BARANGAY ORDINANCE
ON BANAY BANAY-PANGAO RIVER REHABILITATION
WHEREAS, the Barangay Pangao is committed to the protection, preservation and conservation
of the ecosystem;
WHEREAS, it is the responsibility of the barangay to effectively and efficiently implement the
Clean Water Act under Republic Act No. 9275 in its territorial jurisdictions;
WHEREAS, Section 16 of the Local Government Code (RA 7160) also provides:
“SEC. 16. General Welfare. – Every local government unit shall exercise the
powers expressly granted, those necessarily implied therefrom, as well as powers
necessary, appropriate, or incidental for its efficient and effective governance, and
those which are essential to the promotion of the general welfare.Within their
respective territorial jurisdictions, local government units shall ensure and support,
among other things . . . promote health and safety, enhance the right of the people to
a balanced ecology, maintain peace and order, and preserve the comfort and
convenience of their inhabitants.” [underscoring supplied.]
WHEREAS, the unsystematic waste disposal by poultries and piggeries, whether small-scale or
large-sclae, within the area of Banay Banay-Pangao River, cause unsightly surroundings and
spread of communicable diseases;
WHEREAS, the practice of animal waste disposal to preserve the cleanliness, usefulness, and
healthful ecology
ARTICLE I
Title of the Ordinance
This Ordinance shall be known as the “Banay Banay-Pangao River Rehabilitation Ordinance of
Barangay Pangao, Lipa City, Batangas.”
ARTICLE II
Coverage
This Ordinance shall apply to all Piggeries, Poultries and any other livestock farms within the
vicinity of the Banay-Banay-Pangao River situated within the territorial jurisdictions of
Barangay Pangao of the City of Lipa.
ARTICLE III
Authority and Purpose/Goals
SECTION 1. Authority. This Ordinance is enacted to implement the provisions of Republic Act
No. 9275 which mandates the protection of Banay Banay-Pangao River from unsystemized
waste disposal of piggeries and poulties within the area of the said river.
a) To strengthen the prohibition of improper waste disposal into the Banay Banay-Pangao
River;
b) To enhance the total environment of the locality through the necessary control and
mitigation of negative environmental impacts of solid waste;
c) To promote and protect the health, safety, peace and convenience of the general welfare
of the inhabitants of the Barangay;
SECTION 3. Goal. The primary goal of this Ordinance is to enhance ecological balance of the
community through sustainable and integrated waste management.
c) to maximize and optimize sanitary resource recovery for feeds, materials and others; and
ARTICLE IV
Definition of Terms
SECTION 5. Technical Terms. The technical terms used in this Ordinance shall be defined as
follows:
a) Sanitary - refers to the health, with special reference to cleanliness and freedom from
infective and deleterious influences.
b) Animal waste - means animal excreta, discarded products, bedding, wash waters, waste
feed, and silage drainage. "Animal waste" also includes the compost products resulting
from the composting of dead animals;
c) Pig farming - is the raising and breeding of domestic pigs, a branch of animal husbandry.
