POLICE REPORT:

As per report and records of events available in the official police blotter of
this office there appears the following data to wit:

SUBJECT :Violation of Section 5 (b), Article III of RA 7610

DATE :July 10, 2018

Facts of the case:

PEARL DIAMOND E. GASADOR, 17 years old, minor, Filipino, and

resident of Brgy. Ungka Jaro, Iloilo City, appeared in this station together with her
mother ZARIAN LYN A. GASADOR, Filipino, and resident of Brgy. Ungka
Jaro, Iloilo City and reported that she was sexually abused by NOELITO P.
TONTORO.
1. On October 1, 2017, the accused started to show complainant amorous
attention to Pearl the complainant. He began courting her, called her
on the phone and paged her romantic messages at least thrice a day.
On October 25, 2017, when the complainant secured her class card in
Philosophy II at the start of the second semester, accused told her that
he gave her a final grade of 3.0. She protested, stating that her mid-
term grade was 1.0. Thereafter, the accused gave the complainant a
grade of 1.0, provided that she would agree with the condition that the
two of them would become lovers. The complainant immediately
agreed. On November 10, 2017, at around 7:00 p.m., the accused
asked the complainant to lie down in the backseat of his car, since she
was not feeling well at that time. The complainant was surprised when
he brought her to Queen’s Court Lodge on Mandurriao, Iloilo City.
Once inside the motel room, he kissed her at the back and neck,
touched her breasts and placed his hand inside her blouse. She resisted
his advances but he was too strong for her. He stopped only when she
got angry at him. On November 30, 2017, the accused again brought
the complainant to Queen’s Court Lodge. As soon as they were inside
the room, he took off his shirt and dragged her towards the bed, kissed
her lips, neck and breasts and unsnapped her brassiere. She struggled
to stop him but he overpowered her. He went on top of her, lowered
her pants and touched her private part. He tried to penetrate her but
she pushed him away forcefully and she sat up in bed. Upon her
refusal, the respondent threatened her that he will break up with her
 and will eventually stop seeing her. Pressured and afraid of his threat
to end their relationship, she hesitantly agreed. They had sexual
intercourse. Between the months of December 2017 until June 2018,
on different dates, the complainant and the accused continued to have
sexual intercourse. On June 10, 2018, the complainant ended her
relationship with the accused
2. The motive of incident is undetermined and the case still under
investigation.
