COUNTER-AFFIDAVIT

(Affiant was advised to answer the questions asked of him, fully

aware that he does under oath, and informed that he may face criminal
liability for false testimony or perjury and understood thereof.)

I. WITNESS

This is the Counter Affidavit of Remar S. Ramirez of legal age,

Filipino, married and a resident of SRV, Dayawan, Villanueva Misamis
Oriental.

II. LAWYER

This Counter Affidavit is taken before ATTY. SYLVAN GERALD L.

SABIO at 2/F, Consortium Bldg., Corrales Extension, Cagayan de Oro City.

III. STATEMENT

The witness is answering the questions asked of him, fully conscious

that he does so under oath and that he may face criminal liability for false
testimony or perjury. The witness fully prefers Visayan language, hence
this counter affidavit is made in the language known to him and translated
in English.

IV. PURPOSE OF TESTIMONY

The purposes of the testimony of affiant are as follows:

 1. To state the truthful and actual occurrence of the events involved in
this instant case;
2. To prove that accused herein is not guilty of the crime charged;
3. To testify on other relevant matters.

A. Yes.

2. Q: Are you the same who is the respondent in the above-entitled

filed before the office of the Office Provincial Prosecutor?
[Ikaw ba kining respondent sa kaso nga nakasulat sa taas og
gipasaka didto sa buhatan sa Office of the Provincial
Prosecutor?]
A: Yes.

3. Q: Why are you here in our office?

A: I am here to execute my Counter Affidavit to tell everything I
know during the incident which led to the filing of this instant
case.

kung unsa ang tinuod nga panghitabo]

4. Q: What do you want to testify?

[Unsa man ang imong gusto i-storya?]
A: I would like to testify that the case filed against me is not true.
[Ako maga-ingon nga dili tinu-od ang kaso nga gipasaka sa
akoa]

5. Q: Why do you say so and what is the truth behind the incident?
[Nganong maka-ingon man ka ana ug unsa man di ang
kamatuoran?]
A: On December 21, 2017, about 1:00 o’clock in the morning, we
were eating noodles together with Dodie Gadian and Jeffrey
 Maloon at the eatery located besides the Coca Cola Plantation.
When we were about to leave, we have noticed that there is a
commotion happening outside Seven Eleven.
[Adtong December 21, 2017 mga ala-una (1:00) ang takna sa
kadlawon, nangaon mi og nudols uban silang Dodie Gadian ug
Jeffrey Maloon dadto sa kan-anan kilid sa planta sa coke. Imbes
mamauli na mi, among nakita nga naay nagkagubot dadto sa
gawas sa Seven Eleven.]

Q: What was the commotion all about?

[Unsa man ang kagubot nga nahitabo?]
A group of people attacking a person.
[Naay grupo nga gitabangan ang isa ka tao.]

Q: Can you identify the persons involved in the commotion?

[Nailhan ba nimo ang mga tao nga apil sa kagubot adtong
panahona?]
A: Yes. It was the group Ronie Sumabal, Charlie Dagasuhan,
Marky Tagucon and some other familiar faces which I do not
know their names.
[Oo. Grupo nila Ronnie Sumabal, Charlie Dagasuan, Marky
Tagucon og uban pa nga pamilyar ang mga dagway pero wala
ko kaila sa ilang mga ngalan.]

Q: What happened next, if any?

[Unsa man sunod nahitabo, kung naa man gani?]
They were chasing their victim towards our location. Then, my
cousin Dodie Gadian stopped and pacified Ronie Sumabay
because he felt sorry for the victim being attacked and hit by
bottles by the group.
[Og nagukod ang maong nagkagubot padulong sa amoang
giplastaran. Diin didto ang akong ig-agaw nga si Dodie nag-
pugong ug nag-aparta kang Ronie Sumabay kay naluoy siya sa
tao nga gitabangan og gibunalan ug botelya sa grupo.]

Q: What happened next, if any?

[Unsa man sunod nahitabo, kung naa man gani?]
A: While Dodie Gadian was trying to stop and talking to Ronie, the
latter did not comply instead he tried to punch my cousin with a
rock in his hands.
 [Samtang gapugngan og gaistoryahan ni dodie si Ronie
Sumabal, wala kini mituo ug iyang gi-aksyonan og sumbag ang
akong ig-agaw samtang gahawid og bato.]

Q: What happened next, if any?

[Unsa man ang sunod nahitabo, kung naa man gani?]
A: I immediately punched Ronie on his face to protect Dodie and we
ran away because we were afraid as there a number of them.
[Ako dayon gidiretsoan og sumbag si Ronie sa iyang dagway
para maprotektahan si Dodie og gidagan dayon mi palayo kay
nahadlok mi kay daghan kaayo sila.]

6. Q: Do you have other things to say?

[Naa pa ka bay gusto i-storya?]
A: Yes. I doubted that Charlie Dagasuan testified as witness to the
incident because before I punched Ronie, I saw Charlie
Dagasuan riding a motorcycle driven by Toba (habal-habal
driver). In fact before leaving he told Ronie Sumabal, “Sibat na ta
,pre! [let’s escape, bro!] ” but he did not comply.
[Natingala lang ko nga nagtestigo si Charlie Dagasuan batok
kanako nga sa wala pa nahitabo nakita nako siya nagsakay
naman siya og motor ni Toba (habal-habal driver) Makaingon ko
nga pauli na siya kay iya man gi-ignan si Ronnie Sumabal nga
“Sibat na ta, pre!”. Pero wala giuban si Ronnie sa iyaa.]

7. Q: Do you know for a fact that Ronie Sumabay was hospitalized

because of the incident?
[Nasayod ba ka nga nahospital si Ronie Sumabay tungod sa
maong insidente]
A: I am skeptical because the incident happened on December 21,
2017, while I heard from our locality that Ronie was hospitalized
on December 26, 2018 which I honestly believed that he was
retaliated by the one whom they attacked on December 21,
2018.
[Natingala pud ko, nga December 21, 2017 man to nahitabo ang
maong incidente, unya nakahibalo ko sa among lugar nga si
Ronie gidala sa hospital adtong December 26, 2017. Nagtuo
gyud ko nga gibalosan siya sa ilang gibirahan adtong panahona.]

A: Nothing more as of this moment.

on my own personal knowledge and that I am fully conscious and aware

false testimony.
