a. Axi Dent is a legitimate child following Article 179, in relation to Articles 177 and 178 of the
Family Code. Legitimated child is considered legitimate if the same is born outside wedlock
to parents without legal impediment to marry that thereafter entered a valid marriage.

b. Kho Inzy Dent is a legitimate child. Children conceived or born during the marriage of the
parents are legitimate, Article 164 of the Family Code.

c. Anak is a legitimate child. Children conceived or born during the marriage of the parents are
legitimate, Article 164 of the Family Code.

2. The marriage is void. Laws relating to family rights and duties, or to the status, condition and
legal capacity of persons are binding upon citizens of the Philippines, even though living abroad,
Article 15 of the New Civil Code. Only man and woman are allowed to marry each other, Article
147 of the Family Code. Corollary, same sex marriage is void.

3. The marriage is void. Vick is a Filipino citizen as of the time of the marriage. Laws relating to
family rights and duties, or to the status, condition and legal capacity of persons are binding
upon citizens of the Philippines, even though living abroad, Article 15 of the New Civil Code.
Only man and woman are allowed to marry each other, Article 147 of the Family Code. Corollary
thereto, same sex marriage is void.

4. The marriage is valid, provided the national law of Vick vests him full legal marital capacity.

5. The family home is a community property. The community property shall consist of all the
property owned by the spouses at the time of the celebration of the marriage or acquired
thereafter, Article 91 of the Family Code.

6. JoeVick Enterprises has no legal personality as Philippine laws prohibit, as a rule, foreign
ownership in practice of all professions.

7. The contention of the heirs of Pinoy is meritorious. In civil cases, the trial court acquires
jurisdiction over the person of the defendant either by the service of summons or by the latter’s
voluntary appearance and submission to the authority of the former (Oaminal v. Castillo, 459
Phil. 542). Wherefore, the prescription set in Philippine laws shall prevail.

8. The institution of heirs is void, the rule on intestacy shall, therefore, govern. The other children
shall receive their respective legitime. Legitime is that part of the testator’s property which he
cannot dispose of because the law has reserved it for certain heirs who are, therefore, called
compulsory heirs, Article 886 of the New Civil Code.
