UOBM PREFERRED PLATINUM CARD

TERMS & CONDITIONS

Effective 23 October 2018

General

These terms and conditions (“Terms and Conditions”) shall apply to United Overseas Bank (Malaysia) Bhd’s
(271809-K) (“UOBM”) UOB Preferred Platinum Card issued by UOBM to the Cardmember and are to be read
together with the UOBM VISA/MASTERCARD Cardmember Agreement (“Cardmember Agreement”)

For the avoidance of doubt, "Cardmember" shall mean both the principal and supplementary cardmembers.

Unless defined differently in these Terms and Conditions, words and expressions used in these Terms and
Conditions will have the same meaning as in the Cardmember Agreement.

UOBM reserves the right at its sole and absolute discretion at any time to decide on all matters pertaining to the
award or use of any or all of the benefits and privileges stated below and UOBM’s decision shall be final and
binding on the Cardmembers. The benefits and privileges described below may be amended, supplemented or
revoked by UOBM, with prior notice at any time at UOBM’s sole and absolute discretion.

UOBM Preferred Platinum Card Cash Back Programme (“Programme”)

UOBM Preferred Platinum Card (“Card”) comes with the feature of awarding up to 10% Cash Back on Utilities
Spend, Dining Spend and Online Checkout/Payment on all days (“Cash Back”).

1. The Utilities Spend shall refer to all transactions made directly to Maxis, Digi, Celcom, Astro, TM & TNB
(“Service Providers”) using the Card. Payment made via third party and authorized dealer is not eligible for
the Cash Back.

2. The Dining Spend shall include all dining spending made using the Card at participating dining merchants
under the following Merchant Category Codes (“MCC”):

For any Dining Spend which not classified under any of the MCC, such spending will not be eligible for the
Cash Back.

3. The Online Checkout/Payment is eligible to the following online merchants/apps:


a. Paypal
b. Lazada
c. Google
d. Itunes
e. Apple Store
f. Grab
4. Subject to Clause 10, Cash Back will be awarded for Utilities Spend, Dining Spend & Online
Checkout/Payment Spend for each calendar month subject to a minimum monthly Card spend of RM1,000
(“Qualifying Spend”) charged to the Card based on transaction date captured by UOBM’s system for the
particular calendar month.

5. Subject to Clause 9, the minimum Qualifying Spend is inclusive of the collective spend of both principal and
supplementary Cardmember charged to the Card based on transaction date captured by UOBM’s system
for the particular calendar month. For the avoidance of doubt, only the principal Cardmember is entitled to
the Cash Back.

6. The total Cash Back awarded for Utilities Spend, Dining Spend & Online Checkout/Payment Spend category
for both principal and supplementary Card combined is capped based on the following Qualifying Spend in
each calendar month:

For newly approved Card, the Qualifying Spend requirement must be fulfilled within the first calendar
month. In the event that the qualifying period is less than one month, the Qualifying Spend requirement
still applies.

7. For the avoidance of doubt, the Cash Back amount will be rounded to the nearest cent.

8. The determination of monthly Cash Back earned and/or to be credited is at UOBM’s discretion and shall be
reviewed from time to time. UOBM may amend and/or vary the required minimum Qualifying Spend at
UOBM’s sole discretion, with prior notice.

9. Any accumulated Cash Back including Cash Back pending credit into the Cardmember’s Card account shall
immediately cease to be valid upon the occurrence of any one of the following:
a. Any cancellation of the Card;
b. Any conversion of the Card to any other UOBM Credit Cards;
c. The Card Account becomes delinquent, terminated or suspended for whatever reason;
d. The Cardmember breaches any of these terms and conditions or the terms and conditions in the
Cardmember Agreement;
e. The Cardmember passed away or commits an act of bankruptcy or allows a judgment to remain against
him / her for more than twenty one (21) days;
f. The financial position of the Cardmember is or has become unsound and UOBM is of the view that the
Cardmember’s ability to fulfill these terms and conditions or the terms and conditions in the
Cardmembers Agreement is or has become impaired; or
g. The Card is terminated by UOBM for whatever reason.

