Smith #72350 On 4-10-2019, a formal Internal Affairs investigative summation was sent through the employee's chain-of-command for staff review and/or recommendation of disciplinary action. On 4-18-2019, Undersheriff P. Ivey #5423 concluded the review process with his review of the case. He agreed with the final classification of NOT SUSTAINED for the charges of Commission of Conduct Supporting Criminal Acts = Aggravated Assault, Falsification of Official Documents, and Unbecoming Conduct (Sexual Conduct on Duty) as well as SUSTAINED for the charges of Commission of Conduct Supporting Criminal Acts — Domestic Criminal Trespass, Departure From the Truth, Failure to be Wholly Candid, Failure to Conform to Work Standards, and Unbecoming Conduct against Corrections Officer Cierra N. Smith #72350 On July 20, 2018, Intemal Affairs received a complaint, via phone, from ai ERR who is the husband of Jacksonville Sheriffs Office (JSO) Corrections Officer Cierra N. Smith #72350. HIE is an officer in the United States Amy and resides in Fayetteville, North Carolina. C. Smith resides in Jacksonville, Florida. There were multiple allegations that were reported to Intemal Affairs. 1. An incident in which C. Smith allegedly filed a false police report against aM in reference to a domestic battery on September 3, 2017 at Hiway EEE acksonville, FL. 2. An incident in which C. Smith allegedly committed aggravated assault against Armeshia Johnson on February 20, 2018 at Case #2018-0504 Page #2 3. An incident in which C. Smith allegedly committed burglary to aM apartment on July 19, 2018 at [SSMS M0) a 4. An incident in which C. Smith allegedly used Sa -est card to purchase approximately $1,000 worth of merchandise without his permission. 5. An allegation in which C. Smith provided false information ae chain of command in reference to spousal support not being provided to her. 6. An allegation in which C. Smith threatened to release nude photos of Johnson iif EER irttriena) to her (Johnson) job. 7. An allegation in which C. Smith performed a sex act on a JSO employee while she was in a JSO uniform. The sex act was allegedly recorded on video. On July 27, 2018, this case was forwarded to the Integrity / Special Investigations Unit (ISIU) due to the alleged criminal allegations. The alleged burglary that occurred at ESEERROAICCESERELEOMICONEE Was investigated by Detective Zachary Pittman of the Fayetteville Police Department. Upon the conclusion of Pittman's investigation, a warrant was issued for C. Smith's arrest for the charge of Domestic Criminal Trespass in Cumberland County, NC (Case #2018-019217). The arrest warrant was issued on August 30, 2018. A Domestic Violence Order of Protection was also filed against C. Smith in Cumberland County by (RIM (Case #18CVD600490). According to the Complaint and Motion for Domestic Violence Protective Order, Ii [iiliileleged that the defendant (C. Smith) “has a pattern of making unannounced visits to my home with ill intent and also that the defendant “has been charged with Domestic Criminal Trespassing. She has an active warrant in the state of North Carolina” jggmgppso alleged “continuous social media slander.” On November 2, 2018, the charge of Domestic Criminal Trespass against C. Smith was dismissed due to insufficient evidence. The Domestic Violence Order of Protection against C. Smith was also dismissed on the same day. According to the protection order, the plaintiff “failed to prove grounds for issuance of a domestic violence protective order.” Intemal Affairs initiated an administrative investigation
