JUDICIAL AFFIDAVIT
of PO1 JUAN SANTOS

I, PO1 Juan Santos, of legal age, married, Filipino, with postal address in
Barangay Sta. Maria, Zamboanga City, after having been duly sworn to in
accordance with law, fully conscious that I am answering the following questions
under oath, and that I may face criminal liability for false testimony or perjury and
said judicial affidavit was conducted at the Police Station 11 located at Gov. Lim
Avenue, Zamboanga City, which taking was done in English which I can fully
comprehends and speaks, hereby deposes and states as follows:

OFFER OF TESTIMONY
This affidavit of the witness, PO1 Juan Santos is being offered to prove that

 The accused Pedro violated Section 5 of RA9165.


 The proper procedure was followed in accordance with the law
in the conduct of the buy bust operation.
 During the Buy bust operation he personally handed the marked
money to the accused and he personally received the Sachet of
Shabu from the accused.
 And, to identify this affidavit and other matters related to or
germane to his main testimony.

DIRECT TESTIMONY

Question 1: Please State your name and other circumstances for the record.
Answer 1: I am PO1 Pedro Santos, 49 years of age, married, and a resident of
Barangay Sta.Maria, Zamboanga City.

Question 2: Why are you here in my office today?


Answer 2: I am going to give my testimony in relation to the incident which
transpired on October 20, 2018.

Question 3: How long have you been working with the PNP by the way?
Answer 3: I’ve been working with the PNP for 20 years.

Question4: How long have you been conducting a buy bust operation?
Answer 4: Ive been conducting buy bust operation for 15 years.

Q5: Where were you on October 20, 2018?


A5: I was at the police station.

Q6: Can you recall anything that has transpired on the day of October 20, 2018
when you were at the office?

A6: On the same day in the morning around 6am, I received a confidential
information from our civilian agent that a certain “Pedro” is selling shabu in
Baliwasan.

Q7: What happened after you received the information?


A7: I informed my superior and he decided to conduct a buy bust operation.

Q8: What happened after that??


A8: A briefing was conducted by our station commander PCINSP Concordio
Procopio.

Q9: Can you tell me what happened during the conduct of briefing?

A9: During the briefing it was decided that I will be assigned as the poseur buyer
while P03 Berto Masigasig was assigned as the arresting officer. A pre-arranged
signal was also set on, wherein I will light up a piece of cigarette using a lighter
which would mean that the transaction had already been completed. And the
arresting officer will have to immediately search for the item in his possession and
arrest him.

Q10: As a poseur buyer what does your role entail in the said buy bust operation?
A10: I was assigned to meet up with the accused and act as the buyer of the
dangerous drugs.

Q11: Is there any other procedure you’ve discussed during your briefing?
A11: Yes. We have discussed that we have to inform the barangay officials of
Barangay Baliwasan that a buy bust operation will be conducted and coordination
should also be made with PDEA9.

Q12: Were all those things been complied?


A12: Yes. We made all the necessary actions and procedure required by law before
we conducted the buy bust operation.

Q13: Can you please elaborate to us those necessary actions and procedure you
are talking about?
A13: Yes. We have communicated our plan for buy bust operation with the
Barangay Officials of Baliwasan so they could accompany us during the buy bust
operation.

Q14: What else have you done?


A14: We were able to obtain a Coordination Certificate from PDEA, and Pre
operational coordination sheet.

Q15: If those documents you’ve mentioned will be shown to you will you be able
to identify it?
A15: Yes.

Q16: How will you be able to identify it?


A16: I personally requested for those documents and it bears my signature.

Q17: When did you comply with those procedures?
A17: We did it right after the briefing and before proceeding with the buy bust
operation.

Q18: And then what happened after you’ve conducted the briefing and complied
with those requirements?
A18: I together with Berto Masigasig and the SDET Team went to Baliwasan to
conduct the buy bust operation.

Q19: What happened during the buy bust operation?


A19: I went ahead to the target area to meet with the alleged drug seller while
being secretly followed by the arresting officer, P03 Berto Masigasig and SDET
Team members.

Q20: Can you tell me, where exactly is this target area you are talking about?
A20: Yes, it was at Chico Drive Baliwasan, at an abandoned building.