Exclusions

10. The following transactions shall not be treated as Qualifying Spend:


a. Balance Transfer;
b. Cash Advance;
c. Flexi-Credit Plans;
d. Easi Payment Plan purchases;
e. 0% Interest Instalment Payment Plans;
f. Refunded, disputed, unauthorized or fraudulent retail transactions;
g. Top-up transactions;
h. Payment of annual card membership fees, interest payments, late payment fees, charges for cash
withdrawals, goods and services tax and any other form of service / miscellaneous fees using the Card;
and
i. Such other transactions as UOBM may determine from time to time.

11. Without prejudice to the generality of the foregoing, in the event that the Cash Back under this Programme
is awarded to and received by person(s) who has committed or is suspected of committing any fraudulent
or wrongful acts in relation to the use of the Card and/or any transaction using the Card, UOBM reserves
the right to disqualify such person(s) from earning or using the Cash Back.

Allocation of Cash Back

12. The total Cash Back payout is RM 148,000 per month throughout the Programme Period which will be
awarded on a first come, first serve basis. UOBM does not have any obligation to inform the Cardmembers
should the Cash Back payout reach the maximum payout limit.

13. The crediting of the Cash Back will be reflected in the Cardmembers’ monthly Statement of Account within
two (2) months from the month that the Qualifying Spend was made as shown in Table A below:

14. At the time of crediting of the Cash Back, the Cardmember’s Card account(s) must be current, valid,
subsisting and in good credit standing as may be determined by UOBM at its sole and absolute discretion
and not in breach of these terms and conditions and the UOB Visa/MasterCard Cardmember Agreement
(“Cardmember Agreement”).

15. The Qualifying Spend under this Programme shall not be entitled to earn UNIRinggit under the UNIRinggit
Rewards Programme.
16. UOBM reserves the right to forfeit the Cash Back in the event where there is a reversal of UtilitiesSpend,
Dining Spend & Card on File Spend, cancellation or termination of the Cardmembers’ Card during the
Programme Period or non-compliance or breach of these terms and conditions or the Cardmember
Agreement with prior notice without assigning any reason.

17. The Cash Back awarded is non-transferable to any other party and is not exchangeable for cash or other
goods, whether in whole or in part.

UOBM 0% 3 MONTHS OVERSEAS EPP CAMPAIGN

United Overseas Bank (Malaysia) Bhd (271809-K) (“UOBM”) is organizing a “UOBM 0% 3 Months Overseas EPP
Campaign” (“Campaign”) from 1 January 2018 to 31 December 2018 (both dates inclusive) or such other dates
as may be determined by UOBM from time to time (“Campaign Period”).

Campaign Eligibility

18. This Campaign is open to all principal UOBM Credit Cardmembers (“Cardmembers”) and:
a. whose account(s) are current, valid, subsisting and in good credit standing as may be determined by
UOBM at its sole and absolute discretion; and
b. who are not in breach of the UOBM Visa/MasterCard Cardmember Agreement (“Cardmember
Agreement”).

19. The following persons shall not be eligible for the Campaign:
a. All UOBM Debit, Corporate, Purchasing and Private Label Cardmembers;
b. Cardmembers whose account(s) are terminated, suspended or cancelled within the Campaign Period;
c. Any accounts held with UOBM that are delinquent or unsatisfactorily conducted as determined by
UOBM at its sole and absolute discretion; and
d. Persons who are or become insane, deceased, adjudicated bankrupt or have legal proceedings of any
nature instituted against them.

