India Pvt Ltd (“AMS”) for the benefit of the customers of Reliance ResQ ("ResQ").

1. This Repair Contract will serve you for any inherent mechanical and electrical breakdown/ defects to the
electrical/ electronic/ mechanical parts of your mobile device during the contract period.

This is an electronically generated document, customer is deemed to consent to this repair contract at the time they
receive it.
    2 Terms and Conditions:

2. 1. Definitions:

2.1.1 Mobile Devices: – Includes Mobile Smartphones and Tablets or any other Mobile Device that
may be included from time to time which should be for domestic use only and not to be used for
commercial, rental, or profit generation purposes.

2.1.2 Official Channels – Manufacturer, Manufacturer’s subsidiary company, Authorized dealer/


Distributor appointed by the Manufacturer or its subsidiary located within India.

2.1.3 Normal Use – Use of the Mobile Device in accordance with the manufacturers guidelines for
Mobile Device usage including but not limited to regular maintenance & up keep of the Mobile
Device, usage of specified protection devices such as voltage stabilizers.

2.1.4 Breakdown – Breakdown means the mechanical and/ or electrical defects and/ or failure of a
Mobile Device that cause it to not function in its intended manner.

2.1.5 BER – Beyond Economic Repairs means cost of a repair is greater than the current market value
(at the time of repair request) of the Mobile Device as determined by AMS or 80% of the Mobile
Device Purchase Price, whichever is lower.

2.1.6 Like-To-Like Model – Mobile Device with similar configuration, and quality comparable to your
Mobile Device. It may be of a different make/model.

2.1.7 Manufacturer Covered Breakdown – Breakdown covered by the Manufacturer’s Warranty


during the Manufacturer’s Warranty period. The covered breakdown will vary for each Mobile
Device in accordance with the Manufacturer’s Warranty for the said Mobile Device.

2.1.8 Manufacturer’s Warranty – The original warranty given by the respective manufacturer in
respect of a Mobile Device.

2.1.9 Manufacturer’s Warranty Period – The uninterrupted period of the manufacturer’s Warranty
covers as stated on the original official Manufacturer’s Warranty certificate or publication.

2.1.10 Manufacturer’s Recall – Any event wherein due to mechanical or technical issues, the
manufacturer of the Mobile Device recalls the Mobile Device, or the category of such Mobile
Devices.

2.1.11 Overload – Non-functioning of the Mobile Device due to an excessive electrical load such that
the normal functioning of Mobile Device gets impaired.

2.1.12 You/ Your – The customer mentioned in this Repair Contract.


2. 2. Benefits:

2.2.1 Provides repair or replacement in respect of the Mobile Device above caused due to Breakdown
from manufacturing defects arising during the Contract period.

2.2.2 Repair services and cost of parts and labor in respect of the Mobile Device for inherent
mechanical and electrical breakdown/ defects to the extent provided by the manufacturer’s
warranty for Mobile Device manufactured in India or is legally imported in India & sold through
Official Channels supported by an invoice & Manufacturer’s Warranty.

2.2.3 If AMS concludes that your Mobile Device falls within the definition of BER under this Repair
Contract ("BER Mobile Device”):

2.2.3.1 provided that our authorized technician confirms that your device is an original device for
example, based on assessment to your IMEI (e.g. printed in your Mobile Device), liquid
crystal display (LCD) and motherboard, AMS will offer you a replacement of the BER
Mobile Device with a Like-To-Like Model of Your Mobile Device at our discretion.
2.2.3.2 you will be required to surrender the BER Mobile Device to AMS, and it shall be
automatically deemed that you transfer all rights of the BER Mobile Device to AMS.
2.2.3.3 the Mobile Device replacement will be delivered to you after you surrender to AMS your
BER Mobile Device.
2.2.3.4 if you are not agreeable to AMS offer to provide the replacement Mobile Device, your
BER Mobile Device will be returned to you in unrepaired condition.
2.2.3.5 Any such replacement will immediately terminate this Repair Contract with no refund of
the Repair Contract Fee and we shall have no further obligations for the remainder of the
term of the Contract Period.

2. 3. Key Conditions:

2.3.1 This Repair Contract becomes valid only on purchase of the Mobile Device.

2.3.2 The Mobile Device must be manufactured in India or is legally imported in India.

2.3.3 The Mobile Device must be purchased new from the manufacturers authorized dealer/ distributor
and must be supported by Manufacturer’s Warranty.

2.3.4 This Repair Contract is valid only in India on Mobile Devices which are purchased and repaired
within India.

2.3.5 The repair request must be raised by you or in whose name this Contract stands and must be
within the Contract period and 7 (seven) days from the date of Breakdown of Mobile Device,
whichever is earlier.

