tradesmen engaged by Engineer-in-Charge in
executing work not forming part of the Contract, or

(vi) Non-availability of stores, which are the


responsibility of the Institute to supply or

(vii) Non-availability or break down of tools and


Plant to be supplied or supplied by the Institute or

(viii) Any other cause which, in the absolute


discretion of the Engineer-in-Charge is beyond the
Contractor’s control.

If the General Contractor's performance of the


Contract is delayed by a Force Majeure
occurrence, General Contractor shall immediately
provide to the Owner written
Notification of the delay and its estimated duration.

17. Arbitration Clause 17.2.2 Two arbitrators are to be

appointed by the said two arbitrators. Any
arbitration under the Contract shall be held in
Mumbai in State of Maharashtra, India.
The decision of the Arbitrators shall be final &
binding to the parties to this Contract and may be
confirmed and entered as a judgment in
any court of competent jurisdiction.