Campaign Mechanics

20. Any spend of at least Ringgit Malaysia Three Thousand (RM3,000.00) per single and/or accumulated
receipt(s) made during the Campaign Period using UOBM Credit Card in any foreign currency (“Eligible
Spend”) will be eligible to participate in the Campaign. The following transactions shall not be treated as an
Eligible Spend:
a. Cash Advance;
b. Balance Transfer;
c. Flexi-Credit Plans;
d. Finance Charges;
e. Late Charges;
f. Annual Fees;
g. Split and/or void transactions;
h. Reversals or refunds;
i. Goods and Services Tax; and
j. Such other transactions as UOBM may determine.
21. The Eligible Spend made during the Campaign Period must be captured by the credit card system
maintained by UOBM in order to be eligible for participation in the Campaign.

22. Cardmembers who satisfy the Eligible Spend criteria as set out in Clause 20 above is eligible to convert the
Eligible Spend to 3 months’ Easi Payment Plan with 0% upfront interest (“EPP”).

23. Cardmembers can apply for the EPP within sixty (60) days from the date of the Eligible Spend or by 31
December 2018, whichever is earlier, by calling UOBM Call Centre at 03-26128121 (“UOBM Call Centre”).

24. An Eligible Spend is qualified for EPP if such transaction:


a. has been debited to the UOBM Credit Card account; and
b. has been recorded in the current Statement of Account forming part of the current outstanding balance
due; and
c. has not passed its payment due date at the time of the application.

25. UOBM can, at its absolute discretion, approve or reject any application for EPP by the Cardmembers
without giving any reason for the decision, and/or determine the amount allowed under the EPP, which will
subject, amongst others, to:
a) the status of the Cardmember’s UOBM Credit Card account; and
b) the available credit limit of such UOBM Credit Card (“Credit Limit”).

26. Upon approval of the application for the EPP, the corresponding amount of the Cardmember’s Credit Limit
will be reserved for this purpose, and the available Credit Limit balance will be reduced accordingly. UOBM
will not be liable to the Cardmembers for any transactions rejected by any merchants resulting from the
insufficiency of the Cardmember’s Credit Limit.

27. In relation to the EPP that has been approved, no further interest amount will be charged if the monthly
instalment amount is paid in full before the payment due date as stated in the Statement of Account. If not,
the applicable fees and charges based on Cardmember Agreement will be charged on the outstanding
amount accordingly.

28. During the repayment period, the amount will be repaid by way of equal instalments (“the Payment
Instalment”). The Payment Instalment will be debited immediately to the UOBM Credit Card account
following the approval of the EPP application, and will be reflected in the following month’s Statement of
Account subsequent to the approval from UOBM, and payable in accordance with the Cardmember
Agreement. As each Payment Instalment is repaid, the amount equivalent to the payment made will be
restored to the Cardmember’s credit limit.

29. The Payment Instalment is calculated based on the sum of the amount converted to be divided by the
number of months of the EPP tenure, which is three (3) months. In the event of a default, the entire
amount will be payable immediately in accordance with the Cardmember Agreement.

30. The Payment Instalment is included in the computation of the Cardmember’s minimum payment due. If the
Payment Instalment is not paid in full when due, the unpaid balance of the Payment Instalment will attract
interest in accordance with the Cardmember Agreement.

31. The Cardmember can cancel its participation in the Campaign subject to UOBM’s receipt of a written notice
or verbally communicated to UOBM’s Call Centre and a cancellation fee of RM50 (or such other rate as
determined by UOBM at its absolute discretion). Such amount shall be debited to the Cardmember’s UOBM
Credit Card account.

32. The Cardmember can apply for the EPP more than once, subject to the Cardmember’s eligibility under the
terms and conditions in this document and at UOBM’s absolute discretion to approve.

