AFFIDAVIT-COMPLAINT

I, Elizabeth F. Gozo, Filipino, 28 years of age, married and a resident of

Brgy. Concepcion, Hilongos, Leyte, Philippines, after having been duly sworn to
in accordance with law, do hereby depose and state:

1. That I am married to Ricky G. Gozo on May 14, 2012. Hereto attached is

our Marriage Certificate marked as Annex “A”. Out of our marriage, I begot one
child named Ericka Faller Gozo. Hereto attached is the Birth Certificate marked
as Annex “B”.
2. My husband is a professional boxer and we live in Brgy. Concepcion,
Hilongos Leyte.
3. On December 28, 2013 at around 11:40 in the evening while I and my
daughter were inside our boarding house, Ricky G. Gozo, who was drank at that
time, suddenly arrived and without any apparent reason, tried to snatch our
daughter. I tried to prevent him from doing so but he bites me in my left leg, left
arm and right arm. I tried to defend myself but he continues to attack me by
pushing me and choking my neck. I was crying in pain and trembling in fear. I
reported the matter to the PNP Hilongos and have myself examine by the
Doctor. Hereto attached are the Police Blotter and Medical Certificate marked as
Annexes “C” and “D”, respectively.
4. This is not the first time I was subjected to violence by my husband.
Before, when we were still living together in Matalom Leyte, he tried to kill me
or threatened me with a batangas knife. When we transfer in Hilongos Leyte, he
again threatened with to death with a scissor. He always threatened me by
saying “Patyon taka ron”, whether he is under the influence of liquor or not.
5. Out of fear, I tried to ask a Barangay Protection Order from the Brgy.
Concepcion but Ricky Gozo never honors it. Hereto attached is BPO marked as
Annex “E”.
6. He continues to stalk me with threats and even threatened to deprive
me of my daughter. Because of this terrible situation, I am compelled to file a
criminal case against him for violation of RA 9262, be it physical, verbal and
psychological violence.
7. That this affidavit is executed voluntarily and for whatever legal
purpose it may serve best.
