Nevada is in the Ninth Circuit Court of Appeals, along with the states and

territories of Alaska, Arizona, California, Guam, Hawaii, Idaho, Montana,

Northern Marina Islands, Oregon, and Washington. Article 11 of the Nevada

Constitution is about Education and includes 10 different sections.

Section One reads “Legislature to encourage education; appointment, term

and duties of superintendent of public instruction” (Nev. Const. Art. XI, Sec. I).

This section’s purpose is to ensure education is promoted by legislature and

accounted for by all means, as well as provides the education system with a

superintendent. This section also aims to promote the improvement of many

cultural aspects such as scientific, literary, and agricultural sects.

Section Two is for a “Uniform system of common schools” (Nev. Const.

Art XI, Sec. II). The goal of this section is to ensure a uniform and fair playing

field for all students. It also aims to ensure attendance laws are in place for

students. This section also states that schools must be established and maintained

at least 6 months out of the year.

Section Three is the “Pledge of certain property and money, escheated

estates and fines collected under penal laws for educational purposes;

apportionment and use of interest” (Nev. Const. Art. XI, Sec. III). Any funds

collected that go to the state must go to educational purposes, and may also be

appropriated to universities.

Section Four seems to have two parts, one being the “Establishment of

state university; control by board of regents” (Nev. Const. Art. XI, Sec IV). This

section states that legislature should establish a state university, embracing

departments of Agriculture Mechanic Arts, and Mining which are to be controlled

by a Board of Regents. The next Section is the “Establishment of State

University; Legislature to provide by law for governance, control and

management of State University and protection of academic freedom” (Nev.

Const. Art XI, Sec IV). Essentially, part two is reaffirming that legislature is

responsible for providing law and control of the State University and protects

academic protection for students enrolled and instructors in reference to the

encouragement of education outlined in Section 1.

Section 5 is the “Establishment of normal schools and grades of schools;

oath of teachers and professors” (Nev. Const. Art. XI, Sec. V). This section

essentially allows Legislature to establish different grade levels of schooling from

the primary department up to the University level. It also requires professors and

teachers to subscribe to the oath in Article 15.

Section 6 is quite thorough, and is the “Support of university of common

schools by direct legislative appropriation; priority of appropriations” (Nev.

Const. Art. XI, Sec. VI). It seems this article outlays the means of legislative

funding for public education in Nevada grades kindergarten-12.

Section 7 is about the Board of Regents and their election and duties (Nev.

Const. Art. XI, Sec. VII). It states that “The Governor, Secretary of State, and

Superintendent of Public Instruction, shall for the first four years and until their

successors are elected and qualified constitute a Board of Regents to control and

manage the affairs of the University and the funds of the same under such

regulations may be provided by law. But the Legislature shall at its regular

session next preceding the expiration of the term of office of said Board of

Regents provide for the election of a new board of Regents and define their

duties”. This provides clear guidelines for a cycling of board members. I am in

favor of having new board members consistently elected to keep fresh ideas

coming in and this helps avoid corruption.

Section 8 includes two parts, the first being “Immediate organization and

maintenance of state university” (Nev. Const. Art. XI, Sec. VIII). This section

puts the control and maintenance of the Mining department at first priority in

receiving their funds, and the rest going to the Agriculture, Mechanic Arts, and

Military tactics into a separate fund. Part two of Section 8 is the “Use of proceeds

from public lands donated by Act of Congress for benefit of certain departments

of State University” (Nev. Const. Art. XI, Sec VIII). This section simply

reinforces the importance of the funds being properly allocated, and also

coincides with Section 4.

Section 9 is extremely important, “Sectarian instruction prohibited in

common schools and university” (Nev. Const. Art XI, Sec. IX). It simply reads

“No sectarian instruction shall be imparted or tolerated in any school or

University that may be established under this Constitution”. This is crucial to a

well-functioning education system in that it prevents bigotry and separation from

occurring in the classroom. Section 10 expands upon this by prohibiting public

money from being used for sectarian purposes. (Nev. Const. Art. XI, Sec X).
