AFFIDAVIT OF DESISTANCE

I, MELINDA A. TUMICAD, Filipino, of legal age, married with office address at No. 74
LHC Square Building, 15th avenue corner Main avenue, Murphy, Cubao, Quezon City, after
having been duly sworn in accordance with the law, hereby deposes that:

1. I am the duly authorized representative of LAKPUE DRUG INC., and the

complainant in the case entitled Melinda Tumicad/Lakpue Drug, Inc. vs. Sarah
Jane N. Caban for qualified theft and docketed as NPS Docket No. VI-03-
INV16D-0405 that is pending before the Office of the City Prosecutor, Bacolod
City;

2. The above-stated case has been amicably settled by LAKPUE DRUG, INC. thru me,
and SARAH JANE N. CABAN for their common benefit and to put an end on their
disputes;

3. Thus, LAKPUE DRUG, INC., is no longer interested in pursuing the above-stated

case against SARAH JANE N. CABAN and it is also my intention, as well of
LAKPUE DRUG, INC., to desist from prosecuting the same;

4. I am voluntarily executing this Affidavit to attest to the truthfulness of the foregoing

facts and for the purpose of desisting from pursuing the above-stated case against
SARAH JANE N. CABAN;

5. I further request for the dismissal of the above-stated case with prejudice.
