AFFIDAVIT OF WITNESS

I, BERNIE SUAZO, 55 years old, married and a resident of Zone-5,

Linanot, Bunawan, Iligan City, after being sworn to in accordance with
law, hereby depose and say, that:

1. I was born in Linanot in 1963 and my parents had been residing

therein since early 1950’s. Since childhood, I have known
Leonora Balsamo-Dayot (Leonora, for brevity) and her family
being our neighbours for the longest time;

2. I can attest to the fact that Lorenzo Balsamo, the father of

Leonora, had been in actual possession of the properties and
had been tilling and cultivating the land. When I was younger,
there were times when I pass by their property (Lot No. 5145
Cad. 292) and see Jimmy Balsamo, the slain brother of Leonora,
harvest some of the fruits therein. I have also seen Jimmy
actually staying on the small residential house or “payag” built
on the land;

3. In the late 1980’s, I have heard that the whole properties of the
Balsamo family is approximately 24 hectares which were
partitioned among the children of Lorenzo. But rumors were
spreading in our community that some members of the Balsamo
family were killed inside their properties by reason of land
conflicts;

4. Just recently, I was able to visit again the above-mentioned

property and saw the trees planted thereon by the Balsamo
family but the small house of Jimmy was no longer there.
According to some of our neighbours, the said house was also
burnt to ashes when he was killed; and

5. This Affidavit is made voluntarily and executed to attest to the

truth of the foregoing statement and in support of the
application of Leonora Balsamo-Dayot for free patent on Lot
No. 5145 Cad. 292.

I, CHIQUITO COMINGUEZ, 52 years old, married and a resident of

Zone-5, Linanot, Bunawan, Iligan City, after being sworn to in accordance
with law, hereby depose and say, that:

1. I was born in 1965 in Linanot, where my mother was also born in

1946. Since childhood, I have known Leonora Balsamo-Dayot
(Leonora, for brevity) and her family being our neighbours since
the very beginning;

2. I also know Lorenzo Balsamo, the father of Leonora, because he

used to hire me to help him plant trees. He agreed to pay me
Php5.00 per tree sown and planted on his vast area. Also, my
mother is the caretaker of the Balsamo’s properties since I was a
child;

3. In 1996, my family and I flew to Cebu because Lorenzo, the

owner of the properties I used to cultivate, and his son, Jimmy,
was killed by unidentified persons. The following year, we went
back to Linanot and continued living there up to now;

4. I can attest to the fact that Lorenzo Balsamo and his family had
been in actual possession of the properties and had been
cultivating the land, including Lot No. 5145 Cad. 292. I was
actually able to plant trees thereon, upon the instructions of
Lorenzo;

5. In truth and in fact, the afore-mentioned lot (Lot 5145 Cad. 292)
was occupied by Jimmy, the slain brother of Leonora. I have
also seen him planting trees thereon, with my help; and

6. This Affidavit is made voluntarily and executed to attest to the

truth of the foregoing statement and in support of the
application of Leonora Balsamo-Dayot for free patent on Lot
No. 5145 Cad. 292.
