TO BE USED WHEN REQUESTING PUBLIC RECORDS FROM A LAW ENFORCEMENT AGENCY

Under the Arkansas Freedom of Information Act 25-19-101 et seq., I am requesting an opportunity to
inspect or obtain copies of public records regarding:

1. LIST RECORDS YOUR ARE SEEKING HERE

2. Etc.
3. Etc.

Under 25-19-105 (e) If a public record is in active use or storage and therefore not available at the time a
citizen asks to examine it, the custodian shall certify this fact in writing to the applicant and set a date
and hour within three (3) working days at which time the record will be available for the exercise of the
right given by this chapter.

I am requesting that the information requested be supplied to me in electronic form and sent via email
to YOUR EMAIL ADDRESS HERE

Please note that A.CA. 25-19-105(f)(1) states no request to inspect, copy, or obtain copies of public
records shall be denied on the ground that information exempt from disclosure is commingled with
nonexempt information. AND (f)(4) states that If it is necessary to separate exempt from nonexempt
information in order to permit a citizen to inspect, copy, or obtain copies of public records, the
custodian shall bear the cost of the separation.

Also reference Arkansas Attorney General’s Opinion No. 2010-140 regarding a state agency must bear
the cost associated with redactions no matter the size or amount of documents involved. And this
matter is also addressed in Watkins, J., et al., "The Arkansas Freedom of Information Act" (6th ed.), at p.
303, "Moreover, the custodian must bear any cost arising from segregation of exempt and nonexempt
information.”

As adjudicated in Hengel v. City of Pine Bluff, 821 S.W.2d 761 (1991) 307 Ark. 457, The Arkansas FOIA
provides that public records are to be open to inspection "during regular business hours of the custodian
of the records." The Pine Bluff Police Department operates twenty-four hours a day, seven days a week.
When the nature of an agency of the public of necessity operates twenty-four hours a day, it follows in
the absence of some showing to the contrary that those are its "regular business hours." That being so,
its records must be available for reasonable inspection at all times during those hours of operation.

If you deny any or all of this request, please cite each specific exemption you feel justifies the refusal to
release the information.

OPTIONAL: Please use my reference number 2018-000 when referring to this request.
