QUESTION 1

a) Identify the person as stated in Section 1 of OSHA 1994 that this Act shall be applied to
and those exempted from.
(3 marks)

b) Section 3 of OSHA 1994 interprets that risk arising out of activities of persons at work
shall be treated based on three basic criteria or attributes. State the attributes that will
meet the conditions that recognize there are risks present in a workplace.

QUESTION 2

Distinguish the differences between these two groups of employers as defined under Section
3 of OSHA 1994.

a) Immediate Employer

QUESTION 3

List the conditions and steps for the registration of a Safety and Health Officer as explained
in Part II of OSH Safety and Health Officer Regulations 1997.

Describe how the employer should respond to the requirement of Regulation 16 and
Regulation 17 of the OSH (Safety and Health Committee) Regulations 1996 on the conduct
of employee complaints in terms of:

a) Investigation of the complaints.

QUESTION 5

a) Differentiate between the terms Ceiling Limit, Maximum Exposure Limit (MEL) and
Permissible Exposure Limit (PEL).
(6 marks)

b) Any employer under Regulation 9 of the Use and Standards of Exposure of Chemicals'
Hazardous to Health Regulations 2000 must have a written assessment of risk to health
created by hazardous chemicals in a work place. Spell out the important risk and health
aspect that should be included in the written assessment conducted by an assessor
before an employer starts any work related to the hazardous chemicals.

c) In conducting risk assessment, the aspect of control of hazards is considered very


important. List the hierarchy of prevention and control measures commonly used in
controlling risks as listed in Regulation 9 of the Use and Standards of Exposure of
Chemicals' Hazardous to Health Regulations 2000.

QUESTION 6

A report on Industrial Activity and Preparation of Emergency Plan for Major Hazard
Installation must be submitted by manufacturer to the DOSH Director General before
commencing the activity. Describe the information to be included in the industrial activity
report as listed in Schedule 6 of the OSH (Control of Industrial Major Accident Hazards)
Regulation 1996.
