the use of re-usable bags and other containment


materialsin all schools and other school-related activities.
SECTION 4. DEFINITION OF TERMS – The following terms are being
defined for the purpose of this ordinance:
1. Cellophane – are plastic bags use for re-packaging of beverages as soft
drinks, sago, and gulaman; carinderia retailers’ food pouch; local ice-
making, bottled oil and the like. It is also known as plastic pouch. 
 

2. Dry goods - refers to any product that do not require refrigeration or
freezing to maintain freshness such as textiles and clothing. 

3. Information Education Campaign (IEC) – campaign to widen the
knowledge of the locales in relation to recycling 

4. Packaging material – shall refer to any material which may contain but
not necessarily in direct contact with the product especially for purpose
of protection, preservation, handling, transport, and marketability e.g.
cartons, carrier bags, packaging films, protective foams for electronic
product; it shall also refer to any materials which acts as a secondary
container to a product, for purpose of containment e.g. the box which
contains a bottle filled with liquid perfume. 

5. Primary container – it refers to the original packaging material or
container for the goods
6. Residual wastes - shall refer to waste materials that are collected,
transferred and transported for final disposal as garbage. 

7. Reusable bags – are bags made out of different materials that can
withstand several uses as containers and for packaging which
categorically classified as eco-friendly as they provide an alternative to
disposable bags. 

8. Reusable container – can be used for buying wet goods in the market
such as meat and fish. 

9. Reusable food box – can be used to store food such as buying food for
take away. 

10. Reusable straw - it may be a bamboo straw or other materials that
can be used multiple times after washing. 

11. Scrap Collector - shall refer to a recycling center, private or public,
that purchases or otherwise accepts recyclable materials for the
purpose of recycling. 

12. Secondary Container- it refers to the final packaging materials or
container for the good and commodities for the purpose only of
convenient handling. 

13. Single-use cups – cups that are purposely produced to be used one
time to contain liquid, and wet beverage and food such as and plastic
cups. 

14. Single-use materials – any items made of either plastic and
Styrofoam or combination of both that is purposely made for one-time
use as packaging, containing or as aid for eating and drinking.
Example of single-use items are plastic bags, plastic utensils, plastic
straw, plastic cups, styrofoam food box, styrofoam cups, among others.

15. Single-use straw – straws that are used for drinking that is made up
of plastic for one-time-use only. 

SECTION 5. PROHIBITION ON THE USE/SELL OF SINGLE-USE
ITEMS (PLASTIC AND STYROFOAM) OF INSIDE SCHOOL
PREMISES. - Listed below are the prohibited uses of single-use items made of
plastic and Styrofoam in all schools, including those during school and school
related programs and activities.
1. No one shall be allowed to utilize single-use plastics, i.e. plastic straws,
plastic bags, and styrofoam inside school premises and during school-
related programs and activities; 

2. No business establishment shall offer or sell plastics to be used a
secondary packaging material or as primary packaging material on dry
goods when said items shall be brought inside school premises; 
 

3. Disposing plastic waste in common areas in schools, such as school
grounds, corridors, walks, and pathways; and 

4. Disposing cellophane, plastic and styrofoam, not segregated, as embodied
in the Republic Act 
 9003. 


SECTION 6. REGULATED USES OF PLASTICS FOR GOODS AND


COMMODITIES. - The use of plastics on the following are hereby regulated:
1. Wet goods that are already pre-contained in plastic wraps, pouches, bags and
the like as part of the 
 product’s packaging materials such as frozen
products shall not be contained further in plastic 
 bags; 


2. Wrapped or bagged products are preferably to be contained in a customer


supplied “reusable” pre-cleaned and sanitized containers; 


3. Oil containers and other similar products shall be re-used at all times since
they don’t usually end 
 up as recyclable waste; other plastic bottles that
are not acceptable at “buy-back centers” like barangay MRFs, municipal
MRFs or junkshops shall be re-used and should not end up as residual
waste; and 


4. Sacks and other similar bags shall be re-used as garbage bags.

SECTION 7. PROMOTING THE USE OF REUSABLE ITEMS AND


OTHER ENVIRONMENT- FRIENDLY PACKAGING MATERIALS AS
AN ALTERNATIVE. -
 All schools are strictly enjoined to educate all
learners and campaign for the use re-usable items (reusable native bags, water
bottles, lunch box and other reusable containers) and direct the observance of
the following environment friendly practices:
1. All vendors and school canteen operators shall brief or train their respective
personnel regarding the implementation of this ordinance; 


2. All teachers and parents are enjoined to use reusable items (reusable native
bags, water bottle, lunchbox) and shall bring appropriate containers when
going to the school and to the market; 


3. Recovery of tetra packs or other plastic containment materials shall be done


during every after events, programs or activities; 


4. Use of reusable bags shall be mandatory in all schools; use of reusable


bag/sack shall be encouraged to all members of the institution; 
 similar
mechanics shall apply to other programs and activities that may allow the
use of reusable materials; and 


5.The use of cardboard boxes, paper bags, or any reusable bags shall be strongly
encouraged.

SECTION 8. THE LOCAL GOVERNMENT UNIT SHALL ENSURE


THE ENFORCEMENT AND MONITORING OF THIS ORDINANCE
AND SHALL ENDEAVOR TO EXTEND ASSISTANCE AND
SUBSIDIES, to wit:
1. Upon implementation of this ordinance, the LGU of Tigbauan shall assist
accredited organization in providing woven bags (bayong), sewn recycled
fabric bags (katsa or rice sack) and other reusable native bags to be made
available to everyone;


2. Conduct/sponsor free seminars and training for the production of reusable


bags as an alternative to the use of single-use plastic bags; 


3. Give recognition and/or commendation to individuals, associations and


business establishments that have helped in the promotion and observance
of this ordinance; 


SECTION 9. IMPLEMENTING RULES AND REGULATIONS . - Within


thirty (30) days from the approval of this ordinance, the necessary rules and
regulations shall be issued to the Municipal Environment and Natural Resources
Office and the DepEd District of Tigbauan, including all educational institutions
in the Municipality of Tigbauan, for the proper and effective implementation of
this ordinance.

SECTION 10. PENALTIES AND SANCTIONS FOR BUSINESS


PARTNERS –
!0.1. Any establishments who shall violate any of the prohibited acts
stated above shall be published through the imposition of the following
penalties:

First offense : Php 1,000.00


Second offense : Php 1,500.00 and
Third offense : Php 2,500.00 and suspension of business permit
by the LGU for a period of one year
10.2. Any individual who shall violate any of the prohibited acts stated
above shall be published through the imposition of the following penalties:

First offense : Php 300.00


Second offense : Php 500.00
Third Offense : Php 2,500.00
SECTION 11. TASK FORCE "WALANG PLASTIKAN". A special
Task Force on Walang Plastikan sa Eskwelahan is hereby created which
shall take charge of the information dissemination and effective
implementation of this ordinance.
SECTION 12. SEPARABILITY CLAUSE. If any part of this
Ordinance is declared unconstitutional or unlawful, such declaration
shall not affect the other parts or sections hereof that shall not be
declared unlawful or unconstitutional.
SECTION 13. REPEALING CLAUSE. All previous ordinances
inconsistent with this Ordinance shall be deemed repealed or modified
accordingly.
