SUPPLEMENTAL MEMORANDUM OF AGREEMENT

KNOW ALL MEN BY THESE PRESENTS:

This Supplemental Agreement is made and entered into by and between:

The DEPARTMENT AND SOCIAL WELFARE AND DEVELOPMENT (DSWD) Field

Office VIII, a national government agency with principal office address at Magsaysay
Boulevard, Tacloban City, herein represented by its Regional Director, RESTITUTO B.
MACUTO, herein referred to as the “DSWD”.

-AND-

The LOCAL GOVERNMENT UNIT OF HINUNANGAN (LGU HINUNANGAN), with

office address at Barangay Labrador, Hinunangan, Southern Leyte herein represented by
Municipal Mayor Engr. Reynaldo C. Fernandez, herein referred to as the “LGU”.

WITNESSETH, That:

WHEREAS, the DEPARTMENT AND SOCIAL WELFARE AND DEVELOPMENT

(DSWD) and LOCAL GOVERNMENT UNIT OF HINUNANGAN (LGU) entered into a
Memorandum of Agreement for the transfer of Protective Services Program (PSP) funds
to LGU for the Construction of Senior Citizens Center which was executed last August 31,
2017 and notarized by Notary Public Atty. Edwin Y. Chua last August 31, 2017 indexed as
Doc. No. 163 Page No. 23 Book No. 237 Series of 2017;

WHEREAS, by virtue of the said MOA, the DSWD will transfer a total amount of
One Million Pesos (P 1,000,000.00) to the LGU in the following tranches:
a. 50% upon approval and signing of the MOA;
b. 40% after submission of the liquidation report for the first tranche
representing 50% of the total project cost;
c. 10% upon submission of the liquidation report for the second tranche
representing 40% of the total project cost and/or upon completion of the
project

WHEREAS, the DSWD transferred to LGU Hinunangan thru the Municipal

Treasurer the first tranche last July 24, 2018 amounting to Five Hundred Thousand Pesos
(Php500,000.00) thru Landbank Check Number 541459 dated July 9, 2018;

 WHEREAS, the said MOA provided in Paragraph E. Effectivity of this Agreement
DSWD that said MOA shall stake effect upon signing of the parties and shall terminate
on the 31st of December 2017..;

WHEREAS, the DSWD and LGU deemed it NECESSARY and APPROPRIATE to

SUPPLEMENT and AMEND the said terminated MOA to ensure the completion of the
SENIOR CITIZENS CENTER in HINUNANGAN for the BENEFIT of the senior citizens in the
Municipality;

NOW, THEREFORE, for and in consideration of the foregoing premises the DSWD
and LGU hereto have agreed to the following:

Section 1: Purpose

The MoA is executed for the construction of Senior Citizens Center at

Hinunangan, Southern Leyte with a Project Cost of One Million Nine Hundred Ninety
Thousand Four Hundred Seventy Three and 52/100 (Php1,990,472.52) with the approved
Project Proposal incorporated as an integral part of this MOA attached as Annex “B”;

Section 2. Areas of Responsibility

1. For the DSWD
a. Transfer Five Hundred Thousand Pesos (Php500,000.00) in one tranche to
LGU in accordance with existing COA rules and regulations. [The said
amount is the remaining amount of DSWD commitment to transfer to LGU a
total of One Million Pesos (Php1,000,000.00)];

2. For the LGU

a. Allocate, provide/disburse the LGU Counterpart of Nine Hundred Ninety
Thousand Four Hundred seventy two and 52/100 pesos (Php990,472.52);
b. Receive in accordance with existing accounting and COA rules and
regulations;
c. Utilize the said amount according to the purpose of this Agreement and in
accordance with existing accounting and COA rules and regulations;
d. Submit to DSWD any unused funds or savings generated within 30 days
after the project completion and the report of utilization of funds in
accordance to existing accounting and COA rules and regulations;
e. Submit to DSWD within 30 days after project completion the FINAL
LIQUIDATION REPORT duly certified by the Municipal Accountant,
approved by the Local Chief Executive, acknowledged and received by the
Auditor of the LGU.

Section 3. This Supplemental Memorandum of Agreement shall SUPPLEMENT and
AMEND the MOA between DSWD and LGU executed last August 31, 2017.

Section 4. Penal Clause

Any violations of this MOA shall be referred to amicably resolved by the

Parties, however, in case of gross violations tantamount to gross and grave
misconduct will be referred to the appropriate administrative, quasi-judicial or judicial
body.

Section 5. Amendments to the Supplemental Memorandum of Agreement

This Supplemental Memorandum of Agreement may only be modified with the

express prior written consent and mutual agreement by the Contracting Parties.

Section 6. Effectivity and Termination

This Supplemental Memorandum of Agreement shall take effect immediately upon

signing by the Contracting Parties.

This Supplemental Memorandum of Agreement shall be terminated upon execution

of an Exit MOA between DSWD and LGU.
