AFFIDAVIT OF WITNESS

I, Ace B. Escalante, of legal age, single, Filipino, resident of Malini, Santiago

City, after having duly sworn to in accordance with law, do hereby depose
and state that:

1. I one of the farm caretakers of Complainant Jade A. Manuela

who is the actual occupant and tiller of a parcel of agricultural
land situated at Paraiso, Batal, Santiago City covered by TCT No.
T-787898;

2. It was around 8:00 AM on 22 November 2017, when I, together

with the Complainant and my fellow farm caretakers, while we
were spraying pesticides over the grown rice plants, Respondent
Cardo B. Tarun, together with several armed men arrived;

3. Tarun, who was also armed with a handgun, came near the
Complainant and showed a piece of paper allegedly a Certificate
of Title showing that the abovementioned parcel of land was
registered under his name;

4. As the Respondent showed the piece of paper to the

Complainant, he shouted the words “ Syak ti akin kukua atoy
nga daga isu pumanaw kayon!” and thereby forcing us to leave
the premises against our will.

5. As we refuse to leave the premises according to Tarun’s order,

he, together with his armed men pointed their gun towards us.
Fortunately, I managed to escape and was able to report the said
incident to the barangay officers;

6. Having realized that the matter has reached the law enforcement
officers, Respondent together with his armed men, immediately
left the premises of the above mentioned parcel of land.

7. That I am executing this affidavit to attest to the truthfulness of

the foregoing facts and to support the filing of Criminal Case
against Cardo B. Tarun for violations of Article 236 of the
Revised Penal Code of the Philippines.
