AFFIDAVIT-COMPLAINT

I, ROMULO P. ESPIRITU, THELMA E. DELOS SANTOS atLOURDES E.

LIMTANGCO, all of legal age, after having been duly sworn to in accordance with law, depose
and state:
01. That I (Romulo Espiritu) am filing a criminal complaint for FALSIFICATION
under Art. 172 of the Revised Penal Code against Sps. EDUARDO ESPIRITU
andCONSTANCIA DEL ROSARIO-ESPIRITU, both of legal age and with
residence address at Tialo, San Jose Del Monte, Bulacan, for having forged my
signature appearing on a document entitled “Extra-Judicial Settlement of Estate with
Waiver of Share and Sale” dated August 11, 2010 executed in Quezon City,Annex
“A”, committed as follows:
“That the aforesaid respondent spouses have committed falsification enumerated in
Art. 171 in any public or official document xxx by causing it to appear that I have
participated in the execution of the said document when I did not in fact so participate
and by forging my signatures on the said document.”

(01. Na ako ay nagsasampang criminal complaint for FALSIFICATION sa

ilalim ng Revised Penal Code laban sa mag-asawang EDUARDO
ESPIRITU at CONSTANCIA DEL ROSARIO-ESPIRITU, may
mga sapat na taong gulang at nakatira sa Tialo, San Jose Del Monte,
Bulacan, dahil sa pinapalabas nilang ako ay gumawa ng isang
kasulatan at pumirma duon samantalang “fake o forgeries” ang mga
pirma or lagda sa nasabing dokumentong pinamagatang “Extra-
Judicial Settlement of Estate with Waiver of Share and Sale” na may
petsang August 11, 2010;)

02. That as one of the heirs of Isidro Espiritu, I am not adverse to the “Extra-judicial
Settlement of Estate With Waiver of Share and Sale” as we all want to adjudicate
upon ourselves the property of our deceased father as heirs. When I examined the said
document, I discovered that the signaturespurporting to be mine, were forged andis
NOT my signatures.

With Waiver of Share and Sale” sapagkat ito naman ang tama, napansin ko na di lahat
ng signatures duon ay tutoo. Kasama na duon ang mga signatures ko na pineke.”

03. Moreover, we have never relinquished nor waived our rights as heirs to the property
of our parents specifically from the land owned and registered in the name of Isidro
Espiritu, our deceased father.

(03.Hindi naming isinusuko ang aming mga karapatan bilang

tagapagmana sa naiwang proprieded or mana sa aming magulang na si
Isidro Espiritu.)

04. I have categorically and explicitly stated that my signatures in the document is not
mine and we are willing to have the copy of the Extra-Judicial Settlement of Estate
with Waiver of Share and Sale examined before the Questioned Document
Examination Division of the National Bureau of Investigation to prove the forgery of
my signatures thereof by the respondents, who benefited from the falsification of the
said document by making it appear that we participated in the execution of the same;

(04. Handa kaming patunayan na fake ang mga signatures sa dokumento

sa pamamagitan ng pagpapasuri nito sa Tanggapanng National Bureau of
Investigation (NBI).)

05. Another evidence of falsification is that the thumbmark appearing in the document
could not have been the thumbmark of Arsenio P. Espiritu for the reason that on
August 11, 2010, I, Lourdes E. Limtangco, declare that my father, Arsenio P.
Espiritu passed away on this date in the wee hours of the morning. Attached hereto is
a Certified True Copy of his Death Certificate, Annex “C”. I also doubt if the
respondents were able to ask my father to affix his thumbmark on the document
because I was always at the hospital by my father’s side.

(05. Nang nasabing petsang August 11, 2010, ang aking ama na si Arsenio
P. Espiritu ay pumanaw ng mga alas dos madaling araw kaya hindi
maaaring naka thumbmark sya nuon ding iyon. Di rin maaaring sabihin na
napapirma niya ang aking ama habang ito ay nasa ospital sapagkat ako ang
taga bantay sa kanya at hindi ko nakitang napapirma nila ang aking tatay.)

06. That we impute the forgeries of our signatures to the spouses EDUARDO ESPIRITU
andCONSTANCIA DEL ROSARIO-ESPIRITUbecause they were the ones
benefited from the sale transaction with a prospective buyer of our inherited property.

(06. Na alam naming na ang aming kapatid na si Eduardo at ang kanyang

asawaang may kinalaman sa paggawa ng dokumento palsipikado sapagkat
pagkatapos nito ay gumawang Contract to Sell itong si Eduardo Espiritu
hinggil sa pagbentang aming mana ng lupa sa aming ama at siya lamang
ang tumayong vendor or seller dito.)

07. That the forged document excluded us from reaping the benefits in our inherited
property from the sale transaction. As a matter of fact, upon verification, we
discovered that spouses EDUARDO ESPIRITU and CONSTANCIA DEL
ROSARIO-ESPIRITU have already received more than THREE MILLION PESOS
(PhP 3,000,000.00 plus) to the exclusion of the other heirs.

(07. Dahil sa pagkapalsipika ng aming mga signatures sa nasabing dokumento, kami

ay hindi nabigyan na kaukulang parte sa mga naunang bayad sa bentahan
nagkakahalaga ng tatlong milliong piso.)

08. We have executed the foregoing Joint Affidavit-Complaint in order that a criminal
case for Falsification will be filed against the respondents EDUARDO ESPIRITU
and his wife, CONSTANCIA DEL ROSARIO ESPIRITU.
