JUDICIAL AFFIDAVIT OF
EVA L. CASTRO

I, EVA L. CASTRO, of legal age, married, , a government psychologist,

and a resident of 876 Canlanipa Village, Surigao City after having been sworn to in
accordance with the law do hereby depose and state:

That Fiscal CARMIL WISHNIE B. PLATIL, a resident of P1-B Brgy. San

Juan, Surigao City, is the counsel who conducted and supervised my examination
as a witness at her office at Provincial Prosecutor’s Office, Surigao City;

That I am answering the questions herein fully conscious that I do so under

oath and that I may be criminally liable for false testimony or perjury;

That this Judicial Affidavit is executed to serve as my direct testimony in the

above captioned case:

That this Judicial Affidavit is being offered to prove:

A. That Eva L. Castro is an expert witness;

B. That the victim, Jade Flores Bartolome is mentally incapacitated;

C. That the Psychological Evaluation Report has been genuinely and

duly executed;

D. Other matters, facts, and circumstances relevant and material to the

case.

The following are the questions propounded by Fiscal Carmil Wishnie B.

Platil and my answers in English language:
Q1: Do you swear to tell the truth and nothing but the truth?
A1: Yes Ma’am.

Q2: Please state your name and other personal circumstances for the record.
A2: I am Eva L. Castro, of legal age, married, , a government psychologist, and a
resident of 876 Canlanipa Village, Surigao City.

Q3: What is your educational background?

A3: I finished BS Psychology.

Q4: From what school?

A4: Xavier University Ateneo de Cagayan.

Q5: What licensure exam have you taken, if any?

A5: Licensure Examination for Clinical Psychologist.

Q6: When did to take and pass the licensure exam?

A6: In the year 2000.

Q7: After that, did you have a formal training, if any?

A7: Yes. I was a Resident Physician at Capitol University Medical Center.

Q8: What year was that?

A8: From the year 2000 to 2005.

Q9: What further studies have you pursued after medical school, if any?
A9: I pursued a PhD in Ateneo De Manila University and passed the PhD Exam.

Q10: From what year?

A10: From 2005-2010.

Q11: After that?

A11: I worked at Caraga Regional Hospital.

Q12: When did you start working at Caraga Regional Hospital?

A12: I start working in Caraga Regional Hospital of Surigao City from the year
2010-2018.

Q13: As what?
A13: Still as a Clinical Psychologist.

Q14: How long have you been practicing your profession?

A14: For almost 19 years already.

Q15: Have you been qualified to testify as expert witness in the past?
A15: Yes ma’am.
Q16: Approximately how many times have you testified as an expert witness in a
rape case?
A16: More or less 70 cases ma’am.

Q17: Can you tell us what you do as a Clinical Psychologist? What are your
functions?
A17: I conduct a series of psychological examinations in cases of rape, annulment
of marriage, and the like. I also attend court hearings, if needed, for my
expert opinion.

Q18: Did you conduct a psychological evaluation involving one Jade Flores
Bartolome?
A18: Yes ma’am.

Q19: After your examination, what did you do?

A19: I made a report.

Q20: I am showing to you a document marked as Exhibit “E” during the Pretrial,
what is the relation of the document to the report you just mentioned?
A20: That is the same document.

Q21: At the bottom of this document, there appears to be a name, Eva L. Castro
with a signature over it. Is this your name and signature?
A21: Yes, Ma’am. That is my name and signature.

Q22: One of your findings state the examinee, Jade Bartolome’s mental age, is it
not?
A22: Yes ma’am.

Q23: Will you please tell us what does it mean?

A23: Mental retardation is a developmental disability that first appears in children
under the age of 18. It is defined as an intellectual functioning level, one
measured by standard intelligence quotient and significant limitations in
daily living functioning.

Q24: Could you tell the court what is your conclusion based on your findings?
A24 Based on the totality of the series of tests conducted, the examinee suffers
mental retardation. Jade is technically 20 years old but has a mental age of 7
years old.
