PETITION

PETITIONERS, by counsel, unto this Honorable Court, most


respectfully allege:

1. That Petitioners are of legal age, married to each other, Japanese


and Filipino citizens, respectively, and residing at___________
________________, Japan. While in the Philippines, they are
residing at ______________________________;

2. That petitioners were married on ________________ at the


_________________________ as evidenced by their Certificate of
Marriage, a copy is attached as Annex A;

3. That petitioners wish to adopt their own illegitimate son,


____________, who is 12 years old, single, and residing with his
maternal sister at _______________________________;

4. That prior to the said marriage, the petitioners have been
sweethearts since ______. As a result of the said relationship,
minor _____________ was born. Attached as Annex B is the
Certificate of Live Birth of _____________ showing that he was
born on _______________ at ___________________;

5. That at the time _____________ was born, petitioner


____________, a Japanese national, was still married to
_____________. On December 29, 1993, the said marriage was
dissolved by virtue of a Decree of Divorce. A copy of a
Certificate issued by the Consulate-General of Japan stating that
petitioner ______________ is divorced from his wife on
_________________ is attached as Annex C.

6. That petitioners have all the qualifications and none of the


disqualification to adopt their own child and are in the best position
to give the child the proper care, custody, love and support;

7. That petitioners are in possession of full civil capacity and legal


rights, are of good moral character, had not been convicted of any
crime involving moral turpitude, are emotionally and
psychologically capable of caring for their son, and are in the
position to support and care for their son in keeping with the means
of the family;

8. That Japan has diplomatic relations with the Republic of the


Philippines;

9. That this adoption will serve the best interest of minor


_________________ as the same will raise his status from
illegitimate to legitimate and thus be entitled to the benefits and
privileges reserved for legitimate children.

WHEREFORE, Petitioners pray that after due notice, publication,


and hearing, judgment be rendered that henceforth, minor _____________
be declared to all intents and purposes, the legitimate child of the petitioners,
and henceforth be named __________________ .