33. If any or a combination of the following occurs, the total outstanding under the EPP will immediately be
due and payable, will bear the applicable finance and/or late payment charges (whichever applicable) as
per Cardmember Agreement, and will be payable in accordance with the Cardmember Agreement:
a. there is a breach of these terms and conditions;
b. an event of default occurs pursuant to the Cardmember Agreement;
c. there is a delay or failure to pay the Payment Instalment or any sum due under the EPP;
d. there is a failure to pay any money due and payable to UOBM under any banking/credit facilities;
e. there is failure to discharge any obligation or liability owing to UOBM from time to time for any
banking/credit facilities;
f. the Campaign is terminated for any reasons whatsoever;
g. the UOBM Credit Card is terminated or the UOBM Credit Card account is closed for any reason
whatsoever prior to full settlement of all amount owing to UOBM under the UOBM Credit Card or
h. it becomes impossible or unlawful for UOBM to make available or continue to make available the EPP.

The events above will also entitle UOBM to cancel, revoke, suspend or restrict the use of the UOBM Credit Card
and to consolidate all outstanding amounts into the principal UOBM Credit Card account (if applicable).

UOBM SMART$ Rebate Programme

34. The Cardmembers are entitled to earn SMART$ on purchases made with the Card at any SMART$ merchant
outlets via UOBM terminals at the rate determined between UOBM and the SMART$ merchant. The
Cardmembers’ eligibility to participate in the UOBM SMART$ Rebate Programme is subject to and shall be in
accordance with the SMART$ Rebate Programme Terms and Conditions. For the avoidance of doubt, all
references to the value of any given transaction with the Card shall be deemed to be a reference to the final
amount charged to the Card taking into account the redemption of SMART$ (if any) under the UOBM
SMART$ Rebate Programme.

General Terms and Conditions

35. By participating in the Programme and/or Campaign, the Cardmembers agree to be bound by the terms and
conditions of the respective Programme and/or Campaign, the UOBM SMART$ Rebate Programme terms
and conditions and the Cardmember Agreement. In there is any inconsistency between these terms and
conditions, the UOBM SMART$ Rebate Programme terms and conditions and the Cardmember Agreement,
the terms and conditions of the respective Programme and/or Campaign shall prevail.

36. UOBM shall not be responsible nor shall accept any liabilities of any nature and however arising or suffered
by the Cardmembers resulting directly or indirectly by the Cardmembers’ participation in the respective
Programme and/or Campaign unless it arises from UOBM’s negligence or wilful misconduct specifically
related to the respective Programme and/or Campaign
37. If there is any inconsistency between the terms and conditions of the the respective Programme and/or
Campaign and the Cardmember Agreement, these terms and conditions shall prevail for all matters in
connection with the respective Programme and/or Campaign.

38. UOBM's decision on all matters relating to the respective Programme and/or Campaign shall be final,
conclusive and binding upon all Cardmembers. No appeals and/or correspondence from any Cardmember
or any third party will be entertained.

39. UOBM shall not be responsible for any failure or delay in transmission of sales transactions by merchant
establishments, postal or telecommunication authorities or any party which may result in the Cardmembers
failing to be entitled to the Cash Back and the EPP under the respective Programme and/or Campaign.

40. UOBM reserves the right to add, delete, suspend and/or vary these terms and conditions, from time to
time, wholly or in part, at its absolute discretion, by providing twenty one (21) days’ prior notice to the
Cardmembers via posting on UOBM’s website, displaying a notice at any of UOBM’s branches, a statement
insert in the Statement of Account or any other manner as determined by UOBM from time to time.

41. UOBM reserves the right at its absolute discretion to cancel, terminate or suspend the respective
Programme and/or Campaign in whole or in part, at any time with prior notice. For the avoidance of doubt,
cancellation, termination or suspension by UOBM of the respective Programme and/or Campaign shall not
entitle the Cardmember to any claim or compensation against UOBM for any and all losses or damages
suffered or incurred by the Cardmember whether as a direct or indirect result of such cancellation,
termination or suspension.

42. These terms and conditions shall be governed by and construed in accordance with the laws of Malaysia
and the Cardmembers agree to submit to the non-exclusive juriasdiction of the courts of Malaysia.
