SUPPLEMENTAL AFFIDAVIT

I, Virgilio L. Cardenio, of legal age, married, Filipino and a

resident of Brgy. Tampong, Sogod, Southern Leyte, after having
been duly sworn to an oath in accordance with law, hereby
depose and say:

1. That I am the accused in Crim. Case No. R-1531for

Homicide;

2. That I executed a counter-affidavit relative to this case

dated June 5, 2018;

3. That I wanted to correct and give a detailed narrations

of my statements in said counter-affidavit particularly
paragraph 6 and 7 as to the actual incident, to wit:

a. That on May 11, 2018 at around 6:00 PM, we just

finished putting the tables back inside the Brgy Hall
next to the basketball court of Brgy. Tampong. Right
after we organized everything, I went home. On my
way home, I met NOEL NAPALAN lingering and
holding a lumber about 2x2 and 3 feet long. He told
me, ‘You won’t even accept my payment, might as
 well finish you off! I will kill you!’ while running towards
me. I saw his face that he had a devilish expression
in his face determined to attack me (Gikan mi
nanghipos sa lamisa sa Brgy. Hall didto sa Basketball
Court sa Tampong. Pagkahuman namo og
panghipos padung ko uli sa amo bay og sa dihang
nag-atang si Noel Napalan nagdala bunal nga
kahoy nga 2x2 ang kadak-on og mga 3ft ang katas-
on. Ija ko giingnan nga “DI MAN DIAY KA PABAYAD,
MAJU PAY TIWASAN KA! PATYON KA!” samtang
nagdagan sija padung atake naho nga murag
gipanuwajan ang nawng nga determinado
buhaton ang ija gibanta);

b. That I ran away to avoid him and ran towards the

direction of my parent-in-law’s house. I saw a knife
on top of the table outside their house, which I
picked up in order to deter him from attacking me
but he continuously attacked me with the lumber
(Nidagan ko aron ahu ilikay ahu kaugalingon sa ija
gibanta naho padung sa bay sa ahu ugangan sa
dihang nakit-an naho ang kutsilyo sa gawas sa ila
bay nakabutang diha sa ibabaw sa lamesa. Ahu
gipunit ang kutsilyo aron mahadlok sija apan
padajon gihapon sija og atake naho gamit ang
kahoy nga 2x2( dos por dos) ang kadak-on);

c. That his lumber grazed my shoulder but my injuries

were not severe because I was trying all my best to
dodge my head from his blows. That was why when
 he was about to attack again, I stabbed him,
because it seemed that he had no plans to stop until
his plan to kill me be fulfilled, even if I already got a
knife (Naigo ko pero wa ko nagrabihi ky tapsing ra
man sa ahu abaga ang naigo kay ahu gipaniguro
og likay ahu ulo, mao to nga pag-utro nija og bunal
ahu na sija gidunggab ky mura mn wa sija plano
moatras bisan nakakuha na ko og kutsilyo);

d. That I only stabbed him once in the front of his body

in order to defend myself from his attack (Ahu sija
gidunggab kausa sa atubangan ija lawas aron ahu
depensahan ahu kaugalingon sa ija atake);

e. That after I stabbed him, he ran away from me

(Paghuman naho og dunggab nidagan sija palaju
naho);

f. That I went to the road, rode a pot-pot to the Police

Station to surrender bringing that knife with me
(Niadto ko sa kalsada nisakay ko dajon og pot-pot
padung sa police station aron mosurrender samtang
bitbit naho ang kutsilyo);

g. When I reached at the Police Station, Sir Richie

Felicilda and Chief Ryan Meriquita was there. Chief
Meriquita questioned me why I was there, and I told
them what happened that I have stabbed
somebody and surrendered them the bloody knife
(Pag-abot naho sa station didto si Sir Richie Felicilda
 og si Chief Ryan Meriquita unja gipangutana ko ni
chief nganong naa ko sa station mao to ahu gisulti
ang nahitabo nga nakadunggab ko og ahu gihatag
ang kutsilyo nga nagkadugo);

4. That I executed this affidavit in order to attest to the

truthfulness and veracity of the foregoing statements
and for whatever legal intents and purposes this may
serve best.
