I was in New Orleans during the entre week of March 4th for the annual ABA white coll criminal defense conference, so 1 was unavailable that week, not Mr. Engler. Mr. Engler is not under any travel restrictions. Indeed, you and David have said he is nota target or subject of the investigetion, let alone a person being supervised by the Cour, | also never said Mr. Engler was not willing to travel to Michigan forthe interview. That tactical maneuver coupled with his demand to essentially have an advance script of the questioning clearly demonstrates that he never had any intention of participating in this process in good faith. On a personal note, as an alumna of Michigan State, 'm embarrassed that our University’s former President can make time to attend basketball games but not to sit to discuss the largest sexual assault seandal in the history of higher education. The University deserves better. Since Mr. Engler s not going to voluntarily participate inthis interview in good faith, we will ‘explore al legal resources available to secure his interview in Mchigan involuntarily including, but not limited to, the enforcement of his ongoing contractual cbigations to the University. At the end of the day, if Mr. Engler's conscience can't compel him to do the right thing, we will do whatever we can to ensure that the law does.
