8 IDENTIFICATION SYSTEM IN ALL THE BARANGAYS IN
9 BUTUAN CITY, AND FOR OTHER PURPOSES

15 EXPLANATORY NOTE

17 WHEREAS, Section 16 of Republic Act No. 7160, also known as the Local
18 Government Code of 1991, provides:
19
20 “Every local government unit shall exercise the powers expressly
21 granted, those necessarily implied therefrom, as well as powers
22 necessary, appropriate, or incidental for its efficient and effective
23 governance, and those which are essential to the promotion of the
24 general welfare.”

26 WHEREAS, the institutionalization of the Barangay Identification System
27 will improve the delivery of basic services in the Barangay, making it faster, more
28 efficient, and more convenient on the part of the residents, and will contribute to the
29 maintenance of peace and order;

31 WHEREAS, the Barangay Identification System will enable the Barangay to
32 establish a Barangay Information System, the entries of which can be used by the
33 Barangay Council in crafting policies, programs, and projects to advance the welfare
34 of the residents;

36 WHEREAS, the said identification system will hasten and simplify the
37 processing and release of other Barangay documents, such as Barangay Clearance,
38 Certifications, and the like, as the information of all the inhabitants in the Barangay
39 are already available in the information system;

41 WHEREAS, the Barangay Identification Card will be of great help to those
42 who do not possess any valid identification cards, since the same shall be recognized
43 and accepted in all public and private offices within the city of Butuan.

45 BE IT ENACTED by the Sangguniang Panlungsod of Butuan in session
46 assembled and by authority of the same that:

48 Section 1. Title - This Ordinance shall be known as the “BARANGAY ID
49 SYSTEM ORDINANCE.”

51 Section 2. Scope and Definition – The Barangay Identification System shall cover
52 all residents (permanent and/or transient) of the Barangay. For the purpose of this
53 Ordinance, a resident shall refer to an actual inhabitant in the Barangay, 15 years of
54 age and above, who has resided in the Barangay for a period of 6 months prior to the
55 application, as certified by the Purok President in a Purok Certification.

57 Section 3. Coverage – All residents, 18 years of age and above, are required to
58 secure a Barangay ID Card. However, in the case of residents under 18 years of age
59 but not less than 15, the application for a Barangay ID Card shall be voluntary.

61 Section 4. Proof of Residency – A resident applying for a Barangay Identification
62 Card must submit a proof of residency to the Purok President, e.g. any valid ID,
63 utility bill, proof of lease, pay slip, etc., before the latter issues a Purok Certification.

65 Section 5. Imposition of Additional Requirement – The Barangay may, by
66 ordinance, impose additional requirements for the issuance of a Barangay ID Card.

68 Section 6. One Barangay ID Card Policy – Every individual shall possess only one
69 Barangay Identification Card.

71 Section 7. Issuance of a Barangay Identification Card – All residents of the
72 Barangay, as certified by the President of the Purok where they live, shall be issued
73 a Barangay Identification Card. The Punong Barangay, as the validating officer,
74 shall be the signatory of the ID Card.

76 Section 8. Process – Prior to the issuance of the Barangay Identification Card, the
77 applicant shall fill out a form and submit to the Barangay a Purok Clearance issued
78 by the Purok President. The Barangay shall process the application and issue the
79 applicant’s Barangay ID Card within a period to be determined by the Barangay.

81 Section 9. Validity – A Barangay Identification Card issued by every Barangay in
82 in the city shall be recognized and accepted in all offices, public and private, within

83 the jurisdiction of Butuan City. The same shall be valid for a period of one year from
84 the date of issuance.

86 Section 10. Fee – The Barangay may, by ordinance, impose a reasonable fee for the
87 issuance of the Barangay Identification Card.

89 Section 11. Information to be contained in the Barangay Identification Card –
90 The Barangay Identification Card shall contain the following information:

92 1. Logo and Name of the City
93 2. Logo and Name of the Barangay
94 3. Full Name of the ID Bearer
95 4. Photo of the ID Bearer
96 5. Citizenship
97 6. Sex
98 7. Blood Type
99 8. Address of the ID Bearer
100 9. Date of Birth of the ID Bearer
101 10.Contact Person in case of emergency
102 11.Mother
103 12.Father
104 13.Number of Children
105 14.Voter’s ID Number
106 15.Date of Issuance and Period of Validity
107 16.Unique Identification Number
108 17.Signature of the Bearer

111 Section 12. Prescribed Information Sheet1 – There shall be a prescribed
112 information sheet, which shall be used by all Barangays for the Barangay
113 Identification/Information System. The said information sheet shall contain all the
114 information enumerated in the preceding section, and shall be subscribed. An
115 applicant who provides any false entry in the information sheet shall be held
116 criminally liable under existing laws.

118 Section 13. Prescribed Size and Format of ID Card2 – The size of the Barangay
119 Identification Card shall be 3.37 inches by 2.127 inches. There shall be a prescribed
120 format for the Barangay ID Card, which shall be used by all Barangays; but the latter
121 can make any modification as regards the design, e.g. background, of the card.

123 Section 14. Barangay Information System – A Barangay Information System shall
124 be established in every Barangay, which will serve as the repository of information
125 for the Barangay Identification System. The Barangay shall provide the necessary
126 software, hardware, and other equipment for the said information system.

128 Section 15. Confidentiality – The Punong Barangay and the Barangay Secretary
129 shall ensure that the entries in the information system are kept confidential and
130 accessible solely for official purposes. The data and information contained in the
131 Identification Card and the information sheet shall not be used for any purposes other
132 than identification.

134 Section 16. Validity of Barangay IDs Issued Prior to the Implementation of this
135 Ordinance – All Barangay IDs issued prior to the implementation of this Ordinance
136 shall remain valid until the expiration date indicated therein. In the absence of an
137 expiration date in the Barangay ID, the same shall be valid only until December
138 2018.

140 Section 17. Penal Clause – Any person who obtains a Barangay ID Card from more
141 than one Barangay shall be penalized with a fine of one thousand pesos (Php 1,000).
142 Any person, barangay official or not, who violates the provisions of Article 15 hereof
143 shall be civilly, criminally, and administratively liable under existing laws.

145 Section 18. Separability Clause - If any provision of this Ordinance is held invalid
146 or unconstitutional, the same shall not affect the validity and effectivity of the other
147 provisions hereof.

149 Section 19. Repealing Clause - All existing ordinances and resolutions of this City
150 found to be inconsistent herewith are hereby repealed or modified accordingly.

152 Section 20. Effectivity Clause - This Ordinance shall take effect after fifteen (15)
153 days following the completion of its publication in a local newspaper of general
154 circulation in Butuan City.
