As regards to the vacancy, the Central Office on July 6, 2018 promulgated DILG Opinion No. 36 series 2018 wherein it discussed the manner how the.incomplete number of SK members should be filled-up as provided under the SK law. Accordingly, a special Katipunan ng Kabataan Assembly should be called by the Chairperson for purposes of filling-up the vacancy in the office of the Sangguniang Kabataan. We have attached a copy of the said legal opinion for your ready reference. As regards on the issue of “no appointed SK treasurer”, this Department level is of the considered view that the SK shall authorize their respective Barangay Treasurer to act as their temporary disbursing officer in order to prevent hiatus in the operation of the SK pending any guidelines on the matter from the Central Office. Section 8 (c) of the Implementing Rules and Regulations (IRR) of RA 10742 or the SK Reform Act of 2015 provides that the Sangguniang Kabataan shall promulgate resolutions necessary to carry out the objectives of the youth in the barangay in accordance with the “Matino, Mahusay at Maaasahan” DILG REGIONAL OFFICE XIADVISORY 2018-35 JULY 24, 2018 PAGE 2 OF 2 Comprehensive Barangay Youth Development Plan (CBYDP) and the applicable provisions of this IRR. In view of the foregoing, while it is true that the SK shall have financial independence in its operation, disbursement and encashment of their funds, income and expenditures, however, it would be logical and legally permissible for the SK to pass a resolution authorizing the concerned Barangay Treasurer to act as a temporary disbursing officer of the SK for the time being until the SK treasurer is duly appointed considering the latter is a bonded official whose duty and function primarily revolve on the financial matters of the barangay. The duly authorized Barangay Treasurer shall disburse SK funds in accordance to the approved annual budget and supplemental budget, as the case may be, of the Sangguniang kabataan.