Q21: You said that you were secretly accompanied by the SDET Team members.
Can you tell me what are their functions/role in the buy bust operation?
A21: They serve as the backup if the arresting officer will have trouble to capture
the drug pusher.

Q22: What happened when you arrived at the target area?


A22: I waited for the accused to arrive while the arresting officer and SDET Team
Members positioned themselves strategically a few meters away from the target
place wherein the transaction is visible

Q23: What happened after that?


A23: Few minutes later, a man arrived and approached me and introduced himself
as “Pedro”.

Q24: What happened next?

A24: The man who introduced himself as Pedro asked me “ Magkano man bibilhin
mo? (How much will you buy?), then I answered “Sampung Libo”(“Ten Thousand
Pesos”).

Q25: What happened after that conversation?


A25: For me to be certain that he was the man my informant said to be the drug
pusher I asked him to show me his item and he did as asked. He opened his sling
bag and showed me 10 sachets of white crystalline substance which looked like a
shabu.

Q26: What happened after he showed you the items?


A26: He then asked me for the money so there and then I handed him the envelope
containing the marked money and few papers cut into money shaped.

Q27: Was the marked money registered?


A27: Yes.

Q28: How could you say so?


A28: We submitted a request for marked money and thereafter received the
acknowledgment form.

Q29: When did you asked for the money to be registered?


A29: Before the conduct of the buy bust operation.

Q30: When was the request acknowledged?


A30: It was immediately acknowledged, since our head was aware of its urgency.

Q31: If that request and acknowledgment from be shown to you will you be able to
identify it?
A31: Yes.
Q32: How will you be able to identify it?

A32: I requested for it so it bears my signature.

Q33: I am showing you a request letter for marked money please go over it and tell
me if it has any relation to the document you were talking about?
A33: This is the letter I requested for marked money.

Q34: I am also showing to you an acknowledgment form for marked money please
go over it and tell me if it has any relation to the document you were talking about?
A34: This is the acknowledgement form duly issued by our station commander.

Q35: You’ve mentioned that you have requested for the money to be marked? ‘ it?
A35: Yes

Q: What marking is that?


A: It was marked as JC-11, 10-20-18

Q36: If that marked money is shown to you will you be able to identify it?
A36: Yes.

Q37: How?
A37: It bears the serial number FN222333 that we registered.

Q38: I am showing you a One Hundred Peso Bill bearing a serial number FN
222333, please go over it and tell me if it has any relation to the marked money
you were talking about?
A38: This is the marked money I handed to Pedro during the buy bust operation.

Q39: What happened after you handed him the envelope containing the marked
money?
A39: He looked at the window of the envelope, after seeing the real money he
immediately placed it in his sling bag and handed me the sachet of white
crystalline substance which probably is a shabu.

A40: When was about to immediately leave the premise, I lighted up a cigarrete as
my signal to the arresting officer.

Q41: What happened after that?


A41: The arresting officer immediately responded to my signal and caught the
accused, who tried to escape and run away from us.

Q42: What happened after he was caught?


A42: The arresting officer together with some barangay officials checked if the
marked money was really in his possession, after seeing it in his sling bag, he was
immediately brought to the police station for investigation.
Q43: By the way after you received the 10 sachets of Shabu what did you do to it?
A43: I kept it in my possession at first while P03 Berto Masigasig was trying to
arrest Pedro but afterwards when the accused was already hand cuffed and the
marked money was already checked and verified to be in his possession, I turned
over the sachets of shabu to P03 Berto Masigasig.

Q44: Why did you turned over the sachets of shabu to him?
A44: He was assigned to keep the items in safe keeping and turn it over to the
Police Investigator P03 Abe Cede for inventory.

Q45: Are you sure it was kept safely before the turn over?
A45: Yes, I was with him the whole time even he turned over it to P03 Abe Cede.

Q46: Was the items submitted for inventory?


A46: Yes.

Q47: How did you know?


A47: I personally saw the document.

Q: If that inventory form is shown to you will you be able to identify it?
A: Yes.

Q48: How?
A48: It bears my signature.

Q49: Is there anything else you want to add to your statements?


A49: None sir.

corresponding answers given by him;
3. That he was not coached, in any manner, in giving him answers to
the questions propounded by the undersigned;
