AFFIDAVIT OF WITNESS

I, VICTORIA NAKIBALITA, 37 years of age, married, and a resident of #0322,

Diamond St., San Ignacio Subd., Brgy. Pandan, Angeles City, after having sworn in
accordance with law, do hereby depose and say:

1. That I am a fruit vendor in Pampang Public Market;

2. That my fruit stand is located beside Victor Prutas’ fruit

stand;

3. That I was present and personally saw that the defendant,

Gloria Dimakabayad, frequented Victor’s fruit stand and
gets various fruits from him;

4. That she doesn’t pay the said fruits she gets from him and
promises to pay them when she has enough money
already;

5. That Victor lists down on his notebook the fruits and their
corresponding amount being owed by Gloria each time
she doesn’t pay;

6. That on August 13, 2018, just as Gloria Dimakabayad was

about to leave after acquiring another bunch of fruits,
Victor took notice of the total amount of money owed by
Gloria has already amounted to P10,018.00;
 7. That Victor ran after Gloria to tell her of the total amount
of money she owes him, and that she has to pay in a
week’s time;

8. That Gloria did not come back to the fruit stand since
then;

I executed this affidavit to attest the truthfulness of the foregoing facts and
to support the filing of Civil Case against Gloria Dimakabayad for Collection of Sums
of Money pursuant to A.M. No. 08-8-7-SC (The 2016 Revised Rules of Procedure for
Small Claims Cases)

AFFIANT FURTHER SAYETH NAUGHT.
