Tim Gordon's Ethics Filings Questionable


Steve McLaughlin, Republican candidate for State Assembly, today asked Tim Gordon to explain a confusing
pattern of irregularities and inconsistencies in his public statements and ethics filings.

McLaughlin's campaign raised the following concerns:


• If Gordon is a small businessman, why hasn't he shown any substantive income in his Annual
Statements of Financial Disclosure? If he hasn't received any substantive income from a small business
in several years, how can he truthfully call himself a small businessman and say he empathizes with
small business owners? (item 13)
• Is it ethical for an Assemblyman to be doing business with the State Education Department, an
organization whose leadership is selected by the Assembly Democrats? How can the Assemblyman tell
us, on the one hand, he did business with the state, but then turn around and say he didn't make any
substantive small business income? (items 5 and 13)
• Why did Gordon choose not to disclose that he did business as "Gordon's Fruits Co.", as the law
requires him, when Albany County Clerk documents clearly show this to be the case? (item 5)

"Tim Gordon represents the worst of Albany politics. He told us that we should have stricter ethics laws, but
he's ignoring the ones that are in place now. It's a lot like the way Tim calls himself an independent and then
takes almost three quarters of million dollars in campaign cash from Sheldon Silver. We deserve better than
these dishonesty and deception we're getting from Tim Gordon," said McLaughlin.

"Tim Gordon holds 'Doing Business As' (DBA) certificates for two businesses, declares the existence of only one
business, says he earned no meaningful income from either business and then tells us that he is a small
businessman. You don't have to be an accountant to see that something doesn't add up," said McLaughlin.

Immediately after joining the Assembly, Gordon mysteriously began doing business with the New York State
Education Department, an agency whose leadership is elected by the Legislature and is effectively under the
control of the Assembly Democrats.

"It doesn't make sense for Tim Gordon to admit he's taking money from the taxpayers for an unknown reason
and call himself a small businessman but at the same time only to turn around and claim he had no substantive
business income in any of the years he's served in Albany," said McLaughlin.

McLaughlin noted that the latest report was filed with the Legislative Ethics Commission on May 17, 2010, the
same day of Gordon's publicity stunt in Thacher Park.

"Perhaps if Tim wasn't so busy mowing the lawn in Thacher Park, he might have done a better job following the
law," said McLaughlin. "Tim is just another incumbent Democrat who has become part of the problem in
Albany and will say anything to get himself re-elected."

McLaughlin did offer one potential explanation for the numerous contradictions in Gordon's filings.

"Given all the job-killing tax increases and anti-business mandates that Tim Gordon supported, he might very
well have given up on trying to compete in New York's economy. I will gladly give him the same help I've given
hundreds of small businesses in the Capital Region," said McLaughlin.
