LEAVE & LICENCE AGREEMENT

This LEAVE & LICENCE AGREEMENT is made & executed at Ahmedabad on this ____
day of July, 2017 BY & BETWEEN

MR. JIGAR NAVNITLAL DAVE, Aged-Adult, residing at C-21, Industrial Society, New
Sama Road, Vadodara. [Hereinafter referred to as the LICENSOR which expression
shall unless be repugnant to the context or meaning thereof be deemed to include all
their heirs, executors, successors etc.] of the ONE PART.

AND

MR. ANIL DHIRUBHAI BHARADIA, Aged-Adult, having permanent address at 324, Nr.
Pavan Chakaki, Village Charkha, Tal. Babra, Dist. Amreli – 365421. [Hereinafter referred
to as the LICENSEE which expression shall unless be repugnant to the context deemed
to include their, executors, successors and assigns] of the OTHER PART.

WHEREAS, MR. JIGAR NAVNITLAL DAVE, is LICENSOR of the Premises situated at


Flat No. C-302, Dev 181, Nr. Tulip School, Sterling City, Bopal, Ahmedabad, Gujarat
(Hereinafter called as the said premises) and the said premises is in vacant possession
of the LICENSOR and the LICENSOR is desirous of entering into an agreement at the
request of the LICENSEE and willing to give on hire the respective area on the following
terms and conditions:
1. The LICENSEE shall pay to the LICENSOR Rs.12,000/- [Rupees Twelve
Thousand only] per Month as a charges for occupying the said premises and the
said charges must be paid by LICENSEE in advance on or before 10 th of each
calendar month. This charge does not include Maintenance charges payable to
Society and Electricity charges. The LICENSEE is also liable to regularly pay
maintenance amount decided and revised by Society committee from time
to time, which is collected by Society committee for the usage of common
area, lift, maintaining CCTV camera, cleaning of common premises etc.
The society maintenance receipt shall be handed over to the LICENSOR
once received by LICENSEE.

2. The LICENSEE agrees to pay to the LICENSOR an amount equivalent to the


occupation charges of 2 months i.e. Rs.24,000/- [Rs. Twenty Four Thousand
only] as an interest free SECURITY DEPOSIT towards damages and dues etc.
which shall be refunded by the LICENSOR upon receiving the said premises in
good condition and after confirming no due from society and all other relevant
authorities. The LICENSEE shall not claim any interest portion on the security
deposit paid for the said premises.

3. This LEAVE & LICENCE AGREEMENT is for the period of 11 months only
starting from 15/07/2017 and ending on 14/06/2018. Thereafter, the same may
be extended further on mutual consent of both the parties in writing and by
executing fresh agreement on revised terms as may be agreed by parties
at that time. But in absence of any such extension, the said agreement
stands terminated on 14/06/2017 and LICENSEE is liable to provide
absolute and peaceful possession of said Premises to the LICENSOR.

4. In any event where the LICENSEE wishes to hand over the possession of the
premises occupied by him, he shall give One Month’s notice in advance of such
an intention. Similarly LICENSOR also have an option to get the premises
vacated by giving One Month’s notice to the LICENSEE. This notice must be in
writing and can be given to other party without giving any reason.

5. It is agreed by both the parties that at the instance of handing over possession,
the LICENSOR will give the said premises in proper condition. Thereafter, minor
repairs such as leaking of water taps, toilets, broken window glasses etc. shall be
done by the LICENSEE at his/her own expenses. Any major repair required to be
done should be brought to the notice of the LICENSOR. The LICENSEE is not
permitted to carry out any structural additions OR alternations to the building
layout and its Elevation without the written consent of the LICENSOR. However
the LICENSEE shall be free to fix room Coolers and/or Air Conditioners, if
needed.
6. All necessary Electricity bills have to be paid regularly by the LICENSEE. The
Photo copy of paid bill shall be submitted by LICENSEE along with payment of
occupational charges to the LICENSOR.

7. It is well understood and clear that for all the dues of electricity bills &
society maintenance till the date the possession of the premises is handed
over by the LICENSOR to the LICENSEE, it is the responsibility of the
LICENSOR to pay and clear them. Simultaneously, at the time of handing
over possession of the premises back to the LICENSOR by LICENSEE, it
is the responsibility of the LICENSEE to pay electricity, society
maintenance and any other charges, as presented by the Departments
concerned up to the date of vacating the said premises.

8. It is agreed between parties that the said premises shall be used by LICENSEE
Mr. Anil Dhirubhai Bharadia only for his Residential purpose and not be
substituted for any other purpose.

9. That the LICENSEE shall not sublet, assign or part with the demised
premises in whole or part thereof to any person in any circumstances
whatsoever and the same shall be used for the bonafide residential
purposes only and LICENSEE shall maintain the premises free from all
encumbrances and from any other illegal activities.

10. The LICENSOR has provided 3 fans, 4 tube lights, fix furniture of Kitchen,
wardrobe and dressing table of one bed room and TV cabinet which are
also a part of the said premises and servicing & repair will be the responsibility of
the LICENSEE. Further, the LICENSEE is also liable to return the same in an
appropriate condition at the time of completion of this agreement or its early
termination.

11. The LICENSEE at her/his cost shall keep the said premises in clean and
hygienic condition.

12. The LICENSEE shall permit the LICENSOR and his agent at all reasonable time,
subject to his convenience, during the duration of this agreement to inspect the
premises, prior information/intimation must be given before visiting the premises.

13. The LICENSEE shall not store or keep or bring any illegal or dangerous
material/item(s) which are not permitted as per the prevailing laws of state of
Gujarat & Country into the premises. LICENSEE shall also not be allowed to
bring material/item(s) which may be injurious to the premises/neighbors etc.
14. It is always agreed between the parties that the possession of the said premises
will always be that of LICENSOR and LICENSEE shall not claim any tenancy
rights.

15. All or any dispute regarding this contract or occupancy shall be first settled
mutually, if necessary by mutually agreed arbitrators and the jurisdiction shall be
at Vadodara location only.

16. The Leave and License Agreement is valid for 11 months (Eleven months) only.

IN WITNESS WHERE OF the parties hereto have set their respective hand
the day, month and year first herein above written in presence of the following
