CONTRACT TO SELL

KNOW ALL MEN BY THESE PRESENTS:

This AGREEMENT, made and entered by and between:

_____________________, of legal age, Filipino citizen, with address at


Bolabog Beach, Boracay Island, Malay, Aklan, 5608 hereinafter called the
BUYER;

-AND-

_____________________, of legal age, a Filipino citizen, with address at


Bolabog Beach, Boracay Island, Malay, Aklan, 5608 hereinafter called the
SELLER
WITNESSETH:

WHEREAS, the SELLER is the owner of a parcel of land identified as Lot No.
______________________ of an area of SIX HUNDRED SIXTY NINE 669 square
meters, located at Sitio Bolabog, Brgy. Balabag, Malay, Aklan covered by ARP/TD No.
_________________________.

WHEREAS, the SELLER has offered to sell and the BUYER has agreed to buy a
portion or EIGHTY SEVEN (87) square meters of the above mentioned property as
described in the sketch plan prepared by _______________________ subject to the
following terms and conditions:

1. That the consideration of sale shall be in the amount of FOUR MILLION FIVE
HUNDRED THOUSAND (PHP 4,500,000.00) PESOS, Philippine Currency,
which shall be paid as follows, to wit:

a) That the amount of FOUR HUNDRED FIFTY PESOS (Php 450,000.00),


Philippine Currency, shall be paid upon the signing of this agreement;

b) That the amount of ONE MILLION EIGHT HUNDRED THOUSAND


PESOS (Php 1,800,000.00), Philippine Currency, shall be paid on or before
June 6, 2019; That upon receipt of this 2nd installment, the SELLER shall
undertake to clear the subject parcel of land and the house standing thereon from
tenants/boarders/occupants; and that the BUYER shall then be allowed to
inspect the said subject land and building thereon;

c) That the balance of TWO MILLION TWO HUNDRED FIFTY


THOUSAND PESOS (Php 2,250,000.00), Philippine Currency, shall be paid
on or before June 12, 2019; subject to the conditions that a Certification declaring
the subject parcel of land as Alienable and Disposable (A & D) is accomplished
and DEED OF ABSOLUTE SALE is ready;

2. That a DEED OF ABSOLUTE SALE shall be executed by the SELLER together


with the conformity of his siblings/relatives indicated in the sketch plan of the
mother lot of the subject parcel of land upon the full payment of the consideration
sale of the afore-described parcel of land by the BUYER;
3. That Capital Gains Tax shall be on the account of the SELLER; While the
Documentary Stamp Tax, Transfer Tax, Registration fee, assessments, charges,
notarial fee and other incidental expenses arising from the execution of this
agreement shall be on the account of the BUYER.

4. That the BUYER shall take ownership and physical possession over the subject
parcel of land together with the house/building standing thereon upon the execution
of the said DEED OF ABSOLUTE SALE;

WHEREAS, this agreement is made, entered and executed by both parties in good
faith and any and all stipulations set forth herein shall be duly complied with accordingly.