2.3.6 The Mobile Device is used in accordance with the manufacturer’s guidelines for Mobile Device
usage including but not limited to regular maintenance & up keep of the Mobile Device.

2.3.7 Manufacturer’s Warranty remains valid throughout its validity period provided by the
manufacturer.

2.3.8 This Repair Contract will be cancelled in the event of fraud, attempted fraud, or non-disclosure of
any changes that affect this Repair contract and no refund will be due to You.
2.3.9 This Repair Contract only valid for the Mobile Device detailed at the beginning of this Repair
Contract. This Repair Contract is not assignable or transferable for any reason (including but not
limited to the case of the Mobile Device being sold to or stolen by a third party).

2.3.10 In the case of a Mobile Device which is “dead on arrival” from the manufacturer within 30 days as
of the date of the relevant invoice, the Repair Contract can be transferred to the replacement
device provided by the manufacturer for such dead on arrival unit. You must notify AMS in
writing, through the method mentioned in “Repair Request Process” section below, of any case
of dead on arrival along with the details of the replacement device given by the Manufacturer
within 30 days as of your receipt of the replacement device from the Manufacturer.

2.3.11 In the case of change of IMEI number due to in-warranty repair or replacement of mother board
or the Mobile Device itself, you must notify AMS in writing the change of the IMEI number
(including the new IMEI number) within 30 (thirty) days of the change or prior to Contract Period
Start Date, whichever is earlier.

2.3.12 After repair, any salvage remaining from the repairs carried out shall be retained and considered
owned by AMS.

2. 4. What is not included:

2.4.1 Breakdown caused by violating manufacturer’s warranty, Overload, abuse or negligence.

2.4.2 Regular wear and tear or gradual deterioration which affects performance.

2.4.3 Replacement of data, software, music etc. i.e. any data stored on device.

2.4.4 Damage to or malfunction of the phone caused by or attributed to the operation of a software
virus or any other software-based malfunction.

2.4.5 Costs implicitly or explicitly covered by any manufacturers, suppliers or repairers warranty.

2.4.6 Replacement of any consumable item or accessories like batteries, chargers, headphones, etc.

2.4.7 Non-operating and cosmetic damage to the Mobile Device, such as damage to paintwork, Mobile
Device finish, dents or scratches.

2.4.8 Any loss, including consequential loss, being any loss which may incurred by you as a result of
being unable to use Mobile Device during the repair period, but not limited to any loss arisen due
to natural causes, fire, water damage, terrorism, power surge.

2.4.9 Where the asset serial number is removed, obliterated or altered from the device.

2.4.10 If repairs have been conducted by unauthorized repair centres at any point during or before the
Contract Period.

2.4.11 Any costs implicitly or explicitly covered by any warranty, guarantee or maintenance agreement
provided by any other OEMs, sellers, service contractors, suppliers, or repairer.

2.4.12 Any defects that are subject to the Manufacturer’s Recall.


3.     Repair request Process:

3.1 Notify AMS of defect by:


3.1.1 Visiting http://cl.amsa.asia/relianceresq or
3.1.2 Visiting https://amtrustmobilesolutions.asia/ and raise a request via the chatbot Mia; or
3.1.3 Calling on 1800-102-8647; Monday to Sunday 9:00 am to 8:00 pm except public
holidays.

3.2 AMS will register the repair request.

3.3 AMS schedules pickup of the device.

3.4 AMS gets the device repaired through its approved technician.

3.5 AMS dispatches and delivers the repaired device to you.

4.     Limitation of Liability

4.1 In the event of any loss due to negligence of AMS while carrying out its obligations under this
Repair Contract, AMS’s liability under this Repair Contract shall not exceed the Mobile Device
Purchase Price specified at the beginning of this Repair Contract;

4.2 In any case AMS shall not be held responsible/liable for any loss of data, software, or contents
including but not limited to pictures/images, videos, downloads, music and/or any content stored
in the Mobile Device.

4.3 Unless otherwise clearly proven by you to AMS’s satisfaction that there is negligence by AMS
concerning the confidentiality/secrecy of data privacy while AMS is carrying out its obligations
under this Repair Contract, AMS shall not be responsible/liable for any violation(s)/breach under
the prevailing and/or proposed Laws (which may come into force) concerning the
confidentiality/secrecy of data privacy of your personal data,

5.     Governing Law & Jurisdiction

The construction, interpretation and meaning of the provisions of this Repair Contract shall be
determined in accordance with Indian law and by the Indian Courts.

6.     Miscellaneous

This Repair Contract may be amended from time to time, without Your prior written consent, by AMS
which amendment will be notified to You through the email You listed in the beginning of this Repair
Contract.
