requesting, pursuant to the Freedom of Information Act (*FOLA”), W. Va. Code § 29B-1, et seq
copies of the following records:
[A]n itemized list of costs incurred by the state of West Virginia and its agencies in relation
to the mine rescue operation for four people inside the Rock House Powellton Mine in
Raleigh/Boone County including payment made to or to be made to any independent
contractors.
Please be advised that we have not located any records in the Office of the Governor that are
responsive to your request. Responsive records might be found with the WV State Police, WV
Office of Miners’ Health, Safety and Training, and WV National Guard. Please contact these
agencies. Accordingly, your request is denied and our responsibilities in connection therewith are
