AFFIDAVIT

I, WILFREDO BALUBAL, of legal age, married, Filipino, and a resident of Brgy.

Libag Sur, Tuguegarao City, Cagayan, after having sworn to in accordance with law, hereby
depose and state THAT;

1. I am the occupant/tiller of a portion of the property owned and was surveyed

for Francisca Talosig married to Mariano Baligod. Francisca Talosig and
Mariano Baligod are my parents-in-law. Said property is located at Libag Sur,
Tuguegarao City, Cagayan;
2. The above-mentioned property is adjacent to the property of the late Luis
Bangayan. Particularly, the portion which is being tenanted/tilled by Norma
Quilang and her family;
3. That I have been in actual possession of the above mentioned property as
early as 1970. Even before Norma Quilang became a tenant of the late Luis
Bangayan. In fact, I was present when the said property was surveyed in the
year 1977. A copy of the survey plan is hereto attached and marked as Annex
“A”;
4. As adjacent owner of the property of my parents-in-law, the late Luis
Bangayan were notified of the conduct of the above-mentioned survey and he
and his daughter, the late Gloria Bangayan were present when the same was
conducted. Hence, it is not true that we have encroached in the property of
Luis Bangayan;
5. In fact, during the lifetime of Luis Bangayan and even when he was succeeded
by her daughter, the late Gloria Bangayan, no dispute arose between us, the
occupants of the property of my mother-in-law and Luis Bangayan or Gloria
Bangayan regarding the property in question;
6. My sister-in-law and my brother-in-law were surprised when Xavier and the
surveyor entered the property of Francisca Talosig, my mother in law,
claiming that the same is part of the property of the late Luis Bangayan. It is
with our timely intervention that we were able to stop the conduct of the
survey;
7. I am freely and voluntarily executing this affidavit to attest to the truth and
veracity of the foregoing statements.

FURTHER AFFIANT SAYETH NAUGHT.
