Dear Mr. Reid: This letter is being written to inform that you are in violation of Town code-section 116.3 of Virginia Uniform Statewide Building Code effective date July 14, 2014 as itrelates to Cerificate of Occupancy requirements for your business license & operation of your premises for funeral home activity. You are also in violation of Business license requirements per Town Code -section 18-36(a), (b)(2).(b)(3) & (b}(4) for your licensure requirements to operate your business within town. You applied for a certificate of occupancy application on August 29, 2017 & a permit was issued on September 5, 2017 for general office use with specific note for "No services on site”. You were also informed by inspector Mr. John Dolan that there will be no activities related to funeral & related services at this location. During his inspection of premises there were no facliities for storage of dead bodies or related activities associated with such use e.g. embalming, viewing etc. We have been informed & confirmed by state investigator that embalming is being conducted & performed on regular basis per your customer needs by your business employees. Yesterday, inspector John Dolan conducted an inspection & plastic bags were discovered on property with embalming fluid(arterial fluid) and other evidence of this activity of which state inspectorhas informed the town. You have obtained this certificate of occupancy & business license based upon incorrect information & are carrying out repeated Violations of Virginia Uniform Statewide Building Code in effect at this time. Such use of this premises is also a violation of Town of Dumfries Zoning regulation. Therefore, you are hereby directed fo cease & desist from this type of use like funeral activities like body preparation, viewing & memorial services that is covered under funeral home use under town code. The business activities like caskets selections and sales, planning activities & related counseling/consultations are permitted under office use. If you fail to stop your operation that has funeral activity, then we will pursue all legal remedies provided under the law of Town of Dumfries code & Commonwealth of Virginia Code as applicable.
