Seth,
We've had multiple conversations about Engler coming to Michigan. In fat, the March 4th reference is
‘memorialized within this very email string. I recognize that we cannot prevent our clients from misrepresenting
things to us but we do zontrol whether we further that misrepresentation to opposing counsel.
Engler being on travel restrictions had nothing to do with it and you know that, Please don't make this worse by
persisting inthis line of argument,
1 see no reason to talk itis is how you intend to proceed. If you want to discuss Engler coming to Lansing in
the next two weeks, you can speak with Dave to set it up,
‘This materi to serious for tis type of gamesmanship. Your client has ruined his credibility through his own
actions. I won't now participate in revisionist history

‘You completely mischaracterize our conversation. I never represented that Mr. Engler would not be in
Michigan between our last conversation and the 28th. I was in New Orleans during the entre week of March
4th for the annual ABA white coll criminal defense conference, so 1 was unavailable that week, not Mr.
Engler. Mr. Engler is not under any travel restrictions. Indeed, you and David have said he is nota target or
subject of the investigetion, let alone a person being supervised by the Cour,
| also never said Mr. Engler was not willing to travel to Michigan forthe interview. You offered to have Dave
travel to DC, so we accepted that offer out of mere convenience. Mr. Engler isnot trying to forum shop, which
‘would not make any sense in any event
i
| will respond to the remainder of your comments in a subsequent
| suggest we havea call today to futher discuss this matter. Iam available all afternoon
Best,Seth

seth,
‘The interview for the 28th is off. As you know, our agreement to travel to DC to interview Mr.
Engler was contingent on his representation that he would not be in the State of Michigan any
time in the near future. In fac, the partes reconfirmed that undarstanding a: recently a:
‘March &th. So you can imagine my surprise when I read the article below about Mr. Engler’s
attendance at recent MSU basketball games, including the Michigan game atthe Breslin Center
in East Lansing on March Sth. Apparently, your client thought his presence would go unnoticed
despite the fact that he was sitting front row, center court with 15,000 cameras in the
building.

\We have interviewed more than 500 people as part of our investigation. That includes
survivors, parents of survivors and current and former employees ofthe University. While it
‘was quite difficult for many of them to speak, they did so because it's important. Your client's
brazen disregard for this investigation and his willingness to lie about his whereabouts is not
‘only appaling but does a terrible disservice to the University. Infact, in retrospect i's clear
that Mr. Engler’ refusal to interview anywhere but DC was nothing more than an attempt to
secure a venue where he could le to investigators with impunity. That tactical maneuver
coupled with his demand to essentially have an advance script of the questioning clearly
demonstrates that he never had any intention of participating in this process in good faith. But,
‘ur office will not use taxpayer resources to fund a sham interview. On a personal note, as an
alumna of Michigan State, 'm embarrassed that our University’s former President can make
time to attend basketball games but not to sit to discuss the largest sexual assault seandal in
the history of higher education. The University deserves better.
Since Mr. Engler s not going to voluntarily participate inthis interview in good faith, we will
‘explore al legal resources available to secure his interview in Mchigan involuntarily including,
but not limited to, the enforcement of his ongoing contractual cbigations to the University. At
the end of the day, if Mr. Engler's conscience can't compel him to do the right thing, we will do
whatever we can to ensure that the law does.
