(a) Motion to dismiss the complaint except on the ground of lack of jurisdiction over
the subject matter or over the person of the respondent;
(b) Motion for a bill of particulars;
(c) Motion for new trial or for reopening of trial;
(d) Motion for extension of time to file verified answer or counter-affidavit in excess
of twenty (20) days;
(e) Second motion for extension of time to file verified answer or counter-affidavit;
(f) Second motion for reconsideration;
(g) Motion for reconsideration against any interlocutory order issued by the
Commission or the Board; and
(h) Demurrer to evidence.
ORDER OF DEFAULT

ANSWER
Section 4. Order of Default. – An Order of default shall be issued by the Board for
failure of the respondent to file his verified answer or counter-affidavit within fifteen (15)
days from receipt of summons. Complainant shall be directed to present his testimonial
evidence ex-parte by way of judicial affidavit and to file his written formal offer of exhibits,
a memorandum decision, including their soft copies, within ten (10) days from the
conclusion of the ex-parte presentation of evidence. The case shall be deemed submitted
for decision after the Hearing Officer has issued an Order on the formal offer of exhibits.
The respondent shall be entitled to notice of subsequent proceedings but shall not
be allowed to take part therein.
