Department Secretaries/Aqencv/GocC/GFl Heads to Fill
Regular/PermanenUltemized Positions

This is in view of the Department of Budget and l\ranagement's issuance of Circular


Letter No. 2010-3 dated January 29, 2010 which provides interim authority to Secretaries/Heads
of Agencies/GOCCS/GFls to fill authorized regular/permanenvitemized positions that are
necessary in the performance of their vital/core functions from the effectivity of the said Circular
Letter spjqusrsLag!4M.

Please be guided that the said Circular Leiter became effective upon its publication in
ihe Manila Bulleiin on Januarv 31.2010.

ln accordance with ltem 2.5 of ihe said Circular Letter, ihe DBM has fumished the Civil
Service Commission with a list of departments/agencies whose Rationalization Plans fall
under various categories as CSC Otfices' reference in acting on relevant appointments.

Thus, a copy of the said list is hereby being furnished all Regional and Field Offices, for
its perusal.

Also attached are the following, for the CSC RO and FOs' reference:

o Copy of DBM Circular Letter 201 0-3 dated January 29, 2010; and
o DBM Circular Letter No.2009-13 daied December'18, 2009 -

This Circular Letter is being issued to pro,"ide autbority to Secretaries/Heads of

this Circular Letter up to 25 Match 2010.

2.0 Guidelines

2.7 Positlon, Authorized to be Filled

2.1.1 Deparhnent Seoetaries/Heads of Agencies/GOCCs/GFls are hereby


authorized to fiIl the following regular/permanent/itemized positions
which are in thei existing authorized staffing pattem, either through
odginal appointruent, promotion ol reemployment, from the date of the
effectivily of this Circular Letter up to 25 March 2010 (the last day for
said personnel actions undfl Cotfinission on Elections (COMELEC)
Resolutinn No. 8616 dated 1 4 July 2009):

a. Unde$ecrctary and Assistant Secretary positions, including similar


items, subject to Presideirtial action, but not to exce€d the number of
' positions authorized under their latest respeotive legal basis;

b. Positions which have been previously authorized to be filled by the


Department of Budget and Ma{agement (DBIO but have beeo
subsequently vacated;

c. Teaching positions, medical a.nd allied medical items in hospitals


and other medical facilities sewicing agency clienrs, provided these
are lvithin the existing stardards set jointty by the Department
concemed and the DBM:
d. Uniformed positiols in the Departments of National Defense. the
interior and Local (rovenurenl. Tr,ln,po aliorr ;rnd
Conn1uoications, and Enviroment and. Nahual Resouces:

2.1.2 The hlling of said positions is being authorized, subject to pertinent


budgetary-, civil service, accolrnting and auditing ru1es ard regulations,
and the following conditiofis:

a. Positions for filling arclunded ltnder the FY 2009 and the proposed
FY 201 0 budgets of the Depaftment/Agency/cocc/cpli

b- The action would not eotail additional budgetary release or the


realignment ofnon-Personal Senices (PS) funds to PS; and

c. The total mrmber of filled positions in the Department/Agency/


GOCC/GFI at the statt of its rationalization efforrs would not be
exceeded, exclusive of teaching positions, medlcal and allied
medicai items in hospitals, tuld unifonned positions.

2.1.3 Provisions of COMELEC Replutions No. 8616 and 8732 dated,14 \tly
2009 and 23 Decernber 2009, respectively, on prohibited acts dudng the
election period shall like\rise be adopled by the Department
Secretaries/Heads of Agencies/GOCCs/GFIs in the fi liing of positions.

2.2.1 Department Secretaries&Ieads of Agencies/GOCCs/GF1s, whose
submitted Plans are still being evaluated by this Depa.tment, are
likewise autho zed to hll the following vacant positions whioh are in
their existing authorized staffmg pattem:

a. Director positions, includirg similar items, subject to Presidential


action;

b. Irnmediate suppof staff of Director positions, subject to the


following:

b.1 No F,xecutive Assistz[1t nor Private Secretary positions shall be


filled;

b.2 The filling of the position/s shail not exceed the maximum
number and level of positions allowable for the key

c. One-of-its-kind positions in a specihc unit and technical items that

item that shall be filled per division; and

d. Critical adminisfative/suppod items in ihe division concemed,


except those providing services lhat could be outsourced, provided
that the total administrative/supPort positions fiiled at any ol]e time
in a particular division shall not exceed 50% of its total
administrative/support positions

2.2.2 The filling ofpositions under Section 2 2.1 is being aut.horized provided
they are ,rot alfected :'fi..d..r the submitted Ralionalization Plan,
i.e., proposed 'to either be abolished, converted, reciassified or
transferred to another udt, and the conditions set under Scctions 2.1.2
and 2.1.3, shall be strictly folLowed.

2.3.1 DepartDents/Agencies/Goccs/GFls with parlial subnlissions, rvith


Plalx that have been withdra$4 retumed without action, or still for
subnission to DBM shall continually be covered by the provisions of
DBM Circular Letter 2009-13 (Reiteration/Clarification of Certain
Guidelines Related to fie Filling ofpositions/Hirilg oipersonnel Under
Executive Order 366) dated 18 Decenrber 2009 with regard to the
moratorium on the filling of positions, except thosg positions indicated
under Section 2.1.

2.4 Othet Positions Still Covercd by the Moratorium on the Fillins ofpositions

2.4.1 The following items shall continually be covered by thc moratorium on


thc fi lling ol posit ion.:

a. Medical and ailied rnedical iterns, which primarily provide seflices


to agency persoinel, consistent r&'ith Section 2.1 ofDBM Circular
Letter 2009-13;

b. Those positions providing admilistrative/support services (e.g.,


utility, building and grcunds maintenarceJ messeitge al, secudty
and transpofiatiortmobility) which should have been outsourced by
the Depafi me11t/Agency/GOCC/CFI; and

c. 'lhose items earlier declared as CTI and sltould have alreadv been
abolished-

2.5 The DBM shall give the Civil Ser.vice Coumission for its reference the list of
departments/agencies u'hose Rationalization Plans fall rurder vadous categoties.

3.0 R€porting Scheme

The Ilepaltment Secretary/Head of Agency/GOCC/GFI, the Head of the Change


Management Team, and the Head of thc Personnel/Homan Resource Division/Unit

4,0 Responsibilit5r Clause

I1 shail be the joint responsibility of the Depaftment Secretaxy/Head of llte


Agerc)y'GOCC/GFI, the Head ofthe Change Management Teanl and the Head ofthe
Personnei/Human Resource Divisionrunit to strictly enforce the provisions of this
Circular Letter. In case of any violation of the sarne, the tluee (3) officials
aforementiored shall be held jointly liable fbr any darnage it mav cause on the
personnel so affected upon the implemertation of the Department/Agency
Rationalization Plan

Repe.aling Clause

Pertinent portioirs ofDBM Circslar Letter 2009-13 dated 18 December 2009 that are
inconsistent with this Circular Letter are hereby repealed, amended or modified
accordingly for the duration that this Circular Letter shall be in effect.

6.0 ElTeclivity

This Circular Letter shall take effect upon its publication in a newspaper of general
circulation up lo 25 March 20 I 0.
