praying to release the petitioner on bail in
Cr.No.166/14 of Malleshwaram P.S., Bangalore, for the

offence p/u/S.66(A) of Information Technology Act,


2008 and u/S.420 of IPC.

This Crl.P. coming on for orders this day, the


Court made the following:-

ORDER

Petitioner is accused No.1 in Cr.No.166/14 on the

file of Malleshwaram police station, registered for the

offences punishable under Section 66(A) of Information

Technology Act, 2008 and under Section 420 of IPC.

2. The gist of the allegation against the petitioner

and another accused is that they had used fake credit

cards in Mantri Mall at Malleshwaram on 18.07.2014 to

purchase two Apple-I phones.

3. Anyhow, the offences alleged are neither

punishable with death nor imprisonment for life.

Substantial portion of the investigation is already

completed. It is submitted by learned counsel for the

petitioner that similarly placed accused i.e., accused

No.2 has already been released on bail by the I ACMM

on 29.09.2014.

4. Accepting the factual submission of learned

counsel for the petitioner, the present petitioner is also

ordered to be release on bail by imposing suitable

conditions to safeguard the prosecution interest.

5. Accordingly, petition is allowed and bail is

granted to the petitioner, subject to the following

conditions:-

(i) Petitioner shall be released on bail on


his executing a personal bond for a sum
of Rs.50,000/- with one surety, for the
likesum to the satisfaction of the
learned CMM.

(ii) He shall not tamper or attempt to


tamper any of the prosecution
witnesses.

(iii) He shall not hold out threats to the


prosecution witnesses in any manner.

(iv) He shall not involve himself in any


criminal activities.

(v) He shall mark his attendance before the


jurisdictional police station on every
Sunday between 9 a.m. & 5 p.m., for a
period of six months from the date of his
release.
