DEED OF EXTRA JUDICIAL SETTLEMENT

WITH WAIVER AND DONATION

KNOW ALL MEN BY THESE PRESENTS:

This DEED made by and between:

THE HEIRS OF __________________ namely:

1) ________________, single/married/widow, Filipino of legal age and a resident
of ___________________.
2) __________________, single/married/widow, Filipino, of legal age and a
resident of ___________________.
3) ___________________, Filipino, of legal age and a resident of
_____________________.

W I T N E S S E T H:

The late ________________________, in life, was the owner of the following

parcel of land more particularly described as follows:

TRANSFER CERTIFICATE OF TITLE No. ___________

“A parcel of land (Lot ________ containing an area of

_____________________ (____________) SQUARE METERS
more or less”.

_______________________ died on _________________, in

_________________, leaving the above-described property and the above-named
persons as his heirs.
The parties hereto being all of legal age, and with full capacity to contract, and
being the exclusive heirs of the aforesaid deceased, by these presents agree to divide
and adjudicate, as they hereby divide and adjudicate unto themselves the conjugal share
of the decedent to the above-described parcel of land and the properties of
__________________ of the said conjugal share to each of the heirs.

__________________ hereby waives all her shares to the above described

property to her children.
For and in consideration of the love and affection which the DONEES inspire in the
DONOR, taking into account that the DONOR is the DONEES’ mother, as an act of
liberality and generosity, the DONOR hereby, for the first time in her lifetime, voluntarily
and freely gives, transfer and convey, by way of donation unto said DONEES, their
executors, administrators and assigns all her conjugal share to the above-named parcel
of land in equal portions.

The DONOR further states, that this donation is not made with the purpose of
defrauding her creditors, having reserved to herself property sufficient to answer for any
and all lawful debts.

The DONEES hereby RECEIVE and ACCEPT this gift and donation, made in their
favor by the DONOR, and they hereby express their appreciation and gratefulness for the
kindness and generosity of the DONOR.
