 Extrajudicial Settlement of Estate

 Request for a Certification on the outstanding number of shares in our office. Below are the
requirements:
a) NSO copy or Certified True Copy of Death Certificate
b) An originally signed request letter from one of the heirs of the deceased shareholder
c) Required valid IDs of the requesting heirs (please see below list of required IDs)
d) Proof of relationship to the deceased shareholder of the requesting party (NSO copy or
Certified True Copy of Birth Certificate (child) or Marriage Contract or Certificate
(widow))
e) Payment of PHP100.00 for the certification fee in cash or cheque payable to RCBC
Securities Inc.

1. Deed of Extra-Judicial Partition (for more than 1 heir, with children or siblings)
a) Affidavit of Self-Adjudication (for sole heir and without children or siblings)
b) With Waiver if in favor of one of the heirs (minors are not allowed to waive, unless
there’s a court order)
c) Name of issue (RCBC Securities Inc.), number of shares, must appear on the
affidavit/deed
d) It should be sign by all heirs
e) Any of the following which should both be NOTARIZED and duly stamped received by
the Registry of Deeds

2. Proof of payment of, or exemption from Estate Taxes due on the shares of stock.
a. UNEXPIRED (CAR) Certificate Authorizing Registration (BIR Form 1954)
b. Tax Clearance Certificate
c. Payment of Documentary Stamp Tax (BIR Form 2000)
d. It should be NOTARIZED and duly stamped received by the Registry of Deeds.

***Total number of shares x market value at the time of death must appear and it is
clearly indicated that the shares are from RCBC Securities Inc.

3. Affidavit of Publication
a) Any newspaper company – must be of national circulation/generally circulated in the
Philippines
b) Should be published once every week for three (3) consecutive weeks
c) Should reflect the document number, book number, page number and series number
d) It should be NOTARIZED and duly stamped received by the Registry of Deeds .

4. Certified true copy of Birth Certificate of all surviving heirs from the NSO or Local Civil Registrar.
5. Marriage Contract if transfer to Spouse (Certified True copy or NSO copy)
6. NSO Original / Certified True Copy of Death Certificate.
7. Valid ID’s (not expired) of ALL the heirs.
a) Clear copy of one (1) Primary ID OR two (2) Secondary IDs which bear shareholder’s
exact name on record (extrajudicial, birth certificate, CAR)
b) Primary IDs: Passport with signature, Philippine Driver’s License, PRC card, Digitized
SSS /TIN
c) Secondary IDs: Company ID, Credit/ ATM card, Laminated TIN, Senior Citizen Card

For all the IDs:


a. Kindly photocopy the front and back portion of the IDs
b. Please ensure that signature on the ID/s is clear and verifiable
c. Please ensure that IDs are not expired

8. Duly filled-up specimen signature card of the claimants

9. Two Year Surety Bond (from a Non-Life Insurance Company i.e. Malayan, Insular, Prudential)
a) Period should start from the last day of publication and issued in favor of RCBC
Securities Inc.
b) Amount of which should be equivalent to the no of shares* market value of the
shares at the time of death or current market value whichever is higher.
c) It should be sign by all heirs
d) It should be NOTARIZED and duly stamped received by the Registry of Deeds
(Blue copy)

 All affidavit /waiver should be NOTARIZED and duly stamped received by the Registry of
Deeds.
