AGREEMENT OF LEAVE AND LICENSE

THE AGREEMENT OF LEAVE AND LICENSE is made and entered


into at Mumbai on this 1st day of April 2017 BETWEEN MR. SAMIR
LALJI SHAH AGE 57 years, an adult, Indian inhabitant, presently
residing at A/102, Sai Sadan Apt., First floor, Devidas Lane, Borivali
(West), Mumbai – 400092 herein called the “OWNER / LICENSOR”.

(Which expression unless it be repugnant to the context or meaning


thereof be deemed to mean and include his / her heirs, executors,
administrators and assigns) of the FIRST PART.

AND MR. MANISH MAHENDRA PANCHAL AGE 46 years, an adult,


Indian inhabitant, presently residing at D-4/5, Angaraki Soci., Plot No.
214, Gorai-II, Borivali (West), Mumbai – 400 091. Herein after called
the “LICENSEE”.

(Which expression unless it be repugnant to the context or meaning


thereof be deemed to mean and include his / her heirs, executors,
administrators and assigns) of the SECOND PART.
AND WEREAS Licensor is the absolute owner and possession,
occupation of owner of D-4/5, Angaraki Soci., Plot No. 214, Gorai-II,
Borivali (West), Mumbai – 400 091. called the said premises and there
fully entitled to entered into this agreement.

And WHEREAS the licensee has approached the Licensor with a


request to give said premises on Leave and License basis for
temporary residential purpose with his family on the terms and
conditions herewith mentioned.

NOW THIS AGREEMENT WITNESSSTH AND IT IS HEREBY AGREED


BETWEEN THE PARTIES AS FOLLOW:

1. The Licensor hereby grant to the Licensee and the Licensee hereby
accept from the Licensor the License to occupy and use the said
premises mentioned herein above for temporary residential purpose
only for himself and his family members.
2. This agreement shall be for the period of 11 month effective from 01st
APRIL 2017 to 01st MARCH 2018.
3. (a) It is clearly agreed, understood and declare that this agreement is
purely a licensee only occupy and used the said premises and it is
further declared that this agreement is executed by the parties therein
under section 24 of the Maharashtra Rent Control Act 1999 (the Act)
and the said Licensee further undertake to honor the provisions of the
section 24 of the Act and the terms and condition of this agreement.
(b) As stipulated herein before, the license is granted subject to the
provisions of the Maharashtra Rent Control Act, 1999 as amended and
the licensor shall be entitled to approach the competent Authorities for
the said premises, after expiry of the license, the licensee should not
be refused to vacant or handover the possession.
4. The Licensee has agreed to pay Rs. 13,000/- (In words RUPEES
THIRTEEN THOUSAND ONLY) per month as a monthly compensation
and will be paid on 10th of calendar date every month. The Licensee
shall pay the charges for the electricity used in the said premises as
shown by separate meter and billed by the competent authorities. The
Licensee further undertake to pay all telephone charge (Including STD
/ ISD charges, if any) cable charges, etc. to the authorities concerned
and shall furnish and handover original copies of such bills after
payment thereof to the Licensor herein. If the Licensor has already
been given a written permission for the telephone line to the Licensee
then at time of termination of this agreement the Licensee should
withdraw or discontinue the same from the licensed premises.
5. The Licensee shall keep continued deposited with Licensor the deposit
amount of Rs. 130,000/- (In words RUPEES ONE LAKH THIRTY
THOUSAND ONLY) by cash, dated 01st APRIL, 2017. The balance after
deducting for over stay or for any pending bills shall be refunded
without any interest to the Licensee by the Licensor in one lump sum
on expiry or earlier determination of this agreement and on Licensee
handing over the physical, peaceful and vacant possession of the said
premises to the Licensor.
6. The use of the said premises for any other purpose other than for
bonafide residential purpose will amount to a serious breach of
security deposit and the same will stand forfeited.
7. It is further hereby agrees that the Licensee shall not part with the
possession of the said premises except to the Licensors herein and the
Licensors shall not allow any outsider to occupy the said premises or
any other part thereof.
8. The Licensee agrees that the said Licensee availing the use of the said
premises shall do so without causing annoyance, nuisance or
disturbance to the other occupation of the building.
9. During the subsistence of the agreement the Licensor and the Licensee
shall have the option to terminate this agreement by giving to each
other one month prior notice period in writing and this agreement will
accordingly stand terminated on the expiry of the period of notice,
then one month compensation will be recovered by the Licensor from
the Licensee. The Licensee shall not at any time sublet or part with the
possession of the said premises or any portion thereof.
10. The Licensee shall not at any time put any claim of tenancy or sub-
tenancy or any other right or title in the said premises and this
agreement shall not be constructed to create any such right
whatsoever in favor of Licensee.
11. The Licensee shall on expiry of period of this agreement or on earlier
revocation and / or earlier vacation of the said premises, remove
himself together with all his article and the things and handover the
possession of the said premises, along with furniture, fixture and other
articles in the said premises as per the list attached along with this
agreement as it was at the commencement of the license, (reasonable
wear and tear expected) peacefully and without any let or hindrance to
the Licensor.
12. On taking over the possession of the said premises, the Licensor shall
immediately return the security deposit to the Licensee after deducting
there from for any over stay / occupation or for any pending bills
(electricity, telephone, cables charges etc., or any such bills) and the
amount of loss, if any, in terms of money suffered by them on account
of damage to the said premises, fitting and fixtures therein.
13. The Licensor shall not be responsible or liable for any theft, loss,
damage or destruction of any property of the Licensee or of any other
person lying in the said premises nor for any bodily injury or harm to
any person in the said premises from any cause whatsoever.
14. The Licensee shall not carry out any structural alterations or additions
or any changes in the said premises.
15. The Licensee shall keep any maintain the interior of the said premises
and fitting and fixtures electrical, sanitary and plumbing in good
repaired condition at his own cost, whereas the Licensor will be
responsible for external repairs.
16. The Licensor shall pay the dues and outgoings (excluding electricity
charges) of the existing and future rates and taxes levied by any local
or public body or other authority in respect of the said premises
(Society’s maintenance bill will also be paid by Licensor only)
17. The Licensor or his agent shall have right to enter the Licensed
premises for inspection as and when necessary at a reasonable time.
18. The Licensee hereby undertake to surrender or shift the telephone
used in the said premises (if the said telephone is in the name of the
Licensee) before 15 days of expiry of this agreement and shall produce
the said surrender or shifting order before the Licensor. In absence of
such order the Licensor shall deduct the amount from security deposit
payable to the Licensee and only after production of such order from
the concerned authorities the Licensor shall return such deducted
amount.
19. The Licensee agrees that he will not take Ration Card, Aadhar Card,
Driving License and Telephone Connection or LIC Policy at the address
of the above said Flat / Premises without the prior permission in
writing from the Licensor, on the strength of this agreement.
20. That all the agreed terms and condition of the Leave and License are
expressly recorded herein and that there is no oral terms and condition
of this agreement the Licensee granted herein shall deem to be
automatically terminated.
21. This is all new agreement between Licensor and Licensee only and
there is no involvement of any estate agent, so neither party are liable
to pay any brokerage to any outside third person. The aforesaid rent of
Rs. 13,000/- (In words RUPEES THIRTEEN THOUSAND ONLY) per
month is mutually decided by both the party and subject to no
involvement of any person in between.

IN WITHNESS WHEREOF the parties have put their signature to this


agreement today i.e. 1St day of April 2017.
