Defendant.
The undersigned prosecutor states on information and belief that the defendant, either
directly or as a party, at County of Davis, State of Utah, committed the crime(s) of:
§ 76-5-209, as follows: That the above named defendant, on or about March 5, 2019, did, under
circumstances not amounting to aggravated murder, murder, or manslaughter, cause the death of
Davis County Attorney and has received information from the investigating officer, David
Owens of the Woods Cross Police Department, and the information herein is based upon such
personal observations and investigation of said officer.
On March 5, 2019, Ross Letham came out of the room he was staying at in the
Intown Suites because a victim was on the phone and talking loudly. Letham didn't like this and
punched the victim, knocking him out and to the ground. As a result of the punch, the victim
died at the hospital, never regaining conciousness. Witnesses identified Letham as the assailant
Letham was on felony probation to Judge Kay in case no. 161701848. Under JRI,
however, he was terminated from probation early, in 2018. Interestingly, in October 2018, a
month later, Letham was arrested and was charged for a felony evasion, reckless endangerment,
and DUI. He is assigned to Judge Edwards. The case number is 181702364. Thus, the
foregoing homicide offense was committed while on bail pending a felony charge before Judge
Edwards. As such, and given his history of evasion from law enforcement in this case and in that
case, a no bail hold is requested; he is felony on felony, poses a risk of flight, and is a danger to
the community, having caused the death of another over something as trivial as someone else’s
