PETITION

Petitioner, in his own behalf, unto this Honorable Board, most respectfully avers:

1. That the petitioner is of legal age, Filipino, married and a resident of


__________________________;

2. That Public – respondent ___________________, in his capacity as Provincial


Agrarian Reform Program Officer _______________, is the head of the Provincial Office of
the Department of Agrarian Reform, primarily tasked by law to implement the agrarian
reform program of the government with office address at ________________________, where
he may be served with notice, summons and other legal services of this Honorable Board.
Likewise, Public – respondent Register of Deeds of _____________ is the agency of
government tasked in the custody and registration of titles under the Torrens System of
Registration, where it may be served with notice, summons and other legal services of this
Honorable Board.;

3. That the petitioner is a farmer – beneficiary of Operation Leasehold Transfer


by virtue of Republic Act No. 3844 involving ______________ with an area of ___ square
meters of the ________________, located at ______________________ as evidenced by an Order
of Award marked as Annex “A”;

4. That under Republic Act No. 3844, Land Bank of the Philippines finance the
acquisition of the ___________ to be distributed to the qualified beneficiary, as such Lot
No. __ was issued a Transfer Certificate of Title No. ___________ in the name of the Land
Bank of the Philippines whereby a Deed of Sale shall be issued by Land Bank of the
Philippines to the beneficiary after full payment of its amortizations. However, under the
new policy on the matter, Land Bank of the Philippines turned – over to DAR all the titles
under its name and custody involving R.A. 3844 Landed Estate, _____________ therefore
was transferred in the name of the Republic of the Philippines under TCT No.
______________, as evidenced by the hereto attached copy of the said title, marked as
Annex “B”;

5. That to guarantee the amortization payments of the subject lot an application


to purchase subject lot was executed by the petitioner, as evidenced by the hereto
attached copy of the Investigation/ Inspection Report of the Cluster Head,
________________________, marked as Annex “C”;
6. That under RULE II Section 1 of the 2009 DARAB Rules of Procedure, it
provides, quote:

Jurisdiction of the Board and the Adjudicators

SECTION 1. Primary and Exclusive Original and Appellate


Jurisdiction. — The Board shall have primary and exclusive jurisdiction, both
original and appellate, to determine and adjudicate all agrarian disputes
involving the implementation of the Comprehensive Agrarian Reform
Program (CARP) under R.A. No. 6657, as amended by R.A. No. 9700, E.O.
Nos. 228, 229, and 129-A, R.A. No. 3844 as amended by R.A. No. 6389,
Presidential Decree No. 27 and other agrarian laws and their Implementing
Rules and Regulations. Specifically, such jurisdiction shall include but not
be limited to cases involving the following:

a. The rights and obligations of persons, whether natural or juridical,


engaged in the management, cultivation, and use of all agricultural
lands covered by R.A. No. 6657, otherwise known as the
Comprehensive Agrarian Reform Law (CARL), as amended, and other
related agrarian laws;

h. Those cases involving the collection of amortization payments,
foreclosure and similar disputes concerning the functions of the LBP,
and payments for lands awarded under PD No. 27, RA No. 3844, as
amended, and R.A. No. 6657, as amended by R.A. No. 9700, and other
related laws, decrees, orders, instructions, rules, and regulations, as
well as payment for residential, commercial, and industrial lots within
the settlement and resettlement areas under the administration and
disposition of the DAR;

7. That the right of the petitioner as farmer - beneficiary over Lot No. __ must
likewise be confirmed;

8. That petitioner is availing of the benefit granted under Rule V Section 2 of the
2009 DARAB Rules of Procedure.

WHEREFORE, premises considered, it is most respectfully prayed to this Honorable


Office to confirm the right of the petitioner as farmer – beneficiary of ___________________
with an area of ___ square meters of the __________________.

Other reliefs just and equitable are likewise prayed for.
